On 03/13/2018, I entered a lease agreement with a leasing company named **************** LLC, *********************************** STE 1750, ********************* for a 2018 LS Tractor. This lease has been sold twice (to the best of my knowledge), first to a company named Enverto and then to TimePayment. The lease was for 72 months. I made 72 payments, on time and had a 'buyout' amount of $199.00. I have proof of my payments in a Quickbooks report which was generated directly from bank statements. I have access to these statements and can be confirmed by the bank directly. The payments were $382.87 (including sales tax) for 72 months for a total of $27,566.64. All was fine until TimePayment took over the account (on or about July, 2021) and increased the amount of the monthly direct debit in 09/2022 to $403.93. When contacted about the discrepancy they said it was for sales tax, which was already built into the original Master Lease in the first place. When I complained, after three months, they decreased the payment to $319.69. The next month they increased it to $381.71 and that lasted until 11/2023 then increased to $387.71. The next month it was back to $381.71. In 01/2024 it went back up to $387.71 and remained at that level until 03/2024, which was the 72nd payment. With all this payment fluctuation madness, in the end, I ended up making 72 payments, on-time, for a total of $27,547.72. That is $18.92 short of the total due on the master lease. I've been arguing with these people to send me an invoice for $217.92 ($18.92 for arears and $199.00 buy-out) to settle the account and send me my title. They are saying the amount doesn't match their documents and insist on a much higher amount. After that, I spoke to a representative about the buy-out and he said he didn't even have the master lease...but I do! I would be very surprised if this is the first complaint against them. No one I've communicated with at TimePayment seems to have any clue about what they're doing!Business Response

***************************** advised on 05/12/23 that I was signing a lease for a monthly payment of $249.66 for 33 months. I was never advised of any taxes, processing fees, damage fees, insurance fees, and the list goes on. I was also advised that this lease would help both my insurance and personal credit, another lie. I was also advised that I could do an early payout at anytime. I am now 12 payments ($292 monthly due to fees) into the lease, requested a payout and still owe $5700 with return of the printer from an original purchase amount of $4500. I have correspondence with TimePayment from August, September, and October regarding additional fees to my monthly payment that they did take off. But now months later my balance has not gone down and is still more than my original purchase amount after paying $2800 plus to time payment.Customer Answer

In March 2024, our company chose to switch our phone service to this company. Our phone lines were not "ported" till April 8th but they failed to tell us this. We were forced to forward our company phone number to our office cell phone so that we could even receive calls. Our fax line didn't work for over 6 weeks because the installing technician didn't set it up correctly. We got emails and updates from our clients stating that we were "out of compliance" because were not responding to faxes and missing calls. Our company quite possibly lost thousands of dollars because of the phone calls we missed over the two months or so it took for them to get our service straightened out! We called in several times to literally beg for them to send a technician out! Once, after having my office manager on the phone for over 45 minutes trying to diagnose an issue, they asked her to get on a ladder so that she could reach a piece of equipment that was in fact in the wrong place! We were not offered the two week trial period to decide if this was a good fit for our company because the phone services were not working properly. Now, we are locked into a four year contract that we weren't even aware of! We are being billed by two different companies and each time we call in to discuss a billing question, we are given different information. We are very unhappy with the service we have received and Spectrum VOIP plans to do nothing to rectify the issues. WE WANT OUT OF THIS CONTRACT IMMEDIATLEY!!!Customer Answer

Per the terms of that agreement, TimePayment has all of the rights of Spectrum VoIP but none of its obligations. I have been going through identity theft for the past few years and it's been a up heel battle. This Time payment corp was on all three of my reports I have contacted the *** the police and reported it as identity theft now on two of my reports they have been deleted I have contacted this company they just kept switching me around then they just hand the phone up. Dear Better Business Bureau,I am the owner of *************************** LLC, and I wish to file a complaint against TimePayment regarding what I perceive as unfair lease terms and equipment buyout options. My lease agreement #******** with TimePayment was initially understood to be a purchasing agreement, but it turned out to be a rental, which has caused significant discrepancies in financial planning.The lease terms stipulate a buyout at Fair Market Value, defined in the agreement as the cost equivalent to three additional monthly payments. According to our calculations, this does not accurately reflect the depreciated value of used equipment, especially considering that one piece of equipmenta slushy machinewas valued by TimePayment at about 33% of its new price when opting for a return rather than a buyout.The total costs implied by the buyout are considerably higher than the current market value of the used equipment. Specifically, after payments already made and the proposed buyout, we would end up paying nearly $24,000 for equipment originally worth around $14,000. This situation seems to contravene typical leasing practices where the buyout price should correlate with the equipments current market value.Moreover, the terms clearly state at the end of the lease, we have options including returning the equipment or purchasing it at *********** Value, which will not exceed three (3) lease payments. Given this clause, the implied depreciation should logically apply to all equipment under the lease, which does not seem reflected in the proposed buyout totals.We hope the BBB can facilitate a resolution that reflects the fair market valuation of the equipment, ensuring that the buyout terms are adjusted accordingly.Thank you for your attention to this matter. Despite your records indicating that my complaint was delivered to them on 5/22/2024, TimePayment claims they have never received any complaints from the BBB. They informed me that they have forwarded the issue to their legal team; however, there has been no further communication or resolution.
I have actively followed up with TimePayment, especially given that another payment is approaching, but my attempts to clarify and resolve the issue have been unsuccessful. I requested a copy of the communication they supposedly sent to their legal team to verify their claim and ensure my complaint was being addressed appropriately. Unfortunately, after this request, TimePayment ceased responding. The last communication from them was on last Thursday.
As of now, the problem remains unresolved, and TimePayments lack of response and engagement is concerning, especially as they claim to have no record of the BBBs involvement. This situation is causing significant inconvenience and financial concern as subsequent payment deadlines approach.
I would appreciate further assistance from the BBB to ensure that TimePayment addresses and resolves the complaint satisfactorily.

I am writing to reject TimePayments response to my complaint. Several critical issues remain unresolved and require your attention:
1.Tax Exemption Discrepancy:
TimePayment Corp. charged us sales tax on the purchase of equipment even though they used a tax exemption form from WebstaurantStore, meaning they purchased the equipment tax-free. This practice implies they are profiting from the taxes charged to us, which is inappropriate and potentially illegal. Taxes should not constitute an additional income stream for TimePayment.2.Delay in Response:
TimePayment has taken more than 14 days to respond to the BBB complaint, far exceeding the expected response time. This delay has forced us to make an additional monthly lease payment due to the unresolved issues. We assert that this payment should be disputed or counted towards the final buyout agreement, as it was made solely because of TimePayments failure to respond in a timely manner.3.Fair Market Value Misrepresentation:
TimePayments definition of Fair Market Value as three additional monthly payments is inconsistent with typical leasing practices and does not reflect the depreciated value of used equipment. They previously valued a slushy machine at about 33% of its new price when opting for a return rather than a buyout. This inconsistency raises serious concerns about their fairness and transparency in calculating buyout prices.4.Misleading Contract Terms:

This cost includes previous payments that should have contributed towards ownership, but instead, we are being asked to pay nearly double the equipments value without a clear and justified explanation.6.Lack of Legal Transparency:
TimePayment claims their legal team is handling the matter, yet they have failed to provide any concrete evidence of this. Their responses have been vague and dismissive, further exacerbating our frustration. As a result, we have already filed Form 3949-A with the *** to report the tax exemption issue and are considering additional legal steps.7.BBB Complaint Handling:
TimePayments handling of the BBB complaint has been inadequate. They initially claimed not to have received the complaint and have since failed to provide proof of communication with their legal team. This lack of accountability and transparency is unacceptable.
We urge TimePayment to address these issues comprehensively and transparently. Their current practices and delayed responses are unacceptable and not in line with the standards expected from a legitimate business.

I am writing to reject the response provided by TimePayment regarding my complaint. Below are the detailed points supporting my rejection:
1.Tax-Exempt Purchase and Tax Charges:
Discrepancy in Tax Handling: TimePayment purchased the equipment using a tax-exempt form from WebstaurantStore, thereby avoiding sales tax. However, when charging us, they included sales tax in the lease payments. This discrepancy suggests that TimePayment is generating profit from taxes, which is not lawful. Taxes should not serve as an income stream for TimePayment.
No Record of Tax-Exempt Form: TimePayment claims they have no record of a tax-exempt form being submitted by us. This is misleading as the tax-exempt form was handled during the equipment purchase process. We have submitted a Form 3949-A to the **** reporting this suspicious activity, and we have provided evidence of this illegal practice.
2.Delay in Response Causing Extra Payment:
Lack of Timely Response: According to BBB policies, a business is required to respond within 14 days. TimePayments failure to respond within this period caused a delay, resulting in an additional monthly payment from our side. This payment, which would not have occurred had TimePayment adhered to the response timeline, should be deducted from the buyout cost.
3.Misleading Communication and Lack of Resolution:
Contradictory Statements: Initially, TimePayment claimed they did not receive the complaint from the BBB, but later mentioned their legal team was handling it. This inconsistency casts doubt on the transparency and sincerity of TimePayments communication.
Unhelpful ***************** Despite calling to resolve the issue, the customer service representative had no knowledge of our case, indicating poor internal communication and lack of effective problem resolution.
4.Buyout Payment and Closing of Relationship:
Completion of Buyout: We have already paid the buyout quote for the full amount and received confirmation that it was successfully processed. This should mark the end of our financial relationship with TimePayment.
*** Reporting: We have submitted the necessary documents to the *** regarding TimePayments improper handling of taxes and will await their investigation.
Given the above points, we do not accept TimePayments response as it does not address our concerns adequately. We will keep the BBB complaint open until a satisfactory resolution is achieved.

I was lied to about their products and misinformed, when I went to get it because I was told if I find something better they will let me out I was told something completely different. This company over the last 6 months has falsely reported me being late and non payment on a loan I have never been late on or missed a payment on. I paid the loan off 6 months early to rid myself of the company and its false reports only to have the attempt to send me new fake charges after I paid the loan in full. I received a letter from them stating it was paid in full and after i started complaining of the existing bad marks on my credit they sent me new invoices months after paying off the loan . They even tried claiming another company was asking for the money ( ****) I contacted **** and their owner ********************* who stated they had nothing to do with the charges. Im attatching copies of page 6 of my credit report , the letter from time payment stating fulfilling of loan , the new fake invoices they just sent months after the loan was satisfied, the email from the owner of Fuji and the identification this company may ask for from me later on so they have all they need. TimePayment has resolved this matter and updated the customer's credit accordingly. A third party system error caused the incorrect reporting and subsequent fixes caused additional invoices to generate after the account had already been paid in full. I am submitting a complaint against Time Payment due to unauthorized use of my personal information and misleading contractual activities, which have significantly impacted my financial standing and credit score.As founder of a business, I provided my personal documents (drivers license, lease, utility bills) to my business partner, believing they were needed to apply for financing for machinery. Unbeknownst to me, these documents were used on the same day to unilaterally sign my name on a non-cancelable finance contract with Time Payment. This was done without my knowledge or consent, and ************ LLC was also involved in this transaction.My partner, misled by third-party advice, believed she was authorized to sign on my behalf. However, neither Time Payment nor ************ verified my consent or the authenticity of the signature used in the contracts. The issue has not been resolved. This account was opened due to fraud. I didnt speak with anyone from Time Payment the day this account was opened nor did I sign any contract with them. I do have a lawyer who is on the case about this account being opened fraudulently.

I recently received an email indicating that my complaint was closed due to a lack of response. However, I was unaware that I received any communication asking for further information. Since the closure of the complaint, I have obtained additional information that is crucial to this case:
1. Unauthorized Signature: My business partner, *************************************, has admitted in writing via email to ***********************, that she signed my name on the contract without my knowledge or consent, under the direction of a *********************** from **** Capital. This act was done without my permission, and she even spelled my last name incorrectly.
2. Lack of Consent: I never saw the contract, nor did I agree to open an account with **********************. The contract was entered into by my business partner without my involvement or consent. I have repeatedly communicated this to TimePayment, but they still insist that the contract is valid. The contract was never discussed with me, and I did not authorize any such agreement. Now, I am being held responsible for payments that have been missed, even though I did not consent to this arrangement.
3. Legal Action and Lack of Response: I have retained legal counsel to address this matter. My attorney has repeatedly attempted to contact TimePayment without receiving any response. He has also issued cease and desist letters, which have gone unanswered. Despite this, I continue to receive harassing phone calls from TimePayments collection department.
Given these facts, I strongly believe that my complaint was prematurely closed and that the contract in question is invalid.

I am writing to request the reopening of my complaint against TimePayment and to reject their response. Despite their response claiming the matter has been addressed, there are significant misunderstandings and unresolved issues regarding the contract in question that require further investigation. I have broken it down into numerical points.
1. Fraudulent Contract and Lack of Consent: I want to clarify that I had absolutely no knowledge of my business partner, *************************************, entering into a contract with TimePayment on behalf of our business. ********* signed my name as the guarantor of the contract without my consent or knowledge. There was no communication between us about her entering into this agreement, and I was not aware that she was signing any documents on my behalf. Additionally, ********* even spelled my last name incorrectly when she signed the contract, further demonstrating the fraudulent nature of this agreement.

Legal Implications of the Unauthorized Signature: I want to emphasize that it is illegal for a business partner to sign another partners name as a personal guarantor without their explicit consent and knowledge. This constitutes forgery and fraud, both of which are criminal offenses. A personal guarantor must knowingly and willingly agree to the terms of the contract which I had no knowledge of, and my business partner had no authority to sign on my behalf. The contract is therefore fraudulent and should be considered void.
3. Miscommunication and Misrepresentation by TimePayment: TimePayment claims that I have acknowledged the lease agreement, which is not true. I have never acknowledged, consented to having my name signed electronically by *************************************. All communication regarding this contract was conducted with *********, not with me. I have no knowledge of what was discussed on the phone or in any correspondence the day she signed the contract. Furthermore, TimePayments position has been inconsistent. They initially held me personally liable for the contract, claiming I was the guarantor. Now, they assert it was signed on behalf of the company. Regardless, ********* had no authority to sign my name as a personal guarantor without my explicit consent, and I would never agree to such terms without thoroughly reviewing the contract first especially a contract that holds only me financially liable.
4. Lack of Proper Response to My Attorney: My attorney has sent a cease-and-desist letter to TimePayment and has tried multiple times to contact them for resolution. Despite these efforts, TimePayment has not adequately responded to these legal inquiries. Their lack of engagement and refusal to communicate with my legal representative further demonstrates their unwillingness to address the fraudulent nature of this contract.
5. Unjust Collection Practices: I continue to receive collection calls from TimePayment regarding this fraudulent account. This is causing undue stress and impacting my credit, despite the fact that I am not responsible for any payments on an account that was opened without my knowledge or consent.
6. Similar Complaints from Other Consumers: I would also like to point out that my experience with TimePayment is not an isolated incident. There are numerous complaints on the BBBs own website about TimePayment engaging in similar questionable practices. I urge the BBB to review these complaints to see the pattern of behavior by TimePayment, which aligns with my experience.
7. Request for Further Action: Given the above points, I am requesting that the BBB reopen my complaint and conduct a thorough investigation. TimePayment must be held accountable for their actions, which have severely impacted my credit and financial standing due to a fraudulent contract. All communications and transactions regarding this matter were conducted with *************************************, and I urge TimePayment to direct their inquiries to her. Please be advised that TimePayment Corp. acted solely as a finance lessor in this transaction, extending credit to ****************** as lessee and ************************* as Personal Guarantor, in the form of a lease after receiving and approving the credit application from ************* TimePayment and ************ are independent agencies, and if **************** and/or her business partner were advised on certain things by ****************, then her dispute should be addressed to them. ************ has advised they spoke to both **************** and her partner, and further advised that they did not instruct her partner to sign on ******************** behalf. In addition, if, as **************** states, that her business partner had no authority to enter into this lease agreement or to sign on her behalf, then her dispute should be addressed with her business partner. Timepayment management has been charging additional money for the last three years on lease payment for insurance. I had insurance on file with them and they continue to charge. This company is criminals I originally purchased a device for a small business for 3800 and to this date they wont let me pay off my account. I have paid 6800 dollars in total for a device that was 3800. Nobody works with you and none of there accounts are accurate. Do not do business with these people.
