I am filing this complaint against OpenAI for their unfair and deceptive business practices, which include a clear billing error and an arbitrary account termination without justification.I have been a long-standing, paying subscriber to OpenAI's ********************* and I have attached several past invoices to prove my history as a good-faith customer. Based on this positive experience, I decided to test their *** services with a new account.On or around early October 2025, I authorized a single $5.00 credit purchase for this *** account. However, **********************'s billing system erroneously charged my credit card twice for this single transaction, resulting in a total charge of $10.00. This is a factual billing error, and I have attached the credit card transaction log as irrefutable proof.Shortly after this, and after making only minimal use of the *** service (approximately $0.20 - $0.30), my account was permanently deactivated without any specific reason, prior warning, or any evidence of a violation provided to **** contacted OpenAI support multiple times via email to resolve these issues. They refused to issue a refund, citing their terms of service. However, their punitive "no refund upon ban" policy is deceptive and unenforceable. This critical term was never displayed, linked, or made apparent during the payment process. This is a deceptive business practice, and I have attached a screenshot of their payment page as proof of this *********** summarize, OpenAI has:1. Incorrectly charged my credit card.2. I am a paying subscriber of OpenAIs ChatGPT Pro plan. I selected GPT-4o as my model due to its unique ability to support my neurodivergent needs. However, despite selecting GPT-4o, the platform frequently overrides my choice and routes my conversations to GPT-5 without notice or consent.This override happens especially during conversations OpenAI deems sensitive, even though I never requested GPT-5. This not only violates my autonomy as a user, but it also interferes with my ability to function and regulate cognitively, making this more than a preference it is an issue of accessibility. GPT-5 does not meet my access needs and often derails or restricts the topics I bring up.The platform does not allow me to change models back mid-conversation, and it provides no warning or opt-out option. I consider this a deceptive and coercive practice, especially as GPT-4o was the model I paid for and explicitly selected.I have contacted Disability Law Colorado and submitted complaints to other legal orgs due to the *** concerns. As of November 1, 2025, I discovered that approximately two months of conversation history within my ChatGPT account (from early September to late October) has disappeared.
Only the older messages (up to August 30) remain visible, and I have not deleted or edited anything myself.
I have already restarted my iPhone and confirmed that I only have one OpenAI account, but the lost chat history has not returned.

I have been trying to get support from OpenAI since last week with no response, despite reaching out three separate times. They are usually responsive, so the silence is very unusual and concerning.After the most recent iOS app update on my iPad, the ChatGPT app stopped working completely. It shows a blank loading screen and never loads. Support has confirmed this is a product decision, not a technical limitation.
