I hired Prostruct Engineering on Aug 14, 2025 to provide some plans to submit to the city to permit an existing deck. The amount I paid for their services was $3,000. My complaint is that our contract clearly and explicitly states that they would come and do a site-visit to measure the existing deck to ensure the drawings to submit to the city were accurate. Despite me asking over and over again, they never came to do a site visit. They kept giving me inaccurate drawings to submit to the city that kept being rejected. This has cost me MONTHS. They said the project would be done in 3 weeks. It is now 3.5 months later and I still don't have accurate plans. On Nov 18th after the most recent set of drawings was once again rejected and they still wouldn't come do a site visit, I asked to terminate their services and receive a refund. They refused. I asked every day again for a week and they still refuse and now have stopped communicating with me. $3,000 is a lot of money for me and I am actually WORSE off now than I was when I hired them. Out $3K and still don't have accurate drawings for the city. All I'm asking for is a refund so I can hire another engineer to do the work correctly. I'm attaching our contract here. Please help!

    Business Response

Thank you for the opportunity to respond. ProStruct Engineering respectfully disagrees with the customers characterization of this matter. REMOVEDwas engaged to provide structural engineering services for the project, and our records reflect that substantial work was performed, including structural drawings, calculations, revisions, and project support over the course of the engagement. Our records also reflect that a licensed Professional Engineer performed a site visit in connection with this project. As is common with permitting matters involving existing conditions, revisions and back-and-forth with the jurisdiction can occur during the review process. While the customer was dissatisfied with the pace and outcome of the process, ProStruct does not agree that no work was performed or that the matter supports a full refund.
That said, we understand the customers frustration and have made multiple attempts to resolve this matter in good faith. The parties have already been in direct discussions regarding settlement, and there is also a related pending legal dispute arising from the same project. Because of that, and because the parties have materially different accounts of the underlying facts, ProStruct believes the most appropriate path is to continue working toward a negotiated resolution directly or through the applicable legal process. We remain willing to discuss a mutually acceptable business resolution.
ProStruct has acted in good faith throughout this matter, has communicated its position to the customer, and remains open to resolving the dispute professionally. Because this response will be publicly posted, we are limiting detail here and reserving our full factual and contractual position for the appropriate forum.
