    I have received no information from the "Shell" companies ******* or Commonwealth Financial Systems. Upon further review, I found that these companies are somehow affiliated or owned by *******************************, LLC. When searched, Commonwealth and ********** have the same physical address out of PA. It should be noted when trying to contact ******* through the number listed to ******** as well as when contacting Commonwealth Financial Systems, both numbers serve no purpose and disconnect the call immediately. There are no prompts to move forward or speak to a representative. It was not until I found a different number for ************************************** that I was able to leave a voicemail.My story is this. Recently, in May and June of 2023, Commonwealth Financial Systems has placed an account in collection on my credit report. This false report was detrimental to my credit and resulted in over a 20-point decrease in my credit score I disputed the account with ********, the next day the results came back as verified. However, this cannot be the case for two reasons 1) I am a retired military commander with the highest level of coverage. Furthermore I am a 100% disabled veteran with full coverage for any care that is necessary for my health. In all cases I immediately notify the VA if I have any admissions to hospitals so that all care is covered However the only way a medical billing error could have occurred is if they inaccurately billed the federal government for proper payment creating a false balance. I have inspected both military and civilian hospitals my entire career and I can tell you billing errors are extremely problematic. Especially due to lack of follow through and knowledge from the facility 2) I have recently contacted every medical facility in Las Cruces NM including Three Crosses, Memorial and Mountain View and many Dr's offices that have ALL reported I have a zero balance I want this resolved and removed immediately ************************* ********** ****** Acct #

The above referenced account was reviewed fully in conjunction with the consumer's complaint and we hope the following information was found sufficient in addressing the issues and concerns set forth by consumer.

    Commonwealth Financial Systems, Inc. (CFSI) is a third-party collection agency that collects on behalf of our clients, most of whom are medical debt buyers. The account in question is the result of medical services provided by ******** LLC on 09/19/2018, the original creditor of the account. ******** LLC later sold/charged off the original debt to our client after it had become seriously past due. Our client, acquiring all ownership rights upon purchase, including the rights to collect on the account, has assigned the account to our office for collection.

    In compliance with Regulation F of the CFPBs Debt Collection Rule, prior to credit reporting, Electronic notification of the debt, was sent on 4/20/23. We then monitored the account for a minimum of 14 days to allow for notice of deliverability issues with that address. After 14 days, when no undeliverability notice was received, the account was sent to be credit reported. A copy of the document verifying the debt was forwarded to consumer for their record 6/29/2023.

    ******************** spoke with our agents twice on June 19th and again on June 23rd and stated he had 3 different insurances that he felt should have covered this service date. Our agents explained the account details and informed him we would place the account in a disputed status. Our agent also provided ******************** with an address where he can send copies of those insurances for us to provide to our client for further investigation.

    In an effort to resolve the complaint, we again ask ******************* submit relevant insurance information in one of the following ways: a copy of FRONT-AND-BACK of insurance card-OR- an eligibility letter showing coverage on the date of service, 09/19/2018.      As stated the original creditor has legal right to sell an account to collections.  Also as stated the collection company has the right to buy such account at their own risk. As stated the collection agency has no contract with **. ***** therefore ** ********** is under any obligation to pay a collection. Furthermore afore said collection agency has never sent proof that such contract between ** **** and the collection agency exists. Neither has any proof been shown to prove ** **** owns, or owes any such debt.  Therefore, any and all further attempts to collect this debt from **.**** will be considered harassment and this case will be sent to the Attorney General for further action against the collection agency

    RE: Notice to Cease and Desist To whom it may concern, This is in reference to the collection letter sent by your company via mail with opening date 12/27/2022. While checking the above letter, it came to my notice that your company has contacted me prior in regard to the alleged debt via mail and telephone. According to 15 USC 1692a (2), the term “Communication” means the conveying of information regarding a debt directly or indirectly to any person through any medium. Please be advised, following a previous dispute, Commonwealth Financial Systems, Inc. conducted a reasonable investigation of debt in question. Our investigation determined  we were attempting collection of the debt from the right individual, and that the information being furnished to the consumer reporting agencies was appropriate and accurate based on information required to be obtained under the applicable procedures.  Our office forwarded a  copy of the supporting documentation  to ****************** on May 31, 2023.

    I would like to file a formal complaint against Commonwealth Financial System regarding its misconduct and violation of my rights. They affirm that I have a debt that they are trying to collect, I have requested the validation of this debt and they have not responded. I do not have any agreement or contract signed with the mentioned company. First, they sent communications to my address that appear to be bills from a medical facility, which I believe is a violation of HIPAA rules since I have never authorized them to obtain my medical information. Second, I sent a letter a month ago (April 16th, 2023 - (attached)) requesting validation of the alleged debt, demanding proof that the debt is mine, and they simply have not responded. However, they continue to report this debt to the credit bureaus. I demand the immediate removal of this inaccurate information from my credit report. The accounts number are: #*********** the amount is $1,977 and #************ amount is $1,857

    Please be advised, the HIPAA law permits creditors to share information with its Business Associates necessary to collect on medical debt. The HIPAA rules require that covered entities and business associates enter into contracts to ensure protected health information is appropriately safeguarded. Commonwealth Financial Systems, Inc. operates under a Business Associates Agreement with our client which certifies that we agree to not share private health information with anyone other than the consumer, or authorized party, and we further agree to keep records secure. Our company has been fully compliant with HIPAA requirements concerning privacy of medical records.

    The accounts in question are medical debts that have been placed with our office for collection. In compliance with Regulation F of the CFPB’s Debt Collection Rule, prior to credit reporting, our office sent consumer electronic notification of the debts on 11/03/2022.  We then waited fourteen (14) days, the reasonable period of time as defined by the CFPB, to allow for notice of a deliverability issue. No undeliverable notice was received, and after 14 days the accounts were sent to be credit reported.

    Following notice by the credit bureaus the consumer was disputing the accounts on the basis: Not my Debt, our office conducted it's reasonable investigation and confirmed the accuracy of information in our records, and that being reported to the credit reporting agencies. A copy of the documents verifying the debts was forwarded to consumer for their record 03/23/2023.     As established by law for the Fair Debt Collection Practices Act, (FDCPA) the company reporting the alleged debt must provide me with proof that said accounts are really mine. On 04/16/2023 I sent a communication requesting the proof and the validation of these accounts and more than a month later there has been no response, which has led me to question its accuracy and legitimacy. On May 30, 2023, I sent a new communication giving this agency an opportunity to provide the requested evidence, I await a response.

Please be advised, Commonwealth Financial Systems, Inc. is a third-party collection agency and as such, we do not have contracts directly with consumers. We service accounts on behalf of our clients with whom we share a contract and who has purchased the account from the original creditor. The original creditor has a right to sell/charge-off accounts after they become seriously past due. While the consumer did not create the debt with the collection agency, the original creditor has sold/charged off the original debt to our client who then assigned it to our office for collection. This is what gives the collection agency the ability to collect for an outstanding debt.

    The account in question was validated on 05/04/2023 as part of a reasonable investigation resulting from previous dispute on the account and the investigation determined we are attempting to collect the debt from the correct consumer.     •The account in question is a medical debt for services provided on 07/12/2017 by *** ***** *** **** that has been placed with our office for collection. In compliance with Regulation F of the CFPB’s Debt Collection Rule, prior to credit reporting, our office sent consumer electronic notification of the debt on 12/01/2022.  We then waited fourteen (14) days, the reasonable period of time as defined by the CFPB, to allow for notice of a deliverability issue. No undeliverable notice was received, and after 14 days the account was sent to be credit reported.
    Please note licensing information is available to the public and can be found online within the consumer's state.
    A review of the file found Commonwealth Financial Systems Inc, acted in compliance with the credit reporting requirements imposed by Fair Debt Collection Practices Act (FDCPA) and Fair Credit Reporting Act (FCRA). As per consumer's request, we will cease and desist collection activity in relation to the debt and return it to our client, informing them Commonwealth Financial Systems will no longer be servicing the account.
