For the last almost 2 years, I am being called daily on my phone number ************ by this business. This Company has been harassing me and now my work about a debt they bought that is almost 5 years old for credit card debt this is past the statute of limitations in BC. It had been with them over the 2 years (Aug 2022) of limitations as well so it has never been open to them. It is the last blemish on my credit I am trying to deal with. I had to download a credit app just to see the account info

    Business Response

    Date: 14/02/2025

We have updated the consumer's contact preferences.  Debts remain on the credit reports for 6 years from date of last activity.  We kindly ask that the consumer contact our office so that we can provide some options for settling the debt.

    Customer Answer

    Date: 02/05/2025

I already had a solution from BBB in regards to being contacted by MAC on a debt past statue of limitation just this year, and they have started to contact me again when that wasn’t the resolution from earlier. Prior complaint number ********.

    Business Response

    Date: 05/05/2025

A member of our consumer relations team reached out via email to see whether the consumer wished to pay the account to improve their credit.  This debt is still affecting the consumer's credit and cannot be removed unless the debt is paid.  The contact was a one time occurrence.  We will not contact the consumer again in relation to this debt.

Company is currently trying to collect a debt well over 15yrs old. It was entered on my credit report last summer dated April and March or 2020 and have recently updated this toJuly of 24. This debt is past the statue and should never have appeared on my report. I want it removed and do not want them to contact anymore. In the 6 months since this started they have also added $3000 to the original amount they have been trying to collect which seems way above the legal limits

    Business Response

We have investigated this matter.  The delinquency date which we had on file was incorrect.  We thank the consumer for bringing this to our attention.  We have submitted requests to both ******* and ***** ***** to have the collection item removed.  Please reply back to us if either credit bureau is not updated within 10 business days.

These guys have been harassing me about debt they bought that is almost 8 years old credit card debt past the statue of limitations for it. The original debt doesn't even show up on my credit report. I have spoken with Greg from MAC- he is very **** on the phone to me when I do answer I've asked them to stop calling me as it is harrassement. He told me he can do whatever he wants and he isn't scared of me or my lawyers because I don't have any money. His words. If they record their calls you can hear him threaten me. I have asked for all communication to be strictly by mail. Nope MAC calls me daily. I ask that MAC does the proper thing and remove my phone number from their file. And Greg to attend courses on ********** behaviors.

MAC financial purchased my debt from a second party debt collector in 2020 and has since been harassing through threatening letters, multiple daily robo-calls and emails. Multiple attempts have been made to both dispute and settle the debt, all of which MAC is unwilling to work with. Repeated attempts to add the debt to a Debt Management Program have been rejected by MAC Financial, all so they can continue to collect interest rates that appear higher than the legal limit, and damaging my credit, including negatively impacting the ability for my business to obtain credit. Original debt was $200 yet MAC claims it to be over $600 and has refused a settlement of $400 as well as illegally contacted my cellphone, and continued contact after receiving a letter stating my Inability to Pay.
Only acceptable resolution would be for MAC financial to immediately remove the debt from collections status on my credit report and accept a settlement of the debt.

    Business Response

    Date: 19/11/2024

The consumer sent a repayment proposal of $25/month on the full balance.  We rejected the offer as it would take 2 years to pay off a $600 account.  We cannot update the credit bureau until the account's balance is paid in full.  We kindly ask the consumer to pay the balance in full if they wish to have the collection updated on their credit report.

    **Update**

The original limit of the card was $200 which they maxed out by claiming the payment was never received. When I had asked it to be closed the balance was zero but I have no idea what ******** **** did after that.
I would appreciate any adjustments and *********** that need to be done

    Business Response

    Date: 20/11/2024

We understand that the balance was less in 2018 than it is today.  This is due to interest.  The debt in question is a credit card with a contractual interest rate in effect.  If the consumer has proof that the account was paid off in 2018 then we kindly ask her to send it to us.

    Business Response

    Complaint: ********

I am rejecting this response because:

The balance of the card was paid off in full in store by debit as clearly shown in the provided, which they claimed was never recieved and attempted to raise the balance for non-payment. This clearly shows the payment was made to ******** **** and ******** **** would be responsible for provide copies of proof of payment notifications they received as well as the repeated requests to have the account closed.

As the bank account that was used in 2018 is no longer open I cannot provide further details other than the same copies I sent to ******** **** originally as proof of payment when it was made in 2018.

    Sincerely,

    ******* *******

    Business Response

    Date: 24/12/2024

    The ******** statement provided
shows one payment of $120 on May 31, 2018.  It shows that there was still a balance of $286.15 as of that day.  The last payment received was $60 on
03/07/2019. The last charge was 03/13/2019.  No payment has been made since the last charge.  The consumer’s credit counsellor accepted our
counter offer of $75/month on a balance of $608.65.

    Customer Answer

    Complaint: ********

I am rejecting this response because:

No proof has been provided showing that there was any balance remaining after the payment was made, nor was the card used in any way after that time, and would not have been a span of time of over a year between uses.

I have proven that the payment was made and that ******** **** failed to put that payment towards my balance.

The obligation is on ******** **** and MAC Financial to provide proof that there was a remaining balance by way of a dated bill for a date after the last payment was received.

I informed my credit counselor that the payment had been made and the offer was not to be made and thus it was removed by the credit counselor.

    Sincerely,

    Business Response

We have ******** the statement showing last payment dated March 2019.  We have ******** the last 4 statements from June to September 2019.  The consumer alleges that there was no activity after 2018.  We trust that this puts this argument to rest.

    Customer Answer

    Complaint: ********

I am rejecting this response because:

I had repeatedly informed ******** **** to block the ****** ***** **** from charging the account, which they did not do. None of the purchases were authorized or performed by me as the account was supposedly blocked from use. All this shows is that ******** **** continued to allow the card to be accessed without authorization and continued to charge interest after the request for the account to be closed had been made in July of 2018.

Since 2016, Mac financial has been ********* me for my daughter's contact information. If she took out a loan, I had no idea. She put my number down as she had stayed with me briefly for a few months in 2016, but since then we have had no contact.

Every time Mac financial calls, I tell them my daughter does not live here and we do not have a contact number for her, we have been estranged for years. I have been yelled at, ********** and ************ by this company for 8...years... I will be filling a complaint with the Financial Consumer Agency of Canada today, and if I need to take legal action for elderly abuse/harassment, I will.

I am 81 years old, and I have been clear every time that someone calls, my daughter is not here and I do not have any way of contacting her. Half of the time, when they call, they say her name wrong! They don't even know who they are harassing me about. Shameful behaviour, and I will take legal action.
