      for the correspondence regarding the **** Loan terms and conditions. The Xact
      Loan is an installment loan originated and funded by ******* ********* ****
      (“**Bank”), a **** Chartered bank, located in ***** ****, Member FDIC.  We have reviewed the complaint and appreciate
      the opportunity to investigate the matter and provide a response.


      During our
      investigation we reviewed all documents, notes, and recorded phone
      conversations pertaining to the complaint. We found that *** *********
      electronically signed an Installment Loan Agreement with **Bank on 7/12/2021
      for $3,000.00 with a finance charge of $7,123.47, for a total due of
      $10,123.47. The Installment Loan Agreement contained the Annual Percentage Rate
      of 210.4368% along with the Finance Charge, Amount Financed, Total of Payments,
      and an 18-month Payment Schedule. Bi-Weekly payments of $273.62 began on
      8/6/2021 for a total of 36 payments, with the final payment in the amount of
      $273.15. Records indicate copies of the loan agreement, and all federally
      required disclosures were provided to him through email.


      *** *********** request to validate debt, and request to remove information from
      his consumer credit report were reviewed. After completing an investigation
      into the matter, we can advise that Verification of Debt documents were sent to
      *** ********* (per his request) on December 19, 2022.  *** ********* was sent a copy of his loan
      agreement, a copy of the Federal Truth in Lending (TILA) Disclosure
      electronically signed by *** ********* on 7/11/2022, and a copy of his
      transaction history.  These documents
      contained a full description of *** *********** rights and responsibilities
      under his agreement.  They also detailed
      the amount financed, amount of finance charges to be paid, and the total amount
      *** ********* agreed to pay upon fulfillment of his agreement.  All validation of debt documents sent to *** ********* meet Federal requirements.


      Multiple
      attempts have been made to contact *** ********* including phone calls, emails
      and voicemails, however all attempts have been unsuccessful.


      Regarding
      *** *********** request to remove information from his credit report, we
      believe the reported information to be a**urate.  As such, we respectfully decline his request
      to remove the reported items.  Our
      records indicate that the loan defaulted and was sold to ******* ******* *********** *** on 06/22/2022 with a balance of $5,082.56. For any questions or concerns,

      would have no additional information as we are not the current owner and have
      not contacted *** ********* since the date of sale.

      I applied for a loan in person at the ****** ** branch onsept 5 2022 and was approved for only 990$.I WAS NEVER ALLOWED TO APPLY ONLINE AND STILL CANT APPLY ONLINE.I HAVE PROOF THAT 146.27 WAS POSTED ON JAN 3 2023 WHICH MEANS MY ACCOUNT IS supposed to be UPTODATE online BUT it says i still owe 146.27 online and i JUST SPOKE WITH CHECKNGO IN ****** ** AND WAS TOLD PAYMENTS WAS RETURNED ON NOV 5 AND DEC 5 AND THAT I OWE 292.54.ONLINE IT SAYS I OWE FOR JAN 3 2023 BUT I HAVE PROOF ITS PAID SO IM SUPPOSED TO BE UPTODATE.I want to be able to apply online because i know the online contract would have different details like me being loaned more money and having less interest.Can you remove this off my credit and allow me to reapply online

      We want to thank *** ******** for contacting Check ‘n Go regarding her account. We understand
      that there is some confusion with the terms and conditions of her loan. We
      completed an investigation into the matter and advise *** ******** currently has an in-store installment loan for $990.00 that was taken on 9/19/2022. The terms of the loan agreement were reviewed with *** ******** at the time of the loan and consist of a finance charge of $1,496.35 along with the $990.00 that was borrowed for a total due of $2,486.35.  The loan agreement contained the annual percentage rate of 143.24%.  The loan was taken for an 18 month term.  Payments are due monthly on the 3rd of each month in the amount of $146.27, with the last payment being $157.85.  At this time *** ******** has made one payment and two payments have been returned by her bank.  The return reason is showing as account closed.  if *** ******** would like to provide proof of payments clearing, we would be more than happy to review and update her account if necessary.

      Within the complaint *** ******** also addressed her inability to apply for an online loan.  *** ******** can set up an online account through P360 at any time, however a customer may only have one active loan open with the company at a time.  She would need to pay off the in-store loan in order to apply for an online loan.  We are unable to guarantee her approval as the determination is made by underwriting.

      Regarding *** ********'s request to remove information from her credit report, we believe the information to be accurate.  As such, we respectfully decline her request to remove the reported items.  The only agencies we currently report payment information to are ******** and **********, and only if reporting is permitted in the applicable state. After a loan is opened or a payment is made, the payment information is reported the following month. It will then take anywhere from 45 to 60 days for the credit bureaus to update the information on the credit file. It is possible to see the update sooner; however, it can take the full 60 days.

      This company appeared on my credit report today, but I have never heard of them or opened an account with them. This is fraudulent. The only thing I did on 11/8/22 was go to the dentist when my crown broke.

      ******** and *** in ************ **. The business was locked, I knocked on the door and they buzzed me in, I had my son with me and they would not allow my son accompany me. I am disabled. I had previously spoke with someone by the name of Keisha new that I would be coming. I spoke with Keisha during this time. I wanted a 300 dollar loan but when I left the store I noticed that I had a 1000.00 loan instead. I was given a credit instead of a check. Even when I was informed that I was would be given a check. I went in person to Check N Go in ************ **. on ******** and *** The address (**** * ******** *** ************ ** *****) I informed them that I did not want that amount, and that I would pay the interest. They would not take the card back. I did not feel safe in the store because the had the doors locked and I feel like they were not listening to me while I was informing them that I did not want that amount. I do not want to pay 305 percent for a loan in the amount of 1000.00 that I did not ask for. I wanted to borrow 300.00

      We want to thank *** ******* ***** for contacting Check ‘n Go regarding her loan. We understand that there is some confusion with the terms and conditions of her loan. We completed an investigation into the matter and advise we tried calling to discuss *** ****** concern; however, the phone number we have on file is disconnected. We also tried to reach out via email, but the email was returned undeliverable. 

      We were able to review store camera footage and would like to respond to the claims made. For the safety of our customers and staff the doors of the location are locked and customers are buzzed in. At no time did the staff deny *** ****** son entrance. He did not attempt to come in the location with her when she entered. Towards the end of the transaction her son did try to enter and one of the associates asked if the son was with *** ***** and then unlocked the door. the son did not enter the location. One of our associates then went outside and spoke with her son for a few minutes while she was on break. 

      *** ***** stated she asked for $300 but the loan was originated for $1000. Again store footage and audio was reviewed. The associate explained to *** ***** that the max amount she was qualified for was $1010 and what the payments would be for that amount. At no point does *** ***** say anything about $300. She agrees to the terms of the $1010. The associate did review the terms of the loan agreement with *** *****. The option of a check or a ******** prepaid card was given to *** ***** and she chose to take a ******** card. It was also explained that *** ***** could rescind her loan in cash until close of business the day after the loan was originated. We cannot accept the ******** back as payment in order to rescind the loan. 

      *** ***** is more than welcome to payoff her loan at any point and apply for another loan.

      I have reached out to CCBANK/CNG. They have failed to provide proof of validation regarding a debt that does not belong to me. They have furnished this alleged debt on my consumer report and have failed to validate the alleged claim pursuant to Sec. 809(b)of the Fair Debt Collection Practices Act and according 609(a)(1)(A), you are required by federal law to verify, through the physical verification of the original signed consumer contract, any and all accounts that you post on a credit report. I demand this item be removed from my credit report immediately. CCBANK/CNG you are furnishing inaccurate and incorrect information to the consumer reporting agencies.
      The reporting of such inaccurate information has caused severe damage to my character, my reputation, my general mode of living and my ability to obtain credit for personal and house purposes.

      I had done a cash advance with this company and then lost my job. Since then, a Shawn O******* and the company has harassed my family and myself. Threatened to have me arrested for fraud. Threatened my family with having me arrested. They have called at least 5 people in my family. If they called more I have not been made aware. When I told them to quit harassing and threatening, they told me it was my fault for committing fraud. Now I have never denied the fact that I owe money but due to the stress and harassment I don't feel like they should be getting anything from me. I am graduating with a business management degree in two weeks and I am very well aware that their actions are illegal.
