Are these people legitimate? They certainly didn't do enough to convince me over the phone. Anyone can spoof a number and claim to be someone else; that's frighteningly easy these days. So when I receive multiple calls from Potential Spam, if I call back at all it's to tell them to take me off their call list. I shouldn't have to go scouring the internet to prove their legitimacy when they called me first.Business Response

Better Business Bureau:
I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
I am not satisfied with the provided solution because: the number you provided is incorrect. ************** is a private citizen's number, who has stated that Receivables Management Solutions has incorrectly handed out their number multiple times.Since I have received a response to my original complaint, I am at least somewhat more confident that Receivables Management Solutions is a legitimate company. My original complaint was that I could not confirm the company's identity when they reached out to me via phone, as they were listed on my caller ID as "Spam Likely." While it may be unwise on my part, I do occasionally answer these calls in order to ask companies to add me to their Do Not Call lists.
Regarding other attempts at communication: paper mail is not a very good way to reach me. If you provide an accurate phone number, I will gladly reach out to settle any legitimate debt. In the spirit of cooperation, please also be advised I can be reached at my personal email, ******************

I have reviewed the offer made by the business in reference to complaint ID ********, and find that this resolution would be satisfactory to me.The phone number provided this time was correct. The representative I spoke with was much more helpful than the obtuse representative I had previously worked with. I have also attempted to provide the representative I spoke with an updated mailing address, though phone or email remain the best ways to reach me.
If the company does not perform as promised I can get back to you at: **********************************************.

RECIEVABLES MANAGEMENT SYSTEMS is report a account#############**** from elephant insurance on my credit report in the amount of $113.00 that i do not owe. They have never provided me with a contract or any other documentation that is verifiable evidence that I owe them.Using as a example ****************************** vs. LIBERTY MUTUAL INSURANCE COMPANY. 1 Mass. App. Ct. 569 February 21, **** - November 30, **** Suffolk County. And it says: To the limited extent to which it is set forth in the declaration the transaction before us is similar to that in the ******* case. There the insured was offered a plan under which the annual premium could be paid in ten instalments with a down payment of ten percent plus a flat monthly service charge. If an instalment were not paid when due, the sole remedy available to the insurer was cancellation of the policy. Indeed, in the event of cancellation for any reason, the insurer could make no claim for any premium earned for coverage already provided but not paid for by the insured. The court concluded that the insurer was not a creditor of the insured, that the transaction was not a consumer credit transaction and was not subject to the Truth-in-Lending Act. ******* v. Allstate Ins. Co.,It also states:the ********************* have consistently taken the position that insurance premium financing plans "in which the customer is not obligated to make remaining payments but may elect to cancel at any time by simply not paying an instalment when due, would not create the creditor-debtor relationship required before a transaction becomes subject to [the disclosure requirements of] Regulation Z." Hello - We are a third-party debt collection agency, there would not be any contract between us and the consumer. We are collecting on behalf of our client, which owns the debt this consumer has. In regards to the two accounts, we have been accurately reporting one account *********************) that this consumer paid in full as allowed by law. I have reviewed the offer and/or response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.Receivables Management Systems is in violation FCRA because they have not provided a contract with my signature as I am entitled.
Additionally Receivables Management Systems has NOT cease and desisted because they are still attempting to collect a debt they have NOT verified as mine; contract with my signature. Furthering they are still reporting this debt which is a form of collection NOT a cease and desist. Furthermore they did NOT cease reporting this collection while they investigated my dispute. These are multiple violations of my consumer rights.
I repeat I do not have a contract with Receivables Management Systems and they have not sent me a contract with my signature.
I request once again that they stop reporting this account to Equifax that they have NOT verified as mine.
