    There is advice on my consumer report thats is identity theft. I did not provide written authorization or instruction for these transactions to be reported on my consumer report. Im requesting that this info is blocked and ERASE immediately. You have caused me mental and financial stress when you issued an items that does not belong to me and in which I am not responsible for. I'm seeking litigation if this complaint is not handled accordingly. I have not been able to investment my dream house and provide for my family needs due to these fake, inaccurate and fraudulent items showing on my credit recvord. I attached a letter along with ftc report.

    Our policy is to mail correspondence to all consumers. Initial correspondence was sent to the consumer March 7, 2022, to the address provided by the client.   We will send a request to the credit reporting agencies to note this account as disputed.  As per the consumer's request, the account has been flagged as 'Cease and Desist'. The consumer will receive no further communication from our office. A cease and desist will not remove a valid entry from the consumer's credit report but it prohibits our office from contacting the consumer.  We ask the consumer to send ** the Identity Theft reports (police report, FTC report, etc.).  Once received by our office, we will send a request to the credit reporting agencies to have this account removed from the consumer's credit report.  As a 90 -year old company, Caine & Weiner wants to help consumers in any way possible.     Our policy is to mail correspondence to all consumers.  The account is not owned by Caine & Weiner, therefore, we do not provide contracts.  Caine & Weiner is a collection agency and as such represents a variety of creditors.  Records indicate that we mailed correspondence to the consumer April 5, 2023, to the address provided by the client.    We will send validation to the address provided in this complaint.  This account will be reported to the credit reporting agencies as disputed.  As the consumer noted, this account is specific to an automobile policy.  Any contract with the consumer would have been initiated with the original creditor.   As a 90 -year old company, Caine & Weiner wants to help consumers in any way possible.  We encourage the consumer to call our office at ************ and ask for a manager for further assistance.  We may also be contacted at www.connectcw.com.

    In accordance with the Fair Credit Reporting act Convergent account ********************** account #******** has violated my rights 15 U.S.C **** section 602 A states I have the rights to privacy. 15 U.S.C **** section 604 A section 2. It also states a consumer reporting agency cannot furnish a account without my written instructions. On OCTOBER 4TH, 2022 account #******** was opened under my name without my knowledge or consent and was used and left a $412 balance. I reached out to the credit bureaus for verification of accuracy and they said they did and I found improper inaccuracies on my credit report even after the credit bureaus thorough research. I demand this account be deleted expeditiously from my report being that the name was entered incorrectly but the perpetrators were still able to furnish a credit account with this company.

    Our office wishes to assist the consumer in any way possible.  However, the consumer is misinformed with respect the credit reporting process.  As an agent for the original creditor our office does not need a consumer's permission to submit an eligible file to the credit bureaus.  Based on communication received earlier this week, our office is working with the creditor to provide validation information to the consumer for review.  Our records do appear to indicate that we have reached out to the proper party with respect to this account and that the balance remains due.   We encourage the consumer to contact our office at ************ for additional assistance.

    In accordance with the Fair Credit Reporting Act.Everything has to be 100% accurate on my credit report.The Credit bureaus stated my account was properly investigation but how is that possible if the open date is inaccurate, the date last active ** inaccurate, and date last reported is not accurate. This ground for removal they also violated my rights under 15 U.S.C **** Section 602 A States I have the right to privacy.15 U.S.C **** Section 604 A Section 2: It also states a consumer reporting agency cannot furnish a account without my written instructions or consent.

The consumers states that his credit report contains inaccurate information.  Our office can not provide information on the reporting structure of the credit bureaus.  Our records indicate we sent correspondence to the consumer January 10, 2023.  Correspondence was sent again in February and the last correspondence, a copy of the validation, was sent May 8, 2023.  As a 90 -year old company, Caine & Weiner wants to help consumers in any way possible.     I am rejecting this response because:

    I do not sign any contract with this debt collection they know they going to get tax credit with this debt anyways I can't be paying again if they gonna get debt paid with tax. Why it is on my credit report without my written permission it is illegal to put on my credit report it is unacceptable. I'm trying to fix my credit report they better negotiate and pay to delete if they are not going to do that then shouldn't report because it is under $500 it is not suppose to report anything less than $500.

    I do not have a contract with CAINE & WEINER. I am not liable for the collection of this debt from Progressive. I am not responsible for this debt. I request that all mail, calls, and emails cease, I would like NO COMMUNICATION WITH THIS COMPANY. American Jurisprudence, 73 Am Jur 2d. Sections *****; it says that one cannot subrogate onto a contract that they were not originally on, did not have any interest to protect, and then claim successor in rights and interests. Thus, when an original credit sells the debt, they give up their rights to collect on the debt, BUT they do not give those same rights to the collection agency. The collection agency cannot act as a substitute for the original credit.

    As the consumer noted, the debt in question is for a Progressive automobile policy.  Caine & Weiner is not the owner of the debt.  Our company does not buy debt, we collect on behalf of our client(s), who in this case happens to be Progressive.  We mailed correspondence to the consumer September 19, ******************************* this complaint.  We will send validation to the address provided in the complaint.  We will also contact the credit reporting bureaus to report the account as disputed.   Per the consumer's request, we will close this account as a cease and desist.   As a 90-year old company, Caine & Weiner wants to help consumers in any way possible.   We encourage the consumer to call our office at ************ and ask for a manager if further assistance is needed.  We may also be contacted at www.connectcw.com.

    This is an account which dies not and has never belonged to me ! This company wants me to lie and state it is fraud! This is not my account and it should be removed within 7 days or I will be forced to *** for $20,000! This has slandered me, caused me to lose housing, financing and more!

    The consumer states she has never had car insurance.  We have reviewed this complaint and our records, and we believe we have the correct consumer for this account.  We will send a request to the credit reporting agencies to note this account as disputed.  If the consumer believes she is a victim of identity theft, we ask the consumer to send us the Identity Theft reports (police report, FTC report, etc.).  Once received by our office, we will send a request to the credit reporting agencies to have this account removed from the consumer's credit report.

    We appreciate the consumer's concerns and wish to assist in any way possible.  Our office is assisting the creditor in resolving a past due balance owed by the consumer per the creditor records.  It is accurate that the consumer would not have a contract or directly relationship with our company.  However it does appear that the information provided to our office by the creditor is accurate with the respect to this consumer and indicates a remaining balance specific to an auto rental in 2020.  We do show sending information to the consumer upon receipt of the account but records indicate we were unable to reach the consumer by phone.  Our office will resend information to the consumer for review.  We encourage the consumer to contact our office at ************ and ask for a manager for additional assistance.

    We understand that the consumer does not believe the balance is due, however the creditor records appear to indicate otherwise.  As noted previously we are working to provide additional details to the consumer from the creditor so that we may work toward an amicable dispute resolution.
