      I used Vivant Smart Home (alarm) services in my previous home from May 2020 to June 2022. That included an installation of equipment that I paid for in the amount of $3379. Then I paid the monthly service fee for those two years. We sold our home at *********************************************************************) in June of 2022. I called Vivint to cancel my service. I wanted them to know that I was leaving behind the equipment that I had paid for and perhaps the new owner would want to use it. They deactivated my service and I thought we were done. A year later in July of 2023, I noticed a debit from my checking account for $40 from **********************. I called on August 8, 2023, to see what that was all about. They said they had only put my account on deferment and now they would charge me again. That is their mistake. They never contacted me prior to charging my checking account and they know I don't have any of their equipment (for over a year) and I am not using their services. I told them it needed to be cancelled immediately since we're not doing business anymore and that they are not authorized to charge my checking account again. They never made contact with me during that YEAR after I moved and discontinued service and never contacted me to say they were reinstating the account. They just started charging my checking account. This is a scam.Of course they are going to drag this out stating the need for a "30 day cancellation process. " This is only so they can charge my checking account another $40 before that "cancellation process" is complete. They have been unclear on the phone whether they will refund this $80 that they charged me for NO REASON. I am contacting you to help me get that back and to put them on notice that this is a deceitful business practice which much be stopped because I'm sure they are doing this to others.

      In her complaint, ****************** states that she sold her home in June of 2022. She states she let Vivint know that she was leaving behind the paid for equipment. ****************** states Vivint deactivated her service. She states in June of 2023 she noticed a charge of $40 from Vivint. ****************** states she contacted Vivint on August 8, 2023 and was told that her account was only placed on a deferment. She states Vivint never contacted her to say they were reinstating her account. ****************** desires a refund. 

      A Vivint representative has attempted to contact ****************** via email in efforts to resolve this matter. Vivint offers to cancel the account effective August 11, 2023 and to provide a refund from that date forward. 

      Vivints records indicate that ****************** signed a Purchase and Service Agreement (Agreement) on May 27, 2023. Records show on June 14, 2022 ****************** reported that she was moving and that the new homeowners may want to takeover the service. Notes show that ****************** was open to a deferment and a twelve (12) month deferment was placed on the account. Notes show ****************** was planning on getting new Vivint equipment installed in her new home. August 7, 2023 ****************** reported that she paid the balance for the equipment, notified Vivint that she did not use the service in over a year and threatened a lawsuit. August 11, 2023 ****************** provided the required Notice of Cancellation to cancel the account.

      I am rejecting this response because:

      1.  I signed the initial agreement with Vivant May 27, 2020 NOT 2022.  So I used the service for 2 years not 1 month.  

      2 - I never agreed to a deferment.  I casually told ******* in June of 2022 that I would be building a new home and may need a new alarm system at that point.  His words to me were that I should call back and WE COULD DISCUSS OPTIONS THEN.  None of that happened. 

      I NEVER AGREED that it would be OK for them to randomly start charging my checking account again when A - THEY KNOW I do not have any of their equipment.  B - THEY KNOW and could verify that I am NOT USING THEIR SERVICE  C - I did not sign anything or verbally agree that they could charge my checking account again for NO REASON.  Who does business like that?  

      They charged my ******* bank account $40,28 July 28, 2023 - UNBEKNOWST to me and again on August 29, 2023 $40.29 after I called to make sure it was cancelled.  They owe me $80.57.

      I got an email on Sept 1 from Vivant offering to settle with me for $61.08.  It said that they would deposit this into my bank account, however, I had closed out the card they had on file to prevent them from further charging me.  I gave them my new address to send a check.  

      I heard nothing.  A couple of weeks later I called and their rep took down my new address again and said they would send a check.  

      Of course, I've seen nothing.  

      Can you help me get that money?  It's less than the $80 they owe me but I was willing to accept since it was most of it. I'm pretty sure I"ll never see a dime. 

      Vivint should be on your list of bad businesses. Just because they "answered" does not make them a good business.

      Thank you for that message.  I responded to you as soon as I had something to report.  Here is an update on this complaint:

      My issue with Vivint IS NOT resolved because the check that Vivint mailed to me and that I deposited last week for $61.08 was INSUFFICIENT and is being CHARGED BACK to my checking account today.  In case you need proof of what I am saying, I am attaching a screen shot of my bank account today.  I also called my bank and they confirmed that the check was being charged back because of insufficient funds.

      Why on earth would a legitimate business send a customer a refund check when they have NO MONEY in the bank to cover it? 

      The only way this issue will go away is if they send me the refund money.  Maybe next time they should send me a cashier's check or money order that is guaranteed to be good.  

      I hope this is a reason to reopen this complaint.  They are playing games with both of us now with a response from their "legal" department while they are sending out an INSUFFICIENT CHECK.     .

      This company is an ABSOLUTE SCAM - On July 26th, a sales rep came to my door around 7pm while I was 9 months pregnant and basically was deceitful and lied about vivint all around. I am disgusted that this company exhibits such low morale when it comes to people in the community. I've called over 5 times on different occasions to have this canceled. I was told I can cancel ANYTIME come to find out, I had to cancel within three days, this was not explained to me by the sales rep, he never discussed any trial periods. I am a victim to this company and their lies and deceit. It was never explained I will have two bills, one from fortiva and one from vivint, two bills that equates to $150 for the next 5 years. I just had a newborn, so this means, this will be paid off once my newborn is 5. I called right before 30 days and the amount of run around I've received is ridiculous. It seems like fortiva and vivint is running a scam together. I see why there are numerous lawsuits against vivint. I am truly disgusted and will inform all my neighbors to stay away from vivint. I just want out of this contract, I do not want this equipment.

      In her complaint, Ms. ******** states that a sales rep went to her home on 7/26/23 about 7pm. She claims that he was deceitful and lied about Vivint. She has tried to cancel multiple times. She claims a trial period and the 2 bills totaling $150 for 5 years were never discussed. She called “right before” the 30-days and the amounts were discussed. 


      Vivint agrees to cancel Ms. ********’ service and loan upon the removal of the equipment from her home. 

      Vivint’s records indicate that Ms. ******** signed a Purchase and Services Agreement (Agreement) on 7/26/23with an initial term of sixty (60) months and an equipment fee of $3655.80. Vivint’s records indicate that Ms. ******** participated in an audio and video recorded survey in which she represented that she understood that she was approved for a Fortiva line of credit with a 9.99% APR and that she understood that her monthly payment to Fortiva is separate from her monthly Vivint fee. Vivint and Citizens will charge her separately for the following amounts pursuant to her Agreement. Vivint relied on Ms. ******** representations to ensure that she understood her commitments to Vivint as outlined in the Agreement.

      I am a victim of deceptive sales techniques.I have been tricked into a contract believing that I was in a 3 month trial by the alarm company Vivint.I didn’t know they had independent contractors and I’ve been telling this regional manager that I later found out that he was an independent contractor that I didn’t want this equipment anymore.I’ve been lied to and getting the runaround when I’ve been telling them that I didn’t want their services even before they installed everything.But he basically forced me to try their services.He then blocked all my calls and texts.They told me there’s nothing I can do but he signed and told me everything to say for me.They also put a hard hit on my credit.I was not aware any of this was going on until I checked my credit and received a bill of 4 thousand dollars.I want this equipment out of my house.I want to get out of this contract that they put me in.I want to dispute this off of my credit.& I never want to hear or see them again!I have not given them any of my banking info to pay for this mess and I don’t plan on it.

      I agreed to co-sign for my friend and her fianc. I was told by the salesmen (two of them) that I would only be using my credit to co-sign for my friend and that I wouldnt be financially responsible. My friend and I had a falling out and I moved out. Since then she and her fianc have ended their relationship and since both moved from the residence. I tried to take my name off the contract since I was under the impression that I was just co-signing. I was told I was the account owner and unless I paid off the remaining balance I could not remove myself, even though she would still be on the contract. Not only that but we are still getting charged monitoring fees when the cameras arent even installed. I was told that even though the cameras arent installed Im still having to pay for the service. My main complaint is the way I was illegally misinformed upon my signing the contract. I was explicitly told I would not be financially responsible but it turns out not only am I, but ** also the account owner. The only acceptable resolution I would be satisfied with is a complete cancellation of my contract, including equipment and monitoring services, and anything else Im paying for, and a zero balance on the account. ********************** is a horrible company and their dishonesty is ridiculous. I want no further relationship with them.

      ************************* from Vivint came to my home on 8/3/2023 and sold me a security system that had several components immediately stop working and when I reached out to Bassil for service he told me a technician would be contacting me but no one ever did and now Bassil stopped responding to me entirely.Contacting customer support has yielded the same result , they refuse to cancel the contract and only offer to have a tech call me for an appointment but no one ever does.I feel at this point I may need to hire legal representation .

      Jan 17 2023 I canceled service with vivint for several reasons;
      *Poor customer service
      *I reported faulty equipment, a technician was sent to replace equipment but the parts replaced didn't fix the issue.
      *I was told on 8/22/2022 that my loan would be settled with a payment of $267. When I canceled service on 1/17/2023, I received an email stating the cancellation was incomplete due to an unsettled loan.
      *vivint has continued to draft money from my account even after it was verified by their representative the loan was settled with the $267 payment.
      *shortly after my cancellation email from 1/17/2023, the motherboard began to emit excessive heat and smoked/discolored my wall directly above the motherboard. I called to express my concern, I was told I would be contacted by a representative but no one contacted me.

      Vivint has the worse customer service, ********************** sys, ********************, and equipment is poor for the price they charge for it. We started w/Vivint in 2017 when a sales person convinced ** to go with them. We had two other companies who actually scheduled time to meet with us. From the start we had delays in installation, the video quality was not good. By the time we decided we didn't like it we were already stuck in the agreement. Three years later we moved. They charged us to uninstall & reinstall. The fee was ridiculous but we had no choice because we didn't know anything about installing the equipment ourselves. Same equipment with exception of the door camera. Fast forward, we move again in 2021. Same uninstall & reinstall fee, only this time they didn't install the door camera. We waited and waited, still nothing. I called several times and they finally told me the camera was backordered. We never got the door camera. They eventually told us they no longer carry it and we had to get a new panel that works with the new door cameras. Well that was gonna cost for which we didn't have the budget to do. Also, when we moved they set the agreement up for a 60 month agreement instead of month-month. We were not clear at the time that we would be stuck with them for 5 years. The batteries die fast, video quality is poor, no door camera that was returned to us, and we don't get a call when the alarm goes off. In May 2023, we decided that Vivint was just not working for us. We started the cancellation process, they deferred our payments for two months so they can determine if they will cancel us. I didn't see any reason why they wouldn't. Until we got a letter stating that our cancellation request was not approved. I've never been in a situation where you're forced to stay with a company when you're dissatisfied. The only resolution is for them is to cancel service and close account without penalty. I don't feel safe and don't have confidence in their service or equipment.

      In her complaint, **************** states that she has been with Vivint since 2017. She has moved her system to new homes twice. The last time she moved was in 2021. At that time her doorbell camera was not installed because that model was no longer made. To install the new version, it would require upgrading her system which was not within her budget. She wants to cancel but was told she has 3 years left on the 5-year contract. She wants to cancel without an early termination fee. 

      Vivint agrees to give a one-month credit of $53.88 for her past due monthly balance. Vivint agrees to cancel ****************** account and waive the remaining 45 months of her contract and the early termination fee once she pays the remaining past due balance of $62.94.  

      Vivints records indicate that **************** signed a Purchase and Services Agreement (Agreement) on 6/26/21 with an initial term of sixty (60) months. Vivints records indicate that **************** had her monthly payments deferred for 2 months on 5/11/23 adding the 2 months to the end of her agreement. Vivints records indicate that **************** called to cancel on 5/12/23, was given agreement buyout and cancellation information.  

      A representative from Vivint has reached out to ************** in an effort to resolve this matter. Vivint has agreed to the above resolution and ************** may contact Vivints representative directly if she has any further questions or concerns.

      On two occasions weve had vivint sales reps come to our door when we have a no solicitation sign. The first rep we asked multiple times to leave our property and he kept talking and pushing for referrals and making jokes about the fact that I was asking him to leave my property. He mentioned he stopped by because he saw our doorbell wasnt working. On 8/24/23 a sales rep stopped by and said the same thing that he only stopped by because he saw our doorbell wasnt working and I asked if he saw our no solicitation sign to which he said he did. Its illegal in CA to solicit to a home w a no solicit sign but even after pointing this out the sales rep kept talking and showed he very much did not care. Vivint is obviously training their sales reps to use predatory, aggressive, and illegal sales tactics and I would under no circumstances pay money to this company.
