Our policy is to mail correspondence to all consumers. Initial correspondence was sent to the consumer April 20, 2017, to the address provided by the client. We will send a request to the credit reporting agencies to note this account as disputed. As per the consumer's request, the account has been flagged as 'Cease and Desist'. The consumer will receive no further communication from our office. A cease and desist will not remove a valid entry from the consumer's credit report but it prohibits our office from contacting the consumer. We ask the consumer to send us the Identity Theft reports (police report, FTC report, etc.). Once received by our office, we will send a request to the credit reporting agencies to have this account removed from the consumer's credit report. The consumer states that our office has not proved the debt is hers. As stated in the original response we are not allowed to call or send correspondence on a file that is in a Cease & Desist status. The consumer states that he does not have a contract with Caine & Weiner. Caine & Weiner is a debt collector. The debt is for auto insurance with Progressive. We collect on behalf of our client, Progressive. Our records indicate that we forwarded the initial letter to the consumer on November 26, 2018, to the address provided by our client. Validation was sent to the consumer on June 7, 2023, to the address provided in the complaint. An original contract would have to be secured through Progressive Insurance. For the past months, perhaps even a year, I have been receiving mail from ********************* addressed to a *********************. I originally would put the mail back in my box with return to sender, but I kept getting them. I opened one to see if it was junk mail, so that I could throw it away. It was not; it was for a payment due the ********************* Company. I returned that one to my mailbox, letting the *********** know that no such person lived here. The mail for ************ continued nonetheless. I became so fed up that I finally mailed one of these notices to the home ****** of *********** in *******. And yet I have received a few more after that and those, I simply tore up. Today I received a letter from a debt collector. When I called Caine & Weiner (two separate times - the 2nd was to apologize for becoming upset) the First **** hung up on me. Both ladies were most insistent about, Did you open the mail? Like I said, I did only once to see if it was junk mail, advertising, etc. But their tone was accusatory as if they could use this against me. I innocently opened that mail to see if it junk mail. I was trying to stop all this mail coming to me! Tearing up that later mail several times was probably worse. I have great credit and do not want this misinformation about a person I have never heard of to affect my credit. I have lived at this same address for 17 years. There has never been anyone by that name living here and I will not be responsible for his debt. I have never had insurance with ***********. (Now I know I never will.) I find this treatment to be harassment. First, from *********** for not doing a better job of following up on this delinquent customer. And now from a debt collector trying to make me feel that I am somehow responsible. Unbelievable!Business Response

I am not liable for this debt with Progressive and do not have a contract with Caine & Weiner. They did not provide me with the original application I asked for. I would like for a correction to be made to my credit report and item to be permanently deleted from credit file. This is not making any sense. According to the law 15 U.S. Code ****i- Procedure in case of disputed accuracy. If any item of information contained in a consumers file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, the agency shall, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller.Business Response

received a notice that I have a collection from CAINE WEINER on my credit report. It says it was opened on 02/12/2018 for $279.00 with account number starting in ******** that I am not aware of nor am I responsible for. I never went into business with this company or signed any agreements with them so they should not be reporting anything on my credit. I want to resolve the collection account that has been affecting my credit score for the past 5 years due to an auto insurance policy. The collection agency is unwilling negotiate a settlement.Business Response

The consumer states that our office is unwilling to negotiate a settlement on his delinquent account. The account in question is for an automobile policy, as stated in the correspondence submitted by the consumer. As such, the file does not belong to Caine & Weiner. We are not in a position to accept settlements that are not approved by our client. Our records indicate settlements were offered on the account in 2018 and 2020 for 50% of the balance. A settlement offer of 75% was offered in 2021. A settlement will not remove credit reporting. The credit report would reflect a valid entry of 'Settled'. The consumer believes that our office bought her delinquent debt. The debt in question is for a Progressive automobile policy. Caine & Weiner is not the owner of the debt. Our company does not buy debt, we collect on behalf of our client(s), who in this case happens to be Progressive. We mailed the initial correspondence to the consumer October 9, 2019, to the address provided by the client. Validation was mailed to the consumer January 6, 2023, to the address provided in this complaint. We will send validation again to the address provided. On 03/08/2023 I disputed the completeness and Accuracy of this collection on my consumer report and it has come back verified. I do not believe that Caine & Weiner properly investigated this account because there are obvious inaccuracies. The account has been re-aged by Transunion and Equifax. Experian is reporting the date of last activity as 07/01/2021 while Transunion has reported 05/10/2023 and Equifax is reporting 05/01/2023. This is a clear 2-year difference and once again it is Caine & Weiner's job to make sure this information is correct by conducting a proper investigation. Since you have not reported the date of the last payment it messes up two things. First, it shows does not help indicate when this account was actually charged off and secondly it manipulates the statute of limitations as I cannot tell when this account is supposed to fall off. This means that you were never given the true date of the first delinquency and this is causing me stress being reported Caine & Weiner has violated 15 usc 1681s-2b of the fair credit reporting act. Since they have verified this account as accurate and there are obvious inaccuracies they failed the 5 duties of a furnisher when receiving a dispute which are all violations from each credit reporting agency they are reporting too I am Demanding Deletion from my consumer report or else I'm going to pursuelitigation.Business Response

I am writing to file a complaint against Caine & Weiner regarding their violations of the Fair Debt Collection Practices Act (*****). The collection agency in question has added a debt to my credit history without any agreement or written authorization from me.Despite my request that they return the alleged debt to the original creditor, the collection agency has continued to pursue collection activities against me, which I believe is a violation of my rights under the ****** I have also requested debt validation, as is my right under the ****** but the agency has not provided me with any proof that I owe this debt.I believe that this collection agency has violated several provisions of the ****** including but not limited to:1.15 U.S.C. 1692e(2)(A) - falsely representing the character, amount, or legal status of the debt **** U.S.C. 1692e(5) - threatening to take any action that cannot legally be taken or that is not intended to be taken **** U.S.C. 1692e(10) - using false representations or deceptive means to collect or attempt to collect any debt **** U.S.C. 1692f(1) - using unfair or unconscionable means to collect or attempt to collect any debt I am requesting that the BBB investigate this collection agency for their violations of the ***** and take appropriate action to ensure that they cease all collection activities related to this debt and that they correct any negative reporting on my credit history.Business Response

The latest validation notice was send April 18, 2023. We will resend the validation on May 12, 203, to the address provided in this complaint.
