To Whom It May Concern,I am filing this complaint due to unethical, deceptive, and potentially unlawful practices carried out by Benchmark Asset Resolution, Inc. following the repossession of my vehicle.After my vehicle was repossessed, I contacted Benchmark to retrieve my personal belongings. They attempted to charge me $150 just to access my property, which I immediately informed them was illegal under California law **************** ******). When they realized I was aware of my rights, they shifted tactics and demanded an additional fee to reschedule the appointment, even though I had already shown up at the appointed time and was denied access.When I was finally permitted to retrieve my belongings, I discovered that many of my items had already been removed and relocated without my notification or consent. I was required to sign a form stating I received all of my property, but when I asked to see what they documented, they admitted to intentionally mislabeling my 20,000-gallon pool and all of its accessories as an air mattress to reduce their liability.Several of my belongings were missing, including:All cash and coins that were in the vehicle around 200 bucks My ******* Cup and a spray bottle Possibly more items, as I was denied access for over 2 weeks and cannot be certain what else was taken or removed I do have photographic evidence showing my ******* Cup inside the vehicle at the time of repossession.I have made multiple written attempts to contact Benchmark and remedy this situation, but they have refused to acknowledge their misconduct, return the stolen items, or issue a refund for the unlawful charges. I have also filed complaints with the ************************************ (****) and the ************************************************************ (****). I am filing a formal complaint against Benchmark Asset Resolutions *** regarding their failure to properly handle and return my personal belongings after my vehicle was repossessed in December 2024.Upon repossession, my car contained valuable personal property, ***luding phone, bags, and jewelry, amongst other valuable and personal items. When I attempted to retrieve my belongings, I was met with uncooperative staff, misinformation, and unreasonable barriers to access.Despite multiple efforts to contact them and follow their procedures, they later informed me that my items had been disposed of. California law requires repossession companies to store personal property and provide proper notice before disposal, yet I never received any written notification or meaningful opportunity to retrieve my items.I have s***e learned that many others have had similar issues with this company, suggesting a pattern of misconduct. I am rejecting this response because: The law requires that the release of the vehicle be in a reasonable amount of time, 140+ hours is not a reasonable amount of time, the attorney generals office has received a complaint as well. I have left a voicemail with the detectives department as well because i believe this is criminal.

November 19, 2024 I went to recover my vehicle that was repoed. After getting everything handled with my finance company they provide me with the contact information to Benchmark Asset Recovery. I called and it was very difficult to get a hold of them. When I was finally able to schedule a pick time they schedule me 3 days away. They charged me $300 for an after hour appointment to pick up my car the same day. After speaking with my finance company they said I wasn't supposed to pay any additional fees or anything to them. Once I received my vehicle I noticed several items were moved from where I had them originally. I also noticed money missing from my center counsel and I inspected my vehicle further and told the representative about it and she wasn't much help. They Also had the majority of my tools in the back seat stacked up like someone was ready to take them but they put them back and my belonging in a brown bag and I asked why they did that and why they got into my truck with out the keys she said to take inventory. Stole personal items out of my car, such as new laundry soap, detergent, phone chargers, car phone holder. Minor damages to the car they refuse to acknowledge. EXTREMELY TERRIBLE CUSTOMER SERIVCE. UNPROFESSIONAL, DISRESPECTFUL, OVER CHARGING (SCAMMERS). No proper communication, locations are in hidden places with no title or signs stating the company name for ability to find it. I was given one location to pick up my car then got told another. If I wouldn't have called to confirm the address it was at I would've missed the appointment. The business known as Benchmark Asset Resolution **** repossessed my car. After satisfying my account with my bank, this company would not release any information of where I could retrieve my vehicle. Said company only gave me a website where I was to make an appointment to pick up my vehicle. Going to said website, the next available appointment they had was for the following Friday. However, after making that appointment I received a text stating that I would need to wait for an appointment confirmation before they release any other information on how and where I can retrieve my car. Their website also states I will need a Police Release Receipt at a police station said to be indicated on my appointment confirmation. At this time, my hands are tied as they wont allow me to gather said Police Release Report, nor do I know what the total fees will be. As I looked up information on this company, it appears there are already many complaints as to how they conduct business. Each day that my car sits on their lot is costing me money. It appears to me that their goal is to rack up as much fees as possible on the customer as they refuse to give any information for the customer to retrieve their car in a timely manner. This business practice seems very unfair and I believe is a company that should be looked in to and possibly fined for unfair practices.Initial Complaint

Not releasing vehicle after fee and due amount was paid to the financial company which sent release papers to one provided 3rd party repossession company American recovery services. ************************** then sent release paperwork to another repossession yard which had my vehicle, Benchmark Asset Resolution which hides behind the name Benchmark ****************** when asked to provide name of company. They then stated I needed more paperwork specifically a repossession receipt from local law enforcement agency which then charges an additional fee. I was then threatened by "********" if I was to show up 10 mins late to my appointment time there is a $75 cancelation fee and $75 rescheduling fee and if I had an issue about paying for the receipt for the repossession receipt from the **** to file a complaint with them. Currently They're continuing to posses my vehicle illegally and wrongfully and making the reclamation process unjust and they are utilizing predatory and unlawful practices to make it that much more stressful and knowingly more costly to return rightful property after debt was already settled with lien holder and released by them.Initial Complaint

Hello,I am writing to bring to your attention the unprofessional, rude, and disrespectful behavior I experienced while contacting Benchmark regarding my property. My name is *********************** and I am deeply disappointed by the lack of professionalism displayed by the staff.Upon calling the office for questions and information, I was met with aggression and was even hung up on multiple times. Despite requesting to speak to a manager, the individual I spoke to was equally rude and dismissive of my concerns. I mentioned that I would reach out to the corporate office, only to be hung up on once again.To make matters worse, I was informed of a $75 fee on my account for missing an appointment to pick up my property, I was never made aware of a fee. I was not informed of cancellation charges for appointments that I had to cancel last minute. This lack of transparency is unacceptable, and I was met with indifference when I raised these concerns with the manager.I am now being told that I must pay $150 to receive my property, despite being unaware of these charges. The treatment I received while trying to resolve this issue was appalling, and I felt like I was being taken for a joke by the office staff.I am reaching out to you in the hopes that you can assist me in resolving these concerns. I simply want to retrieve my property without incurring unnecessary charges and to address the unprofessional conduct of the office staff. My vehicle was repossessed and I paid the fee the same day to get my car back they gave me an appointment 4 days later. when I picked up the vehicle my ring was missing this is a ring for my sons wife. After reaching out to the complain department. they are telling me nothing was in the vehicle. that is a lie. not only they took the ring many other things were in the car that they cleaned out and took it from the car including a expensive perfume. I dont care about any of it. I just need the ring back.
