The company called me a few times looking for someone, but every time I called back to ask who they needed to speak with or find out what issue they wanted to address the phone service center would scream, ******, curse , etc at me. One picked up and shouted Im getting paid to pick up the phone, youre not! before hanging up. Very strange, not sure if theyre just a professional crank call company but I wish theyd stop calling or at least tell me what debt theyre trying to collect. Quite odd, perhaps just a scam layered on top of a seemingly legit biz?Business Response

Debt Recovery Solutions, LLC has listed an old debt as a new debt. The original credit card company was BBVA and went into default many years ago, well past the 7 year reporting window. DRS apparently bought the old debt and reported this old debt as a new account. If I were ever contacted I have no knowledge of it; regardless this is an old debt and cannot legally be reported as a new debt which they have done. The fraudulent information was reported to all credit bureau's and has drastically affected my credit scores. My legal name is ***************************, DOB is 03/02/1962. The original debtor was BBVA, your client purchased the debt and the debt is past the 7 year ***. The *** does not start when your client purchased the debt, it starts when the delinquency began which was 5 years prior to 2020. I received no notification from you of any type and you are totally aware of that. I have also submitted a complaint with the CFPB.

15 USC CODE 1692J Furnishing certain deceptive forms Debt Recovery Solutions, LLC Account *********************** I request that this DEBT COLLECTOR provide PROOF of the alleged items. I request to be provided with specifically the ORIGINIAL APPLICATION, Contract, note, or another instrument bearing my signature. In addition, any contract signed between the Debt collector and the original creditor notarized and sworn under penalty and perjury granting this Debt Collector's ability to collect the debt. Failing that, the items must be deleted from the report as soon as possible or pay fine of $1000 per violation.Please have the creditor provide the validation documents to the BBB as well as certified mail to me. I have already attached the documentation that you requested in your previous communication.
Cease and Desist Communication is not just for traditional phone calls, text messaging or email. the reporting of this alleged account on my consumer credit report is a form of written communication as it is also a collection activity according to FTC guidelines. You are in violation of Under 15 U.S. Code ****j - Furnishing certain deceptive form. I never had any contract nor applied for any credit or business with your company of this alleged debt. You never sent me the initial communication informing me that your are reporting this account in my consumer report, that your company purchased this alleged account.
I also want to inform you that if there are any negative marks on my credit reports from your company or any company you represent, and it is for a debt I do not owe, it is against the law. The Fair Debt Collection Practices Act states that you must ask the credit reporting agencies to remove such entries if you cannot validate the debt. - you are in violation Under 18 U.S. Code 894 - Collection of extensions of credit by extortionate means: (a)Whoever knowingly participates in any way, or conspires to do so, in the use of any extortionate means (1) to collect or attempt to collect any extension of credit, or (2) to punish any person for the non-repayment thereof. - since reporting this alleged account is a collection activity.

On 1/09/24 i received a call from ************ which is debt relief services. I used to get calls from them every couple months about *************************. *** never known an ************************* nor am I *******. It went on for years but then probably around the pandemic it stopped. Then today they called again and hung up on me when i said i dont know him. From my experience you have to say do not call to get respite from their abuse. I called back and she hung up on me again. Then 3 more times she blocked my call. Another agent finally answered and let me say that i do not want to be called. Because this has happened for years and they refuse to be decent about it I need to report them for abuse and not adhering to their own policies of not calling weong numbers.Business Response
