Our office received an account from the creditor ********************* with respect to this consumer in January 2019 for recovery of unpaid auto insurance premiums. Please note the balance due was not owed to ***** & Weiner. We were collecting on behalf of *********************. Initial correspondence was sent to the consumer. There is no record of any mail return. *********** records indicate that coverage was for a***************************************** ***** The policy cancelled November 2018 and the final payment in September 2018 was insufficient to cover the final balance due on the policy. Our records indicate validation and verification has been forwarded to the consumer. As stated earlier, there is no record of any mail return. There is nothing noted on the file that indicates the charges are fraudulent. Our office will gladly review any documentation provided by the consumer with respect to the policy, vehicle, payment, or coverage specifics for this account that may indicate the creditor's records are not accurate. This is a formal complaint against ***** & WEINER located in ******* ***** *** This company has repeatedly violated my consumer rights under the Fair Debt Collection Practices Act and has caused me much unnecessary financial AND mental distress. For starters, they're reporting an erroneous & unverifiable collection account on all 3 of my credit reports, and not to mention an account in which I've asked for proof of claim and in which they have refused to validate per my request under the Fair Debt Collection Practices Act. Despite my efforts to resolve this unfortunate nightmare for nearly a year now, ***** & ****** has completely ignored my communications and legal submissions to remove this inaccurate information from my credit reports. I am well aware of the many, many other complaints filed against this company for their illegal and ********* collection practices - ********** themselves under multiple business names and using ILLEGAL collection practices all across the country. Yet, somehow, this company is still in business. This company's ************** & ********* behavior has caused lots of serious harm, not only to my ability to establish credit & good interest rates, but also to my character as a Professional and as an individual. Please help me, and the many other consumers just like me, to put a stop to the operation of these unethical & immoral business practices immediately. I sincerely appreciate your time and assistance in this matter and hope to hear from you very soon. As previously stated, this collection company is reporting erroneous, derogatory information about me to all three major Credit Reporting Agencies which is killing my credit & my Professional image. They've refused to send any proof of their claim because they have none since this account has never even existed. Our office received an account from the creditor ********************* with respect to this consumer in February 2022 for recovery of unpaid auto insurance premiums. Initial correspondence was sent to the consumer at that time. We spoke to the consumer in June of this year. He stated he would send in money orders. Numerous unsuccessful attempts were made to contact the consumer. The client's records indicate coverage was provided for a **** ******** *** on a *********** account ending in ***** The account was cancelled December 2021 and the final payment made in November 2021 was insufficient to cover the remaining balance on the file. Our records indicate the consumer called in and paid the delinquent balance on November 11, 2022. Once the payment posted, our office notified the credit bureaus to remove any derogatory tradelines associated with this file. Our records show no current derogatory remarks reporting to the credit bureau. However, we are unable to communicate how fast the associated bureaus update their records. The consumer may be able to expediate removal by contacting the associated bureaus. The consumer can contact our office at XXX-XXX-XXXX if he needs additional assistance.

Keep calling into the company, and they keep stating that their system is down. We've tried to make a payment for ****** ******** but their system has been down for weeks, or so they say. I am reaching out to ***** Weiner dealing with a collection that has been placed on my consumer file. I request that ***** Weiner present the original signed contract showing where I entered this transaction. As a collections agency, you are required to produce all original signed contracts, NO ****** OR ************* I am also requesting that ***** Weiner produce their *** Insurance Policy Number and their license to prove that they are in fact debt collectors they are claiming to be. I am aware that any documentation that is submitted that is not what I requested is considered fraud. I am also requesting that ***** Weiner produce me their chain of title showing the paper trail of where and when the debt was sold to them. On April 12, 2022, ***** & Weiner received my certified letter requesting validation of the account listed as ******** on my credit report. This collector never provided me with an initial notice, nor did they reply to my request for verification after my letter of dispute. I first discovered this account when reviewing my credit report for accuracy. I did not recall having an obligation to any collector in the amount the debt collector is alleging. Under ***** Consumer Law, where a consumer has disputed the accuracy of an account in writing to a third-party debt collector, the debt collector is mandated to send a letter in writing to the consumer within 30 days either: (1) Denying the inaccuracy of the account; (2) Admitting the inaccuracy; or (3) Stating that the third-party collector has not had adequate time to investigate the inaccuracy. See ***** Finance Code ************** I did not receive a response to my request for information or documentation within this specified 30 days.
