From July REMOVED, 2025, we experienced major issues with our email provider, Upland Software (REMOVED). For five days, we were unable to send our newsletter to subscribers, which caused us to fail to meet guaranteed placement obligations for our advertisers. On July 28, 2025, we attempted to send an email launching one of our Best Of contests, but due to issues with their system, the contest link was broken. This resulted in calls from confused recipients and a measurable decrease in participation numbers.Despite repeated attempts to resolve these issues, Second Street has been unhelpful. I requested to cancel our contract under Section 8.4 of our agreement, which allows termination if the application fails to meet warranty standards and is not corrected within 30 days of written notice. However, the General Manager informed me there is no way to cancel, despite the contracts explicit remedy clause. When I call their corporate number, I am trapped in an endless phone prompt system and must leave voicemails that are never returned. Email support has been slow or unresponsive. These failures have directly impacted our business, advertiser relationships and audience engagement.I am seeking to terminate our contract under Section 8.4 and receive a pro-rata refund for the unused portion of our subscription, as stipulated in the agreement.
