I have received emails from TrueAccord on multiple occasions, most recently Feb 08, 2025, seeking to collect on a debt I do not hold. The amount is $1801.17, with *****m, at an address I have never lived at. I do not have any responsibility for the debt they are trying to collect. Further, there is no consent by me for unauthorized charges. I would like TrueAccord to remove the collection and cease contacting me about this. Please submit all documents that you have submitted to consumer reporting agencies you used to create this trade line on my credit report. I have reason to believe that you unlawfully obtained my personal identification information. I believe you have used my name and any other personal identifiable information such as a social security card, bank information, driver license, and or my address without my consent or a signed agreement between me and your agency expressing mutual assent from both parties. Before this escalates further and causes more damage and more hours of my time investigating how you or your originator obtained false information, or an investigation into penalties for identity theft (under 18 USC 1028A) is pursued, I asked that you remove this as soon as possible.Business Response

On December 5, 2024, TrueAccord sent you an initial email detailing the creditor, an itemization of the amount due, how the debt could be disputed, and the option to unsubscribe. TrueAccord has processed this complaint as a dispute and cease and desist request. TrueAccord will no longer contact you regarding this account. As a result of the cease and desist request, we are no longer collecting on this account.
In the process of investigating this complaint, we reached out to ******. ****** provided the following information:
Thank you for the opportunity to respond to your BBB complaint. ****** has reviewed your complaint which states your concerns with the credit reporting of an ****** loan.
******’s records indicate that you have obtained one loan. Loan Z9SD-639Z was processed on March 27, 2024 for $2,407.32, for a purchase with R***rb., The loan required a down payment amount of $367.32 that was submitted on March 26, 2024, leaving a residual loan balance of $2,040.00. The repayment terms are 12 installments of $200.69 at an Annual Percentage Rate (APR) of 31.80% with payment due on the 276th of each month. ****** received payments of $200.69 on April 27, 2024, and May 27, 2024. On July 11, 2024, ****** received a payment for $200.00. On July 26, 2024, ****** received a payment for $1.00. There were no further payments received and the loan was charged off on November 25, 2024, after having an overdue balance for 120 days. On February 26, 2025, ****** was informed by TrueAccord that you were disputing the validation of the debt, and the loan has been found to remain your responsibility.

Account was purchased from ****** before 120 day mark.
The payment for October
4, 2024, was made on time. Therefore, the next payment due date was November 4, 2024.
The correct 120-day mark would be 120 days from November 4, 2024, which is March 1, 2025.
Despite the fact that the 120-day period had not yet been reached, my account was sold to collections on February 2, 2025, which is before the 120-day mark.
According to both federal regulations (such as the Truth in Lending Act) and California law, accounts cannot typically be charged off until they are 180 days past due. This account was sent to collections on February 2, 2025, which is prior to the 120-day mark and well before the
180-day period for charge-offs. As such, the account was sent to collections prematurely.
Given this information, I respectfully request that this matter be reviewed and corrected. I ask that the status of the account be updated to reflect the accurate payment timeline and that the collection action be reversed.

While investigating your complaint, we reached out to ****** and they provided the following response:******** records indicate that loan ********* was processed on January 4, 2024, for a purchase with the merchant, Amazon, in the amount of $547.48. This loan has terms of 35.89% Annual Percentage Rate (APR) and 12 monthly payments of $54.97 due on the 4th of each month. This loan shows five on time payments of $54.97 were processed from February 4, 2024, to June 4, 2024. Two payments were processed on July 28, 2024, and August 9, 2024, for $54.97.
Looking at his ****** account, this loan became delinquent because he did not satisfy the payment due on October 4, 2024, and became more than 90 days overdue. To provide further context, the payment that was due on September 4, 2024, was not satisfied until October 4, 2024, and then the payment due on October 4, 2024, was not satisfied. One payment was made on January 18, 2025, for $20.00 but this did not satisfy the loan.
The loan became 120 days overdue, and the loan charged off to ******** third party collections agency, TrueAccord on February 2, 2025. TrueAccord can be reached at ***** ******** for any questions or to schedule payments.
****** received one credit reporting dispute through Experian on February 13, 2025. After investigation, we found the loan to be reporting accurately in the dispute.
On February 16, 2025, ****** was informed by TrueAccord that *** ***** was disputing the validation of the debt, and the loan has been found to remain *** *****’s responsibility.
Please note, ****** has a regulatory obligation to furnish accurate loan and repayment information (positive or negative) to the credit bureau and can only update reporting if an inaccuracy is identified. We reached out to ****** and they provided the following information:
****** has reviewed the account again, and to provide the payment history of the loan, *** *****’s monthly payment for this loan is $54.97 due on the 4th of each month. She made on time payments between February to June 2024. Her July 4, 2024 due date was paid on July 28, 2024. Her August 4, 2024 due date was paid on August 9, 2024. For her September 4, 2024 due date, she did not make a payment until October 4, 2024. Her next due date of October 4, 2024 became overdue until *** ***** made a $20.00 partial payment on January 18, 2025. This payment however, did not satisfy the agreed monthly payment amount of her loan. As this due date was not satisfied, it became 120 days overdue resulting in the loan being charged off to ******** third party collections agency, TrueAccord on February 2, 2025 for continued management.
Loans are not charged off for late payments until they are 120 days past due. ****** provides notices of late payments and the potential for charge-off before the charge-off occurs, and will also send a notification when the loan is charged off. It also included a link to the CFPB website (********************************) for the consumer to learn more information about their federal rights.
On February 17, 2025, TrueAccord received the consumers' dispute via an Automated Credit Dispute Verification (ACDV) form from the credit reporting agency. We have paused collection activity, requested debt verification from the current creditor, and will not resume collections until after the debt verification has been sent.
As a result of this dispute, TrueAccord submitted a request on February 23, 2025 for the tradeline to be removed from the consumer’s credit report. It typically takes around 45 days for the credit report to be updated by the credit bureaus. If the consumer has additional questions regarding credit reporting, we suggest they reach out directly to the credit reporting agencies.
Please note, we do not have a current address for the consumer on file. In order to receive the verification documents, please have the consumer reach out to ********************** or by phone at ***** ******** to provide an updated address.

I received an email addressed to *** **** ***. My name is ****** ***. I don’t know how they got my email address but this is incorrect.
The email startes:

While I have lived at the address above, I have never stepped foot in a ******** ******* or taken out any form of credit with a jeweler. This account does not belong to me. The debt is addressed to a different person.

As a result of this dispute, TrueAccord submitted a request on February 16, 2025 for the tradeline to be removed from the consumer’s credit report. It typically takes around 45 days for the credit report to be updated by the credit bureaus. If the consumer has additional questions regarding credit reporting, we suggest they reach out directly to the credit reporting agencies.
The consumer contacted TrueAccord via telephone on February 17, 2025, to discuss resolving the account for an amount less than owed. The consumer made a payment that day, which effectively resolved the account. TrueAccord confirmed the payment to the consumer at ************************** and informed them that the current creditor would be notified of the payment, provided it is not returned.
As such, TrueAccord is now showing that the account is resolved and we will no longer contact the consumer regarding this account.

I am aware of this tradeline unlawfully reporting on my consumer report. And would like to conduct a further investigation.

Without my prior consent; which, you have used to create this tradeline on my credit report. let me explain, if you have used my Name and any other personal identifiable information such as: a social security card, driver license, or my address. Without a signed agreement between me and your agency. That expresses mutual assent from both parties.
Then you are facing some serious penalties under the UNITED STATES CODE. Pursuant 18 USC 1028A Aggravated identity theft. (See United States v. Kuc, 737 F.3d 129, 134) "Pursuant to 18 U.S.C. § 1028A(a)(1), a person is guilty of aggravated identity theft if, in relation to any crime listed in § 1028A(c), he "knowingly . . . uses, without lawful authority, a means of identification of another person."
The statute defines the term "means of identification". To mean "any name or number that may is used alone, or in conjunction with any other information. To identify a specific individual, including any name, social security number, [or] date of birth." Meaning if you used 2 separate forms of identification without my consent. Then you committed aggravated identity theft under 18 USC 1028A. If you delete this tradeline then I will drop my claim.
All of the documented submitted via my email address calls me as ******* ****. That is NOT my legal name. Number two, you bought/purchased a debt that is near the statute of limitations per Ohio, debt collection rules, the statute of limitations is six years. I have more information valid to this claim I never have ever lived in Maurice Louisiana. This complaint claims that I have lived at *** ***** ***** Maurice, LA 70555. They stole my identity and accused me of being ******* ****. I have never EVER been associated by any other name, other than **** ******** *****, MY MAIDEN NAME OR **** ******** **** MY MARRIED NAME. In no way shape or form, is ******* related to ****. I don't know her, you need to have that company validate the SSN associated with that debt. I have sought out legal representation, and will be seeking further litigation against True accord and resurrgent LLC, for identity theft, and will be seeking legal compensation, to the furthest extent of the law, including filing charges with the state of Ohio, for identity theft!!! Not to mention the statue of limitations is nearly up for this debt, that they are ATTEMPTING TO SUE FOR!!! they never validated the debt, which goes against the fair debt collection laws. True accord has been sending me emails about a supposed debt I have when in fact I do not have a debt . They are saying I have a debt from ******** but I have not had any services with them since over a year ago. When I left ********* I made sure multiple times that I had a zero balance and no surprise fees to pay. Now over a year later, I am receiving messages or rather emails from trueaccord saying they can help me lower the price of my debt that I owe to ********. Since I received these emails, I went ahead and contacted ******** once again to make sure I have no outstanding bills or reason to be contacted by true Accord. I spoke with ******** twice over the phone both times said I have no past dues and I have a zero balance since over a year ago. I have a recording of ******** stating I have an $0 balance and I even got an email confirming that as well. I am a person who always pays my bills on time and never had an issue with ******** from my end . It is not fair to be harassed by true accord for no reason when I have no debt. Subsequently, the current creditor removed the consumer’s account from our system on February 11, 2025, therefore TrueAccord is no longer collecting on it. Since the account is no longer with TrueAccord, we have forwarded this complaint to the current creditor.
As a result of this dispute, TrueAccord submitted a request on February 16 ,2025 for the tradeline to be removed from the consumer’s credit report.
