I went into a Lease on 6|6|2024 with Timepayment on a commercial Equipment in the amount of...it doesn't say on the contract. On the 06/06/2024 a total of $720.30 was taken out of my checking account. I had not received the merchandise. I had to wait until the 27th of June to get it. On 7|10|2024. Timepayment tried to go back into my account and take another payment out. My thought was the amount of $720.30 was the amount for the first payment once the printer was in my possession. This company is charging fees and monthly payments even if the customer doesn't have their items. This is misleading and fraud.Business Response

Over a year ago we switched to a new credit card processing company that ended up being unreliable. I originally signed with NW Payments then they switched us to Riverside payments. They never once mentioned leasing the processing machines at all. We didn't know we even had a separate account with **********************. The processing machine was unreliable and always malfunctioning everyday .We couldn't function without our machine. They could never keep it working so we decide to switch to a new company that has been reliable and no issues. The company that we switched to agreed to buy us out of our contact. We tried constantly to contact Cascade once we were aware that they were handling our equipment. They refused to speak with us, would call and they would say they'll contact us or that they mailed the information. It was over a year of this and then they started to reach out. I was approached with a payment option from a vendor and was contacted by spark financial later presented as Time Payment. I was repeatedly contacted pressuring me to sign documents prior to being told the terms of the contract directly told I have to sign in order to get those terms and figures. I asked multiple times even after signing the documents for the terms and the agreement documents omit the actual dollar amount only misleading or general statements when I looked at my personal credit I noticed that I was listed as individually responsible for the debt and that the total owed was over double the invoice amount. I still have not been provided with a point of contact for my account after asking multiple times I have asked for answers to requested information multiple times and the only response or communication I get from this company is if I let the current payment due go past the due date and they call to collect. I was only given the amount on the invoice and the initial payment figures not a single document states the final amount to be paid at the end of the term. I was only alerted to the total debt after running a personal credit check through Experian. The total amount of the debt is $9289.00 original invoice amount was $4786.94. Sent to me by time payment directly. And fully impacted my personal credit when I was told it would be reported to DUN & ********** small business account not to forget that this is a partnership not sole proprietor business. Then I was advised to not exercise the early pay off option because it will help the business obtain its own lending in the future. I was misled through the entire process and still have not point of contact for the lending company.Customer Answer

I have not heard from the business in response to my complaint. I have asked multiple time to speak with someone in regards to the omission of over all costs and all other points I mentioned and am unable to fully determine exactly what the name of the company is or who I should contact regarding this account. I can't get a name or any contact information from this business and the only way they contact me is if I miss my payment then the collections people are quick to contact me but refuse to answer any of my questions directly and once payment is received I get no response until the next payment due or past due. As you can see in the documents the price on the invoice is less than half what they have reported to Equifax but the document I was forced to sign prior to being told any terms has no solid amounts just base amounts and very vague and general comments of all other fees and taxes and processing fees not once was I ever given a solid number. And the company on the email of the person I worked with is different than the company listed on the agreement.Business Response

The response was irrelevant at best. Nowhere did I mention cancelling the contract actually every item you commented on was not even a factor in my complaint. Other that the name time payment being in bold letters on the document. Which I acknowledged and you copy and pasted into your response so again pointless. My concern is that the amount due is over double what I agreed to. And that I can't c get a point of contact to address any concerns. I was told I was approved for up to $5000 so how did that end up closer to $10000? That is price gouging at its best. That's not ethically or morally right and still I have yet to see a document that I signed that the amount t due is printed anywhere. In no way would I have ever agreed to pay $10000 for equipment that cost $5000. And again I was told I needed to sign in order for her to be able to send me the numbers which I am still waiting on. Again I did not ask to cancel I asked for the amount to be fixed to reflect what I agreed to pay

I used time payment to lease equipment for my small business. The buyout option was selected and the amount paid in full and posted to the account on May *********. The company is now deducting payments from the lump sum and has yet to release the equipment to me despite the buyout quote being paid. When I logged into my account earlier, it's showing the payment being deducted every month from the buyout money I sent to satisfy the quote. This is criminal and while I have a ton of equipment still to acquire, I will never be using them again.Customer Answer

My nature of dispute is unforeseen charges and lack of of information told before agreeing. They price I was quoted and quoted to be paying each month is never what it suppose to be. Each month there is charges that shouldnt even be attached to my account. I was lied to by my rep about the price of the equipment . After the contract was signed the prices was not the same Or the payments was not what they was suppose to be. Also they stated they will report my account to my Bussiness credit and never did!! They gave me a specific date to look at my Bussiness report to see the changes and we are well over 3 months and not one report to my Bussiness credit only personal!! Equipment was purchased 3/4/2024 for ******** plus taxes and fees. To date (7/2/2024), $3094.87 has been paid. When calling to make a final payment before the early buyout is expired, the representative explains that all payments made do not apply to the early buyout amount and they are only willing to credit $26.12 as overpayment. Please note, there was multiple payments made in order to pay off the equipment in the window they advised (before the 5th month) but all payments in the 1st 5 months are applicable per their representative stating it had to be a ONE TIME PAYMENT of over $7k despite already making a substantial payment. They have taken funds but not reporting funds correctly to the credit bureaus. And in turn they are making more money off of clients than they reporting to creditors or to IRS which seems fraudulent. It was reported to my personalcredit as of 6/27/2024 TimePayment all payments current and timely. The conflict is, either I've made payments towards amount owe but they are verbally saying I did not, but my credit says I do and the amounts due and paid. If it's not towards balanced owed, what was it for? When speaking with a representative, (*******************, supervisor *********************) it was stated that it had to be a one time payment to meet the addendum. However, that is not what the early buyout addendum states. The issue is they are changing the contract after it has been signed, they have taken funds and not applied it properly to the balance, and they have reported falsely on my personal credit that I am making payments, but they are not applying the payments to my balance to reflect correctly. If I do not pay early, I will overpay more than the equipment and contract is worth, in the end making Timepayment more money than they legally are in agreement to receive. They have taken bank account and credit card payments and are not applying the payments properly to the balance.Customer Answer

I have not heard from the business in response to my complaint. However, I reached out to the company multiple times. Each time getting a different response as to when and how to make a final payment to end the contract. The company in my opinion deliberately gives misguiding information so the customer is either late, at fault, or ignorant to their business practices in order to capitalize on the customer.
They misuse, misrepresented, and even manipulate their contracts in order to make statements at their call center that is not in alignment with the agreed upon contract that is signed. Case in point: buyout addendum. After contacting my financial institution, I was advised to file a police report and request the $1000 payment made and resubmit final payment and end the agreement.
As a business owner it is critical to get a contract agreement, but I didn't imagine the company attempting to verbally change the contract and not uphold their own document once their manipulative tactic was revealed.

They failed at this. This is closed because I filed a police report, recovered my funds, and closed the account with the buyout. They are not reliable when information is needed and it's not consistent. ****** learned, never use Timepayment.
