Our office received an account from the creditor, Progressive Insurance, with respect to this consumer in August 2022 for recovery of unpaid auto insurance premiums. Please note the balance due is not owed to ***** & Weiner. Initial correspondence was sent to the consumer at that time. There is no record of any mail return. Our records indicate that the creditor still shows the balance as due by the consumer. The Progressive policy was cancelled in July 2022. Creditor records indicate coverage was provided for a 2019 Honda Civic SI and a 2019 Mercury CLA250 on a Progressive policy ending in 9582 and that a payment made in June 2022 was insufficient to cover the premium balance due at the time of cancellation. Despite numerous attempts we have been unable to contact the consumer. Validation has been forwarded to the consumer for review. If the consumer believes Progressive's information to be incorrect, our office will gladly review any documentation provided by the consumer with respect to the policy, vehicle, payment or coverage specifics for this account that may indicate the creditor's records are not accurate. Please note that this is not a refusal to pay off the account but a notice sent as per the Fair Debt Collection Practices Act ******** ** ****** § **** (G) Section *** (B). This notice states that your claim is disputed and validation of the account is required.
This notice is not a request for verification of the account or proof of my mailing address but a request for validation made pursuant to the ***** laws. I humbly request that your agency / office sends me valid proof of claim that I am legally obligated to pay you.

I would like to inform you that in case your agency has reported invalidated account information to any of the three main credit bureaus such as TransUnion, Equifax, Experian, then it will be regarded as a fraudulent action under both federal and state statutes. Due to this reason, if any negative item is reported to any of my credit reports by your agency or the agency that you represent, then I will be compelled to take legal steps against you for the below mentioned reasons:

I would like to further inform you that if any action is taken during the validation period which could be regarded as detrimental to any of my credit reports, then I will seek advice about initiating a potential lawsuit. If your agency can provide me with the requested documents, I will need a minimum of thirty (30) days to investigate this information, and during this period of time, all collection activities must be stopped.
Also, I request that you provide evidence that I must pay you in anything other than appropriate commercial paper should the debt be proven valid because, to my knowledge, the U.S. Congress provided the appropriate solution for me to settle my debts via the remedy in House Joint Resolution (H.J.R.) 192 of June 5, 1933 under the United States, Public Law § 73-10, and Public Law 48 stat. 112 (among others).

Our office provided the name of the original creditor in the initial response. Validation was sent to the consumer on January 4, 2023. There is no record of any return mail in file. Validation confirms what the Progressive policy covers and the amount owed to the creditor. The account has been in this office since August of 2022. The consumer should contact Progressive if he is looking for a copy of the original contract. His contract was not between he and ***** & Weiner. Our office collects on behalf of the creditor, Progressive. If the consumer wants proof of our license and registered agent status, he can contact his Secretary of State. The account has been closed in our database and the negative tradelines will be removed from the associated credit bureaus. However, Progressive reserves the right to pursue the balance as they deem fitting. Caine & Weiner have caused a derogatory account on my credit profile making me look as if I'm a risk to potential lenders. The Progressive poliy ending in **** was cancelled July 2019. Creditor records indicate coverage was provided for a **** ******* ***** and a 2010 Chrysler Town & Country. The account is currently 'Paid in Full' and all negative trade lines have been removed. We do not show any current trade lines reporting to the credit reporting agencies. We are unsure as to how long it may take for the credit bureaus to update their records. The consumer mentioned wanting the original contract. Progressive can provide the original contract. I believe this account is reporting inaccurately. I do not recall having an account with this company. I don't think there is legal contract between this company & myself. The individual filing this complaint is listed per creditor records as a personal guarantor on the account. The balance owed does not represent a consumer debt.
System notes indicate that we have been unable to reach the business by phone. We do not show receiving any correspondence directly from the business.

My husband and I had a policy with *********** that had then lapsed due to unpayment. *********** then sent both of our license down to be suspended for failure to pay. Policy was restated and paid through *********** itself. Please take off both collection filings off of our reports due to double dipping. The insurance company charge a big lump some of payment to initiate a new policy and the unpaid balance of the previous policy. *********** never mentioned the previous policy balance was still owed. I say double dipping because my husband and I were both on the policy and for my credit report it shows another balance.

Initial correspondence was sent to the consumer at that time. There is no record of any mail return. Numerous unsuccessful attempts were made to contact the consumer. The client's records indicate coverage was provided for a **** Acura 3.2 TL and a 2008 ****** Altima on a Progressive account ending in ****. The account was cancelled April of 2022 and the final payment made in January 2022 was insufficient to cover the remaining balance on the file. The original contract was with *********************. We collect on Progressive's behalf. Progressive should be able to provide the original contract for the debtor's perusal. Our records match the consumer's information provided in the complaint. Our office forwarded a 'Fraud' document to the consumer in October of this year due to a claim of 'Fraud'. I just recently got an alert from ******** that my credit score dropped 20 points and I had a change to my report on November 28, 2022. And I saw this company ***** and Weiner as a collection, that stated I have a debt with them from September of 2022. I HAVE NEVER heard, spoken, received any mail or any other correspondence from this business In any fashion!! So why are you putting a collection account on my credit report? I know they are going to lie and say they have as I have read other**** complaints. I Want the proof.. If I have a collections, why have I not received one piece of info from them?? Only thing I know is they have placed a collectuons account on my credit report, and I want it off!!
I do not owe them anything not one cent.. I cancelled a insurance policy with *********** because they tried to over charge me, which I pay them something monthly so it should not be in collections... I want this off my report and My score back up!!Business Response

I have never received any correspondence or mail from these lieing individuals. They **** this same response to every complaint that has been brung up againsy them.. I mean the same word for word **.. I want to see this informatuon in writing.. You can not return something you never received. I should not have to contact them, they should have contacted me prior to placing this on my credit report.. That is *** backwards.. Why do I need to contact them?? I HAVE NOT HAD ANY CONVERSATIONS OR MAIL FROM THEM!! So why would I contact them now.. They say they have imfo from progressive, Why didn't I receive it from this company, or any phone calls?? Because I know they are the type of company to call you all times of day and night and leave messages, but I have not received anything from them, just a drop in my credit score and a collection on my report!! **** no I do not accept and I will not call them, I don't owe them ****!! They can take that collection off my report that's what they can do!!
