I am contacting you to get help with our faulty solar system and to seek justice not just for me, but everyone who was lied to and taken advantage of by *********** and their finance solar company, Sunlight Financial. We decided to go with *********** (i.e. Power Home Solar) because they offered the longest amount of warranty time and they promised to significantly reduce our power bill with their advanced system.We got our system the summer of 2021 and it has been a nightmare ever since. Our system has worked from time to time, but NEVER close to what was shown to us or promised. Our backup battery has never worked. We had reached out to *********** multiple times to come and fix our system. It would take them months to come fix it. Once they fixed it", shortly after it would be down again. It was never a true fix. As I'm sure you are aware, ***********/PowerHome Solar has filed bankruptcy and is under investigation, so therefore we are no longer getting help through them.When we originally met with the sales associate she showed us our past electric bills, some of which were over $300. She had graphs to show us what we would be paying years from now with the rise of energy without solar. We were promised that we wouldnt have a monthly energy bill for many months out of the year. After 25 years our system would be paid off and we would have a small payment to just the ***************** This has all been a lie and evidence of misleading sales practices.We are currently financed through Sunlight Financial who is aware of the situation, but has not offered to help. I don't believe they are honoring the holder rule. Many Attorney Generals across the country have reached out to the financial companies asking them to pause payments and interest as well.Attached is our contract, our energy production, and attorney general letter. Lastly, there are hundreds, if not thousands that have fell victim to their illegal sales practices and deceit. Please help us.Business Response

I entered into an agreement with Solar Titan USA for the installation of a solar energy system at my home, with the project financed through Sunlight Financial. The expectation was straightforward: Solar Titan would complete the installation, and I would repay the financed amount for a fully functional system. However, this process unraveled when Solar Titan USA abruptly went out of business before finishing the installation. What I was left with was an incomplete setupessentially a half-finished project that provided no functional benefit or value to me. Despite this clear failure on their part, Sunlight Financial has persisted in attempting to hold me financially accountable for the full amount of the loan, which totals $49,964.94. They have enlisted ********************************, a collection agency, to pursue this debt, even though the service I was promised was never delivered.I have taken proactive steps to address this injustice. I formally disputed the debt with ********************************, invoking my rights under the Fair Debt Collection Practices Act (FDCPA). In my dispute, I made it clear that I am not liable for this amount because Solar ********* failed to fulfill their end of the contract before shutting down. I requested validation of the debt, including proof of my obligation via a signed agreement, evidence that the installation was completed, and documentation showing the debt was legally transferred to the collection agency. To date, I have not received sufficient proof to substantiate their claim, yet the collection efforts have continued unabated. Worse still, this unwarranted debt has been reported to credit bureaus, damaging my credit score and causing me significant distress.Sunlight Financial, as the financier, shares responsibility here. Date Dispute: Sunlight claims Solar Titan completed the installation by March 15, 2022. I assert this is false, as the installation was incomplete then, and Solar Titan abandoned the project. The system only became functional later through my efforts, independent of the contract. This contradicts their claim of completion by March 15, based solely on Solar Titans unverified word.
Premature Billing: I have a recorded conversation proving Sunlight said billing would start before installation was done, contradicting the Loan Agreements 60-day post-installation term. If billing began May 15, 2022, and installation wasnt complete, Sunlight breached its own terms. They must prove the system worked by March 15, beyond Solar Titans claim.
PTO and Functionality: Sunlight cites the September 20, 2022, PTO as proof of completion, but this was six months after the alleged installation and after billing started. I was charged for an unconnected system until September, supporting my claim of an incomplete setup at billing onset.
Loan Terms: Sunlight says payment obligations are separate from system performance, but they facilitated the Installation Agreement and cant dodge responsibility for premature billing. Their Generac referral doesnt address the May-to-September 2022 period when I paid without full benefits.
Payment History: Sunlight argues my two-year payments validate the loan, but I paid under duress, not acceptance. My recent complaint reflects growing awareness, not inconsistency. They claim I never raised issues, but [insert evidence, if any] proves otherwise.

In September 2024 I filed a complaint with the BBB regarding this issue. In October 2024 I received a resolution (screenshot attached) and was told the process would take ***** days to complete. It has been over 90 days and no documentation has been received from Sunlight Financial or any other party. When I called the number provided to me in the resolution the representative (******) indicated that he cannot speak to me because I am not on the account and requested that I send documentation. He also refused to allow me to speak to his supervisor. I need documentation that this issue has been resolved and the lock on my meter removed.Business Response

I am filing this complaint against ******************** and Sunlight Financial regarding my solar loan, which I purchased through ************. My solar system is no longer functioning, and Vision Solar, the company that installed it, has gone out of business. Despite my system being under a 30-year warranty, I have no way to claim service, yet I am still being held responsible for loan payments.I contacted Sunlight Financial multiple times seeking resolution:Initial Complaint: I was told it would take a few weeks for someone to follow up, which is unacceptable as I am still expected to make payments while my system is not ************ Deferral Request: Another ticket was created, but the representative told me she had no idea when someone would reach out to ***** is unfair and unreasonable to continue making payments on a non-functional system with no path to resolution. I am requesting that ******************** and Sunlight Financial either suspend my loan payments until this issue is resolved or cancel the loan due to breach of contract and non-delivery of service.Additionally, I am aware of multiple lawsuits against Vision Solar and Sunlight Financial for violating state consumer protection laws and Floridas Deceptive and Unfair Trade Practices Act (FDUTPA) due to misleading sales tactics. On 12/27/22, we signed a sales agreement with **************** and financing agreement with Sunlight Financial. Our roof was replaced and installation of solar panels began in June 2023. After many failed attempts in getting Vision back out to finish the job and correct issues, as well as a complaint to BBB, the installation was completed in Sept. 2023. The town came out to inspect and failed our system. Vision came out to remedy, but then it was silent until we received an email on 12/28/23 stating ************ had gone bankrupt and that our financing company would be point of contact on the project. Payments to Sunlight began Aug. 2023. On 2/15/24, we signed remedial actions with Sunlight indicating they were undertaking certain obligations voluntary and at their own expense in order to resolve issues with our system. After 6 payments with no progress or acceptable updates, we began requesting payment deferrals, however the interest is still accumulating. Sunlight has sent at least 3 solar companies out to inspect our system, but there is still no progress towards completing necessary inspections and connecting our panels to the grid. Each time we call for an update we get the run around and each person we talk to refuses to give us the name or contact information for anyone that can help. Each time they open a ticket and say someone will review and contact us, but we never get closer to resolution. I've had to google Sunlight's staff directory to locate email addresses of anyone that works there who might be able to help. After re-reviewing the sales agreement with ************, the terms and conditions in 16.1.2 of Addendum A clearly state we as the Purchaser have the right to terminate our contract with the Seller (Vision) if they go bankrupt. We wish to exercise this right and proceed with termination. We are not asking for any money, just simply out of the contract with no obligation to repayment.Business Response

I am rejecting this response because we strongly disagree that our loan was funded in accordance with the terms and conditions of the Loan Agreement. We have email correspondence between ourselves and Vision Solar along with picture proof that shows we had component parts missing after the installation on 6/19/23, specifically skirting which supports the panels. Additionally, you have indicated that the only outstanding action is to obtain PTO which would include wire management and final inspections. Based on our review with respect to the definition of installed in a solar loan agreement, all necessary permits must be obtained AND all inspections must pass in order to ensure compliance with safety standards. In its current state, our system would not pass inspection which is supported not only by the representative you put us in touch with from **************** but your own statement indicating wire management is needed. You've indicated that Pronto, **********, and *********** all confirmed the system is substantially installed in accordance with industry standards, however substantially does not mean complete. We also have great concern with the fact we were given no say in who our new installer would be. Who is **************************** Are we supposed to just trust Sunlight that this company is qualified to complete the job? We never saw any reports or quotes on our system and were given no information on this company to feel comfortable with the takeover. At the end of the day, we entered an installation agreement with Vision Solar...we have no agreement with **************************** We believe Sunlight Financial prematurely provided funds to Vision Solar before our system met the definition of installed. Vision Solar went bankrupt before our system met the definition of installed. Sunlight is in breach of contract and given this, we have the right to terminate all agreements and relationships.Business Response

On April 14, 2024 we secured a Loan for $50k with Sunlight Financial through a ******************** Multitaskr. Three days after our loan was approved, Multitaskr forged a docusign signature to Sunlight saying our project was complete and they gave our entire loan amount to Multitaskr even though there was no way our project of a ADU was complete when it hadnt even started yet. We never received our product of a completed or partial ADU and have been trying to work with Sunlight regarding this, with no resolution. Since then we have found out more information about Sunlight Financial. They have struggled for the last couple of years and have relied heavily on securing new accounts to sell to investors. Sunlight was aware of the fraud involving Contractors stealing victims info to receive payments for work that was not done.Sunlight was still offering Loans to us knowing Contractors were committing fraud by using victims personal information(our docusign signatures showing the project was complete). This was not disclosed to any of the ********** their own admission they didnt have adequate protection against this fraud.**** ****** the CEO of Sunlight jumped ship from the Company the year before and Sunlight announced that it will be acquired by a consortium of investors in the solar energy industry. One of them being **************** whom they now say they sold our Loan to. Also, **** has now decided to delist Sunlight Financial and the companys trading securities will be suspended.Two other Loan Companies that we also secured through ********** have rescinded their loans to us and have reimbursed what we had paid in up to this point.Business Response

In November 2021, I contracted with ************ to install solar panels at my residence, financing the project through Sunlight Financial. However, the installation has been fraught with issues, including improper practices and non-compliance, leaving the system non-functional. Since April 2022, I have paid $12,928.51 to *********************** (******), including an IRS Solar Panels Credit of $10,274.32, but the system remains non-operational. Vision Solar installed the panels in February 2022 without prior notice or necessary documentation.Upon investigation, it was discovered that ************ failed to obtain the required permits from my HOA and the City of *********. A roofing inspection revealed broken tiles and potential roof damage, which could void my warranty. The City of Homestead rejected the permits due to non-compliance with wind code requirements. Attempts to resolve the situation with Vision Solar were unsuccessful. Their design proposals were repeatedly rejected, and they failed to address the concerns raised. In December 2023, ************ announced furloughs, further delaying the project. Throughout 2024, I sought help from multiple entities, but inspections failed, permits expired, and the project remained incomplete.On January 1st 2025, I submitted my third no-interest payment deferral form to ******, explaining that the debt is illegitimate since the system is still non-operational without Permission to Operate (PTO). I hired a reputable local contractor to complete the project at additional costs. Given that the system remains non-functional due to non-compliance, I request the cancellation of the Sunlight Financial and Vision Solar contracts and the elimination of the TechCU debt. Additionally, I seek assurance that no lien will be placed on my home or damage done to my credit. This situation has caused significant financial loss and ongoing stress, and I urge prompt, fair resolution.Business Response

Sunlight Financials claim that installation occurred on February 15, 2022, is misleading. Florida law requires solar systems to be operational, with Permission to Operate (PTO), to be considered "installed." PTO remains incomplete, leaving the system non-functional. Vision Solars failure to achieve this milestone constitutes a material breach of contract.
Sunlights acknowledgment of delays caused by ************ and third-party contractors like 365 Pronto and **** underscores the incomplete status of the system, more than three years after the project began. This breach invalidates the underlying sales agreement and related financing. Additionally, Sunlight failed to ensure ************ could meet its obligations, leading to financial and operational hardships.
The loan is illegitimate under Florida law, as the system has not delivered its promised functionality. Loan clauses permitting installation without PTO contradict Floridas Deceptive and Unfair Trade Practices Act (FDUTPA), making the financing agreement void.
Deferrals in 2024 do not resolve the core issue: the loan remains tied to a non-operational system. I formally request cancellation of the loan, removal of the lien (UCC Financing Statement), and assurance that my credit will not be harmed due to circumstances beyond my control.
While I acknowledge Sunlights efforts to resolve this matter, they have proven insufficient. I will engage with ***********************, as recommended. However, if the settlement fails to resolve the loan cancellation, lien removal, and credit concerns, I will pursue legal action to protect my rights.Business Response

I purchased these solar panels about 5 years ago from a solar company that went bankrupt a few months after the panels got installed but sunlight financial took over everything. The first of many problems was that I was promised on paper to pay 110 dollars a month which was what I was paying for electricity but about a year later the payments started escalating to over 220 dollars and then to to the current ****** for the last 3years which I would never agree ***** when they installed the panels they had me fix my roof which Im fine with but when they put everything in they messed up my roof which to this day still leaks even though Ive spent thousands repairing holes. Also the panels stopped working a year into the service and sunlight did fix the problem but it only worked for a year and the last two years they havent worked and sunlight wont fix it and wont let me out of this agreement either. For me the best solution is they can come get their equipment and Im willing to get a new roof as long as I stop paying for equipment that doesnt work and never gave me the electrical savings that I was promised. I entered into a loan agreement with Sunlight Financial to fund the construction of an ADU on my property. The day after signing the agreement, Sunlight Financial disbursed the full loan amount directly to the construction company involved in facilitating the loan approval.Despite receiving the funds, the construction company failed to build the ***. They have since closed their office and ceased all communication. It is evident that the project could not have been completed in a single day, yet the loan was funded as if it were.Sunlight Financial worked directly with the construction company to facilitate this loan and approved the disbursement without ensuring that the project was even started. This lack of oversight has resulted in significant financial and personal harm to me as the borrower.I hold Sunlight Financial accountable for this failure, as they acted in concert with the construction company and released the funds prematurely without due diligence.
