I have just finished an application and got approved not to long ago. I even got the email, it's been a few days and I have yet to receive the funds into my account. I don't want to be charged for something that hasn't even been deposited if it won't be. I need the help but I don't want to be charged for it if it's not in my account. We only process applications during business hours which are Monday - Friday. Jae's application processing would have begun on Monday, January 29th at the earliest, and funds would have been deposited into their account on Thursday, February 2/1/2024 at the latest. If Jae has not received funds, we would encourage them to contact our Online Customer Service Department at ###-###-####, and one of our friendly agents will be able to assist them with researching the issue. in 2019 I had a payday loan from Check N go. They were notified of the bankruptcy and provided the attorney's information. They continued to call me afterwards tryingt o collect. I filed a complaint through the ** Dept of Insurance and Finance. Check N go then apologized and sent a letter stating they would cease activity. Now forward 5 years later i get a call from ****** recovery services collecting for Check N GO. 1 check n go shouldnt be collecting on accounts discharged in bankruptcy. 2. if it was sold to a collection company a. it shouldnt have been b. they should be able to comunicate that to me. On Jan 9th I had conversation with check n go they claim to have no record of the transaction or account. I asked their colletion agency to validate the debt as allowed by the FDCPA they said burden a proof is on me because they ave my social and anme of my employer.
I expect to one know the name of the agency they sold the debt to and a physical mailing address that i may send a certified letter too. I do still have a copy of the original agreement as well as the letter from and to the department of insurance and financial services.
I was threatened with jail as apparently they are using a third party that is india or over seas. This is illegal the number they are calling from is ###-###-#### the collection agency is ****** recovery services also out of ohio.
please provide the validation of debt and the contact information to the company you sold the debt to. the date the debt was sold. Was it before or after you were notified of bankruptcy procedings. I WOuld like some one to reach out to me from the corprate office as I have called and left a message on Mr davis cell phone.

They offer an extended payment plan for my state after you have had 3 consecutive loans with them. I have borrowed from them consecutively since September and so I am currently on my 5th loan. I called to request the payment plan and they denied my request stating I have not had consecutive loans as they weren’t requested within 7 days of each other. Last month their website had issues while I was trying to submit my application and I had to have them withdraw it and resubmit it several times. This was not an error on my part and I explained it wasn’t fair for them to hold that against me. They also made me wait to reapply in October. I believe they intentionally make it more difficult for consumers to reapply so that they will not be eligible for the repayment plan that allows consumers a chance to get caught up and escape the payday loan scheme. They are using predatory lending practices by not having more options for consumers to get ahead. I have had 8 loans with them throughout this year allowing them amble opportunity to collect interest and fees from me.Business Response

contacting Check ‘n Go regarding her previous loans. We understand there
is some confusion surrounding consecutive small loans in the state of Indiana
and the requirements associated with extended payment plans.The State
of Indiana defines a consecutive small loan as “a new small loan agreement that
the lender enters into (with the same borrower) not later than seven (7)
calendar days after a previous small loan made to that borrower is paid in
full.” Indiana small loan regulation states that once a borrower has
entered into an initial small loan followed by three (3) consecutive small
loans, the lender is required to offer the borrower an extended payment plan
for the third, fourth or fifth consecutive small loan. This is required
unless the borrower has defaulted on a previous small loan and is only valid
until the borrower reaches five (5) consecutive small loans.Furthermore, Indiana Code § 24-4.5-7-401
states “If five (5) consecutive small loans have been made to a borrower after
the borrower's initial small loan, another small loan may not be made to that
borrower within seven (7) days after the fifth consecutive small loan is paid
in full. After the borrower's fifth consecutive small loan, the balance must be
paid in full.” This is often referred to as a cooling-off period.
Our records show Ms. ******* did have five
consecutive loans; however, she failed to initiate an extended payment plan
before the fifth loan was paid in full. As such, due to the mandatory “cooling
off period” she was required to wait 8 days to receive another loan. Per the
regulation, Ms. ******* will need to have three consecutive loans before she’s
eligible for an extended payment plan again and may initiate it on the third or
fourth loan, or before the fifth loan is paid in full.
This regulation was created and implemented
by the State of Indiana. Check ‘n Go is required to entirely adhere to these
requirements. As a result, we respectfully decline Ms. ********* request
to compensate her financially. If she has any additional questions or concerns,

We would like to thank Ms. ******* for contacting Check ‘n
Go regarding her previous loans, and her request to obtain an extended payment
plan. We understand there is some confusion surrounding the terms and
conditions of the extended payment plan, as well as the regulatory requirements
we must adhere to. We completed an investigation into the matter and have
provided Ms. ******* with multiple detailed responses, and we would like to
acknowledge that Ms. ********* claims of predatory lending and intentionally
being denied an extended payment plan are not true.
We would like to reiterate that the regulatory requirements
of Indiana Extended Payment Plans are put into place by the Indiana State
Legislature, and we are required to adhere to those requirements in full. This is not a matter of corporate
policy. We are legally prohibited from
issuing an Indiana Extended Payment Plan to customers who have not met the
required criteria. These criteria were conspicuously disclosed to Ms. *******
within the Loan Agreement she signed prior to accepting her loan, and we have
included them below for reference.
Consecutive Small Loans: “Consecutive small loan” means a new small
loan agreement that the lender enters with the same borrower not later than
seven (7) calendar days after a previous small loan made to that borrower is
paid in full.
At
the time you enter the third, fourth, or fifth consecutive loan, the lender is
required to offer you an extended payment plan (EPP). You may request an EPP at
any time during the term of a third or subsequent consecutive small loan so
long as you have not defaulted on the outstanding small loan.
Once you have entered into an EPP, you will
not be able to enter into another small loan transaction with any small loan
lender until the EPP is paid in full. A seven-day cooling-off period applies
after you have had a total of six loans (an initial loan followed by five
consecutive loans) with any one lender.
Ms. *******’s loan history has also been included below as a
point of reference. It confirms the loan
she is referencing (opened on 12/26/2023) is not eligible for an Indiana
Extended Payment Plan.

The loan she obtained on 11/1/2023 reset the consecutive
loan count and was considered the new baseline (or loan #0). It is not to be considered the first
consecutive loan. The loan she obtained
on 11/27/2023 and paid off on 12/19/2023 is considered consecutive loan #1 (as
it was the first loan obtained after the initial small loan on 11/1/2023).
The loan Ms. ******* is referencing in her complaint was
obtained on 12/26/2023. It is to be
considered consecutive loan #2 (as it is the second consecutive loan she
obtained after the initial small loan on 11/1/2023). As stated within multiple previous
responses- the reason Ms. ******* is unable to obtain an extended payment plan
on her current loan is because she is currently in process of paying off
consecutive loan #2, and extended payment plans are only permitted after
obtaining three (3) consecutive loans.
Ms. *******’s claims that technical issues with our website
prevented her from submitting a timely loan application are also false. A thorough review of several recorded phone
conversations between Ms. ******* and customer service representatives reveal
the technical issues she experienced on 11/25/2023 were related to a
discrepancy between the last name submitted on the application and personal
identification documentation she submitted.
This was quickly rectified when Ms. ******* submitted additional
personal identification documents to a customer service representative, and her
loan was funded accordingly two days later.
Two additional phone calls from 12/26/2023 were also
reviewed. In those calls Ms. *******
advised she was experiencing technical difficulties while attempting to submit
a new application. During that call, Ms.
******* acknowledged she was previously informed that utilizing a desktop
computer and Google Chrome to submit her applications was highly recommended in
order to reduce the risk of experiencing technical difficulties. Ms. ******* then acknowledged that she has
been attempting to submit her most recent loan application/documentation via
cell phone instead of a desktop computer, because “she just didn’t feel like using
a computer”. Once Ms. ******* submitted
her application via a desktop computer her application was successfully
submitted and she was able to obtain the loan.
In whole, these recorded calls confirm the technical
difficulties Ms. ******* experienced were not an attempt to deliberately delay
her applications, nor were they associated with predatory lending tactics. The issues she experienced were related to
discrepancies with documentation she submitted as well as her unwillingness to
submit her applications in the manner previously suggested to her. It is also worth noting that neither loan
where Ms. ******* claims to have experienced technical issues were eligible for
the Indiana Extended Payment Plan- as she has not obtained a new set of three
(3) consecutive small loans after the mandatory cool-off period expired.
Lastly, we would like to advise that Ms. *******’s current
loan has been placed with our Corporate Collections Department and is currently
past-due. We would encourage her to contact
our Corporate Collections Department directly at ************** to discuss her
loan and any options that might be available to her.

******* *******The three loans were submitted consecutively as is seen by evidence submitted by myself and the business. I would like the business to cease contact and communications with me in regards to this matter. If the business would have allowed the payment plan as they should have done with my third consecutive loan, then I would have made payment arrangements with the business in regards to the amount owed.
Their contact center representative led me to believe that I wasn’t eligible for being late on applying for my past previous loan. The business is now saying there are other reasons I wasn’t eligible. Their story has changed while mine has remained the same that it was my third consecutive loan with the company and I called to request the extended payment plan which is stated to be available on your third loan and was told I was not eligible due to being late on my application. I was delayed on my application because of the technical issues on their website.
I did attempt to complete the application via laptop computer as requested but was still unable to do so. The application was stuck asking for additional bank verification that it had never asked me to do on any previous loan applications. The screen would be stuck on a continual loop on both laptop computer and cellular device. I had always used my cellular device on previous applications without issue. That application was forced to be withdrawn and I had to reapply from their website issues and the new application didn’t ask me for that step again and it was able to be completed perfectly fine on my cellular device as it had been repeatedly in the past.
My last name was changed from a divorce I went through which was a factor in needing to use these terrible services to begin with. I’m not bothered if they have sent anything off to collections as I am not in a place to afford anything in collections at this time while I’ve been trying to rebuild my life. They had taken enough money from me over this time period and it’s been a sigh of relief to have broken free of their predatory cycle they keep consumers prisoners in.

They have not provided any proof of this collection. I have asked for checks/ paperwork/ signatures etc….. Nothing has been provided. This would be fairly easy to forward in my opinion. Fraud is one thing, but showing copies of what they claim I used in order to get a loan— is another.

This collection is on my credit report causing my credit score to decrease and making my history more derogatory.
They obviously had the means to initiate this collection, so I expect a more swift resolution.

I used Check N Go's services in March of 2022, I resolved my owed balance on April 4th of 2022. The local branch in ****** ****** did not apply the funds to my account, this caused Check N Go to send me to collections. I provided proof of paying my owed funds to both the local Check N Go Branch as well as their Coorperate Office, I am now being told that my settled debt was sent to a third party collection company in error and that they are attempting to collect a debt a second time and are refusing my proof of my account being Settle. Check N Go has yet to provide any solutions for the debt that has been settle that was sold to another party on 04/04/2023. I have attempted several times to provide proof of the settlement and they state I should hire an attorney to resolve it for me.Business Response

We can confirm that we have repurchased the loan from the third party and that *** ********'s account profile has been updated accordingly. We can confirm that her loan is now closed with a zero balance, and that she no longer has a financial responsibility associated with the loan.
