Our office received an account from the creditor ********************* with respect to this consumer in July 2022 for recovery of unpaid auto insurance premiums. Initial correspondence was sent to the consumer at that time. There is no record of any return mail. Please note the balance due is not owed to Caine & Weiner. We are collecting on behalf of the creditor, Progressive. Progressive's records indicate the policy was canceled in May 2022. Progressive indicates coverage was provided for a 2015 Jeep Wrangler on a policy ending in **** and that the final payment in April 2022 was insufficient to cover the premium balance due at the time of cancellation. Validation has been forwarded to the consumer again for review. The file is currently disputed in our records. Our office will gladly review any documentation provided by the consumer with respect to the policy, vehicle, payment or coverage specifics for this account that *** indicate the creditor's records are not accurate. I paid off a debt from Progressive for ****** back in December 2022, and a couple reps from Caine & Weiner said that Caine & Weiner reports to the Credit Bureaus on the 24th of each month. Well it's February 1st, 2023 and the debt is still showing up on my credit and on the Caine & Weiner website as an unpaid debt. I sent them a letter asking could the debt be taken off my credit, and I also asked for a receipt to be sent to my email address showing proof that the debt has been paid and I still haven't received either. The consumer states that the debt in question was paid in December of 2022 and still appears on his credit report. Our records indicate that the request to remove the negative tradleline was requested in a timely manner. Unfortunately, our office does not control how long it takes *********** to remove a remark. Our records further indicate that the negative tradeline was removed from the respective credit bureaus on January 31, 2023. This complaint is being sent on my behalf. I checked my credit report, and I saw some fraudulent transactions. Since I sent the letters to them more than 30 days ago, they have not replied, and they have not provided me with adequate justification. Please give me some advice on this. Our office received an assigned account from the creditor, ********************** with respect to this consumer October 2017 for recovery of unpaid auto insurance premiums. Initial correspondence was sent to the consumer at that time. There is no record of any return mail. Please note the balance due is not owed to Caine & Weiner. It is owed to the creditor, Progressive. The Progressive policy was cancelled in September 2017. Creditor records indicate coverage was provided for a 2008 Chevrolet Aveo on a policy ending in ************************************** July 2017 was insufficient to cover the remaining premium balance due at the time of cancellation. Progressive still indicates that the balance is due. Records indicate validation has been forwarded to the consumer in the past and it is being forwarded again for the consumer to review. Our records indicate that the debt in dispute has been researched several times in our office and appears to be valid. We regret that the initial response was not accepted. Unfortunately, the creditor, Progressive, indicates that the disputed balance is still due. As originally stated, the outstanding debt is not owed to our company, Caine & Weiner. The consumer should reach out to Progressive for any original documents associated with this agreement. We collect on behalf of the creditor. Our office forwarded the validation and attempted to give the consumer a clear explanation of the outstanding balance. 15 U.S.C **** section 604 A section 2: It also states a consumer reporting agency cannot furnish a account without my written instructions. Of which CAINE AND WEINER have failed to produce any such written instructions after repeated requests to do so.

our office is not the creditor. Progressive is the creditor that the consumer owes. Our office sent the required validation to the consumer. Our office reported the debt to the credit bureaus as we are instructed to report true information. The consumer never provided documentation proving the debt was not owed. We have closed the file as 'Disputed' in our database and have requested to have any derogatory remarks removed from the consumer's credit report. Although we have closed the file, the creditor, Progressive, still shows the balance as due. Progressive still indicates that the balance is due. The account was flagged as **************** in January 2022 per the consumer's request. With a cease and desist in place we are uanble to contact the consumer either verbally or via written communication. Please note, a cease and desist does not automatically remove an entry from the respective credit bureaus. The consumer can check with the Secretary of state regarding companies that can do business in their state. Not every company has to obtain a license. There are other requirements that can met to conduct business in different states. If the debt is valid, the entry will reflect as such on the credit report even with a **************** on file. MOST IMPORTANTLY, ************ continues to violate my federally protected consumer rights to privacy and confidentiality. Under 15 USC 1681(a) (4)-I have the right to privacy.
15 USC 1681b(a)2 -states that a consumer reporting agency cannot furnish a credit report without written consent from the consumer. Under 15 U.S. Code 1681c(a) (5)-states that no consumer reporting agency may make ANY consumer report containing the following items of information... Any other ADVERSE INFORMATION, other than records of conviction of crimes which antedates the report by more than 7 years. This collection reporting is clearly adverse information. In addition to this, Progressive NOR Caine & Weiner did not CLEARLY AND CONSPICUOUSLY provide me with outlines of my consumer rights to opt out from credit reporting PRIOR to this account hitting my credit report.
15 U.S. Code **** each financial institution has an obligation to respect the privacy of its customers and to protect the security/confidentiality of their nonpublic personal info. 15 U.S. Code 6802(a)business may not disclose to a nonaffiliated third party any non-public personal information (b)Opt out (1)A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given opportunity to direct that info not be disclosed to such third party;AND (C)the consumer is given an explanation of how they can exercise that option.
15 USC **** (5) "nonaffiliated third party" means any entity that is not an affiliate of,or related by common ownership or affiliated by corporate control with, the financial institution.
