I believe that Construction Dispute Resolution Services, LLC (CDRS) is nothing but a scam. I can certainly attest that I would not recommend CDRS. I was forced to use them by an incompetent small claims court judge. I had a home built in ******** by a company based in ******** that uses a company based in VA to administer a so-called extended warranty program. The ******** home builder company (in name only) uses the VA based **************** to cover the shoddy work of their subcontractors. The warranty company, the construction company, or in my case the law firm associated with CDRS uses CDRS to cover up the builders incompetence management. I was forced into having an arbitration meeting held at my house to determine whether or not a defect would be covered by the warranty company even though the warranty companys program specifically specifies the defect as not being covered by the warranty. Then to make the situation even more unbelievable is that the arbitrator assigned to arbitrate the situation has had a long time relationship with the construction companys law firm. Another interesting point is that I objected to the arbitrator because of his past association with the builders law firm since I felt it would be a conflict of interest. The president and CEO of CDRS ignored my concerns and told me it was his decision to use this arbitrator since he felt he could remain neutral. The arbitrator was supposed to know something about construction but I certainly question his knowledge. The arbitrator wouldnt even allow me to explain why the defect was a serious issue and what caused the defect. He wanted to merely look at it and deny the coverage based on what is written in the so-called extended warranty booklet. What a scam. I can tell you this concept of general contractors having no responsibility for the incompetence of their management team, having a so-called extended warranty program, and using a so-called arbitration hearing is an absolute fraud.

The homeowner was not able to understand that CDRS was retained to enforce the home warranty program. He would not accept what the warranty stated, he wanted his wishes understood.
