I paid ABC Driver's Education $464.00 on 11/13/2023 to enroll my daughter in their Driver's Education course to be held in Los Alamos, New Mexico starting on December 2nd, 2023. The class was supposed to have 30 hours of classroom instruction and 7 hours of driving instruction. The classes were scheduled from 1-5pm Saturday December 2, 9, and 16th, and Monday-Friday 3-7pm December 4-8th, and 11th-15th. On December 2nd, my husband and daughter arrived on time for the class. "*****" from ABC Driver's Education met us at the correct time and place but told us that the classes had been cancelled because there were not enough students for a Los Alamos class. No communication had been shared prior indicating the change to the schedule. ***** said our daughter could take the Learner's Permit test that day, with a 1 hour class with him, and that ABC would offer another class in February, 2024, and that ABC Driver's Education would schedule driving time at their convenience with the enrolled students. He also told my husband he would refund our money if we did not want to do the February class. Today, I called to ask for a refund because we do not want to do the February class. ***** told me that since my daughter did the 1 hour test for the learner's permit referral card, that he would not refund our money because the referral card is what we paid for anyway. He also claimed my husband signed a document acknowledging a no refund policy. However, while I requested a copy of that signed document, ***** has failed to produce it. I am looking for a refund of our payment, or at least the majority of the payment, given that ABC Driver's Education failed to provide the contracted services (less one hour) on the advertised schedule, and did not communicate the changes to their schedule in a timely fashion.
