We then waited fourteen (14) days, the reasonable period as defined by the CFPB, to allow for notice of a deliverability issue. No undeliverable notice was received, and after 14 days the accounts were sent to be credit reported. A billing statement was then provided by the current creditor and forwarded to consumer for all three separate accounts.
•Please be advised, the HIPAA law permits creditors to share information with its Business Associates necessary to collect on medical debt. The HIPAA rules require that covered entities and business associates enter into contracts to ensure protected health information is appropriately safeguarded. Commonwealth Financial Systems, Inc. operates under a Business Associates Agreement with our client which certifies that we agree to not share private health information with anyone other than the consumer, or authorized party, and we further agree to keep records secure. Our company has been fully compliant with HIPAA requirements concerning privacy of medical records.
We have marked the accounts as disputed by consumer and, in accordance with the Fair Credit Reporting Act (FCRA), a request to update the tradelines for the accounts to disputed was submitted to the credit bureaus. I received information from you attempting to collect an alleged debt with account number *********** . YYour initial communication to me of the alleged-debt was within 30 days ago. I am rejecting this response because:This balance does not belong to me. I have talked with them multiple times and they can't send me any proof that the person in said collection is indeed me. No such reference or copy of what exact services I received I have since reached out to the original creditor and found out that I have never even seen that doctor at all, also I was completely 100 percent covered by my medical insurance and did not have one unpaid medical service that year I was also resolving a stolen identity case with the IRS during this time I believe this case is mistaken identity or fraud by another person I ask again that this be removed from credit report as it does not belong to me.

that *** ******* found our company response to be unsatisfactory, however as
stated in our initial response A copy of the documents verifying the debt was
forwarded to consumer for their record 06/14/2023. As this information stated,
the referenced account is the result of emergency physicians' services provided
on 04/22/2017 by ******* **** ***** **** LLC, the original creditor of the
account. ******* **** ***** **** LLC, later sold/charged off the original debt
to our client after it had become seriously past
due.
Prior to credit reporting, our office sent written
notification of the debt to consumer in an electronic communication on
05/01/2023. This letter provided the original creditor, name of the current
creditor to whom the debt is owed, the amount of debt, and all other
disclosures as required by the Fair Debt Collections Practices Act (FDCPA) and
applicable State law. We then monitored the account for a minimum of 14 days to
allow for notice of deliverability issues. After 14 days, when no
undeliverability notice was received, the account was sent to be credit
reported.
Should complainant believe account to be fraudulent our
client requires a copy of police/incident report or affidavit of ID theft with
respect to this specific debt being collected. As well should *** ******* have
proof of coverage or additional insurance information , we ask he submit in one
of the following ways: a copy of FRONT-AND-BACK of insurance card-OR- an
eligibility letter showing coverage on the date of service, 04/22/2017. This
information can be mailed to our office at 245 Main Street, Dickson City, PA
18519, or emailed to [email protected].
To prevent any delays, the CFSI Acct #********* should be documented on all
correspondence.
