i have reviewed your response through CFPB and you claim that the attached ******* letter you submitted is sufficient debt verification under 15 USC ****g. but i have distilled the violations that i found in your response that i intend to address now; 1.) You have failed to produce a certified mail tracking number with proof of delivery that the attached document was delivered to me within 5 days of reporting this *********** Even if you did provide a certified mail tracking number that shows proof of delivery, this ******* letter has failed to meet congress requirements under 15 USC ****g(a)(4) & (5) Failing to include my right to request debt verification from the original creditor. in your response, it states that I can only ask for the name and address of the original creditor misinforming me of my complete right to dispute the debt which is a violation in each district court in the U.S. (See e.g., ****** v. Ekpsz, LLC, 821 F. Supp. 2d 859, 870)3.) you have also failed to establish a contract signed by me and your agency that expresses mutual assent. without 2 signatures there is no meeting of minds, hence no valid contract in contract law. Therefore there is nothing that legally obligates me into owing your agency a debt. 4.) The information you have produced does not meet Congress's requirements for debt verification. you have simply forwarded third-hand information that doesn't express personal knowledge of proof that the debt exists. pursuant 15 USC ****g you are required to produce verification from a creditor meaning verified accounting records that would validate this debt. E.g., ****** v. Portfolio Recovery Assocs., LLC, 2009 U.S. *********** ******, *6 "Simply repeating second--or third-hand information in the debt collector's file . . . is insufficient under the statute." Id. Customer Answer

    Date: 05/25/2023

I am rejecting this response because:

the information you provided does not validate a debt. no contract is signed between me and your agency expressing mutual assent. without mutual assent there is no meeting of minds, without a meeting of minds there is no valid contract in contract law. Nothing legally binds me into paying your company the alleged debt.

You provided second-hand information that does not meet Congress's requirements for debt verification. your a third-party debt collector lacking personal knowledge on my transactions therefore you legally cannot validate a debt. As the original creditor to my transactions, I don't validate this debt. ( See e.g., ****** v. Portfolio Recovery Assocs., LLC, 2009 U.S. *********** 104952,)

You failed to produce proof of delivery of a ******* letter within five days of reporting this tradeline on my consumer report, violating my rights under 15 USC 169g.

without providing a contract signed by both parties and verified accounting records you have legally failed to meet Congress obligations under debt verification meaning this tradeline must be deleted from my consumer report until that information is provided under 15 USC 1692g(b). (See Semper v. JBC ************ **** U.S. *********** *****, *13)

you have 10 days to remove this tradeline from my consumer report. failure to comply then I intend to take action immediately.

Southwest Credit Systems, L.P. ("SWC") is in receipt of Mr. ******** rebuttal and is grateful for the opportunity to respond.

SWC believes it has fulfilled its obligations regarding collections activity, validation, and credit reporting in accordance with applicable laws and regulations.

SWC mailed ****************** a notification letter informing him that the account was placed in our office for collections. SWC verified the above-referenced debt with copies of related documents provided by our client. The effort we undertook determined (1) that the debt upon which we sought to collect remained a valid and continuing obligation, (2) that the amount which we were pursuing was the correct amount of the debt, and (3) that ***************************** was the correct party responsible for payment of the debt.

Please note, SWC is not obligated to produce a signed agreement as the consumer is not always required to sign one to obtain services. According to ******** the debt is valid and was properly placed in collections.

****************** may submit a written dispute to SWC, and that information will be forwarded to ******* for further investigation. He may email his dispute to ********************************** or mail to PO Box ****** ******, ***** 75262.

    Customer Answer

    Date: 05/29/2023

I am rejecting this response because:   i have reviewed your response and discovered multiple infractions under the FDCPA.

SWC submitted insufficient verification documentation, simply providing second-hand information from a creditor that is not participating in the collection of the alleged debt. pursuant 15 USC ****g(a)(4) SWC must submit debt verification upon request. You have also failed to include this in the ******* letter you have provided violating my rights under 15 USC ****g.

Pursuant black laws dictionary definition of verification- Verification means Confirmation of the correctness, truth, or authenticity of a pleading, account, or other paper, by an affidavit, oath, or deposition. See ******** **************************, 134 111. 126, 25 N. E.

Therefore unless you can provide a signed affidavit from the original creditor and verified accounting records that prove the debt exists, then you have failed to meet debt validation obligations under 15 USC ****g. Furnishing a deceptive form in the process.

SWC failed to include that this communication is from a debt collector and any information shall be used and obtained for debt collection purposes committing a false and misleading representation of my rights under 15 USC ****e(11), as the mini ******* is required in each SUBSEQUENT communication under the statue. (See e.g., ****** ****************, 911 ******** ****, **** (D.N.M. 1995)

I have succinct evidence of each claim asserted against your agency. if you delete this tradeline then no further action shall be taken on my end. Failure to comply then I shall take action immediately to acquire justice for the iniquitous I've received from your agency under 15 USC ****k Civil Liability. (See ***** v. G. C. Services Corp., 677 F.2d 775, **** **** App. ***** ***** (9th Cir. ****).

******** and SWCS are trying to collect $879. This is not my debt. secondly the information that claims to be my debt does not even have my legal name correct they have it listed as *************** which is not my full legal binding name for any type of contract. I have filed a fraud claim and multiple disputes showing that the debt is not mine. Yet it was reported on my credit report sinking my score. All supporting documents have been provided including but not limited to the ACTUAL responsible party for the debt.

I am rejecting this response because: its negligence by both ******** and SWCS when they have received multiple documents and disputes regarding this matter. It needs to be removed and reflected on my credit report. Otherwise legal repercussions will happen and I will be going after further damages caused by both companies
