    As a resident of the *****************************************, this issue is both pressing and personal. Having reviewed the 2024 budget expenses, Lot Owners found no substantial financial reason justifying an increase in the 2025 budget proposed by the Cusick Company. Unfortunately, the Lot Owners voices were silenced during the budget ratification meeting, held on November 18, 2024. Apparently, the ***************************************** Association is still under declarant control, per ** General Statutes - Chapter 47F Article 3 section (c), hence our right to reject the budget was stripped away. It's crucial to remember that it is under the same statutes that state "the budget is ratified unless at the meeting a majority of all the lot owners in the association or any larger vote specified in the declaration rejects the budget." We were not given that opportunity as lot owners. We were muted. We were ignored. We need a platform to voice our concerns and expectations about the fiduciary responsibilities of our community association. We are not asking for much. Just for our rights as lot owners to be respected. Our primary demand is that the Cusick Company adhere to the ** General Statutes, and provide us with an opportunity to respond to the 2025 budget increase. We deserve transparency and accountability from those in charge. A majority of the Lot Owners signed the petition to reject the 2025 budget ratification for the ***************************************** Association. However, the Cusick company claim that the "correct process was followed based on the ** State Statute and the *** governing documents as it relates to the budget."

    We are aware of your concern.  As you know, your community is still under declarant control and as such they reserved enough declarant votes to ratify the budget. Residents were not muted during the budget ratification process.

    The Budget speaks for itself and is based on the monies your community will need to support itself once it is fully built out.  If you would like to come in the office and speak personally to someone, we will be happy to explain to you your current budget.

    Cusick does not set the budgets, your *************** does but we will be happy to go through it with you item by item to help you better understand why the budget is what it is....

    On 08/05/2024 **** featured a news story on litigation involving Cusick, where in WBTVs research found Cusick, faced allegations that Cusick failed to properly manage financial accounting by failing to perform yearly financial audits. This lack of financial accountability and integrity is what our HOA has experienced under Cusicks management. In addition, business filings identified by **** showed, Cusick has another corporate name, **********************. While Cusicks website does not mention Blue Lake or its owner, **** found several financial filings tying both ********* and Cusick together. Cusick never disclosed this information to The Crossings during the *** process and has yet to produce a financial audit report or required certification to stakeholders in The Crossings. I would like to know what guidance Cusick has provided to our current ********* on following the communitys governing documents; and I would also like the details on when a financial audit is scheduled with an independent licensed accountant to review our HOAs finances? None of the financial reports provided by Cusick to our community have included the required financial certifications in accordance with our governing documents. In addition, on 06/18/2024, ********* featured a news story that stated the following: Court records show a former Cusick employee is currently facing charges for embezzling more than $90,000 from Cusick. The case was filed in 2019 and is still pending. She worked for Cusick after pleading guilty to stealing money from another company she worked for in 2015. In 2013, ******* ****** pleaded guilty to three counts of *** fraud in a federal case. ****** is listed as the companys Vice President. This criminal history was never disclosed during the *** process. What safety measures does Cusick have in place to protect our finances from theft, embezzlement and misappropriation considering the organizations criminal past?

This matter was resolved well over a decade ago and included mitigating circumstances. Following the case, ******* has fulfilled all legal obligations and worked diligently to rebuild her professional reputation. 
    Additionally, as stated Janettes qualifications and ongoing commitment to ethical practices have been validated by the *************************************, which granted her a brokers licensea rigorous process that considers both professional conduct and character. 

    Present safety measures: We take the protection of client finances very seriously and have implemented robust safeguards to ensure the integrity of our operations. 
    We utilize a system of checks and balances, including dual approvals for transactions, segregation of duties. 
    Comprehensive background checks are conducted for all employees, especially those in positions of financial responsibility. 
    While past incidents may raise concerns, its important to note that our current safeguards and processes are designed to help prevent such issues from occurring.

    The fact that NONE of my questions have been addressed says a lot. THE CORPORATE TRANSPARENCY ACT (***) WAS CREATED TO IMPROVE TRANSPARENCY AND DISCOURAGE THE USE OF OPAQUE CORPORATE STRUCTURES AS A TOOL FOR INVESTORS TO MOVE FUNDS. Cusicks unresponsiveness to my inquiry regarding **********************, the investment firm doing business as Cusick, is concerning. 

    1) DOES BLUE ************* THE INVESTMENT FIRM dba CUSICK PLAN TO COMPLY WITH REQUIREMENTS OF THE *** AS A REPORTING COMPANY TO FinCEN? 
    2) It is my understanding that Blue Lake Capital dba CUSICK HAS SUBSTAINTAL CONTROL AND IS SIGNATORY ON BANK ACCOUNTS FOR THE CROSSINGS AND HAS THE ABILITY TO MOVE OR DIRECT HOW MONEY IS MOVED IN THE CROSSINGS BANK ACCOUNTS. None of ************* board members have this same level of authority. In its position of substantial control, BLUE ************ dba AS CUSICK HAS INTERNAL POLICIES THAT ESTABLISH THOSE WHO MAY AUTHORIZE AND THOSE WHO MAY SIGN OFF ON MONIES THAT MOVE IN AND OUT OF THE CROSSINGS ACCOUNTS. Please identify ALL decision-makers in that established pipeline.
    3)    IF YOU FEEL THAT THERE IS NO REQUIREMENT FOR BLUE ************* ******* ****** *******, CUSICK AND ITS EMPLOYEES WHO ARE AUTHORIZED TO MOVE OR DIRECT THE MOVEMENT OF MONIES FROM THE CROSSINGS ACCOUNTS TO REPORT TO FinCEN UNDER THE CORPORATE TRANSPARENCY ACT PLEASE EXPLAIN WHY.

    THERE IS A DIFFERENCE BETWEEN AN HONEST ERROR AND UNETHICAL CONDUCT. The latter seems to follow *******, who linked a presumed error to UNLAWFUL CONDUCT. That in and of itself told me a lot about her present-day character.

     As Cusick again tosses corporate transparency out the window, let it be known that I have already taken the steps that Cusick has suggested to no avail. Thus, the reason I utilized this forum. Cusick and ******************* of directors have had an opportunity to respond to my requests since October 28, 2024. **** *******, Cusick Association Director responded with a simple Thank you. On October 29, 2024, ******* *. (****) ****, Director @Cusick responded stating that he had forwarded my concerns. On November 18, 2024, I raised these concerns during an open meeting held by ******************* with its board members present along with Cusick Association Director, **** ******* and Cusick VP, ******* ****** in attendance. Everyone sat silent on the issues and offered no response. 

    A second homeowner took the platform and raised the same concerns, AGAIN CUSICK ASSOCIATION DIRECTOR **** *******, CUSICK VP ***** ****** AND ALL BOARD MEMBERS IN ATTENDANCE SAT SILENTLY WITH NO RESPONSE. The truth is, Cusick has had an opportunity to address these concerns since June 2024, when ***** aired its first news report revealing *****************, AN INVESTMENT FIRM DOING BUSINESS AS CUSICK - BEHIND THE SCENES - MANAGING COMMUNITY ASSOCIATIONS.

    The opportunity still exists for Cusick to willfully engage in open dialogue as a matter of public interest considering that **********************, an investments firm doing business as Cusick Management Company manages over 200+ community associations according to its website and is the registered agent for hundreds of community associations ACCORDING TO RECORDS FILED WITH THE *****************************. I remain open and cooperative to engage in discussion, although I believe that at some point the **** of Treasury will be required to ignite conversation.

    CUSICKS LACK OF TRANSPARENCY AND COOPERATIVENESS IS A GREAT EXAMPLE OF WHY THE CORPORATE TRANSPARENCY ACT IS SO NEEDED IN THE COMMUNITY ASSOCIATION INDUSTRY.

    I need your advice as to whether I should file a complaint against Cusick Community Management for not enforcing a late night noise complaint in our HOA managed community. I have sent 3-4 e-mails to Cusick over the past week identifying the issue and clearly stating where I live and all I have received in return are two automated replies stating that someone will be in touch within a couple business days and, one asking what community I live in. I have heard nothing more from them. I shouldnt be surprised since their average rating in a 1 out of 5. I am concerned about a reprisal from Cusick, but the noise goes on until as late as 2:30 on Sunday mornings. Please advise what I should do

    I very much regret that my company has fallen short and not returned your call in a timely manner.  Trust me, that is NOT our norm and I have elevated your request.  I will also be having a word or two with our customer service department.  That said, unfortunately, ***'s and Boards have only so much authority and if the noise continues, I would suggest you call the police as there are city wide noise ordinances in communities that need to be adhered to.

    That said, the manager of the account will be calling you to see exactly what the *** can do to help out in this situation.

    Not sure what my monthly HOA payments go to. I own ************************************** and have several complaints about the management. Gotta walk sideways to my front door as bushes are overgrown and not trimmed, parking area is a mess and huge sink holes that can hurt a car or a person walking have been a problem almost 2 years. My back patio looks as if it has never been cleaned with mold and mildew growing up sides of building, closet door, and gas meter. Shingles missing off roofs. Again I wonder where mine and everyone else's HOA money goes. This months 5/2024 there is a special assessment payment which makes my total payment over $500. Where does that money go to because nothing has been fixed.

    I am in receipt of your complaint, unfortunately we, as your management company have no authority to schedule any repair work unless the ***** of ********* expressly gives us permission to schedule. If you want to see where every dime of your dues is going, you simply need to ask your manager for a copy of the financials and/or look online.

    Currently, your dues are $243 a month and there is no special assessment in place at this moment. 

    Again, all your complaints need to be addressed with your ***** as we are unable to approve any repairs without their express permission.

    I am rejecting this response because:  property looks like c*** and I pay as well as the neighbors a lot of money monthly and nothing gets done.  Parking is an issue and not only will these pot holes/sink holes in parking lot hurt cars but any one walking as well.  Maybe I cannot read well but I have paid my ***s every month and pretty sure the picture included says.  BTW, so since the landscapers cannot trim the bushes I guess I have to as well as clean outside of building since the *** Board seems to be useless when all it would take is a drive through the neighborhood to see the neglect.  Again what do my ***s funds go to?  My understanding is between all the ***s in the neighborhood, Cusick makes about $40,000 a month and does not do anything.  Seems to me you could fix things instead of coming to this.

    I am a resident of ******************************** community and a customer of ********************** HOA *******************************************. I previously (in 2021) submitted an ARC review application through the online portal and received appropriate approvals from the Board/********* before commencing work on my patio and outdoor fireplace. The Cusick HOA Management Company subsequently (2.5 years later) sent me a violation saying that I had my patio and fireplace installed without approval, which is not true. Unfortunately, the online portal system does not retain records for more than 2.5 years, and I (or *********) no longer have access to this information.Despite explaining this situation to Cusick, Cusick HOA Management Company has not provided a solution and refuse to help me resolve this collaboratively. Their communication consists of emails that request the unavailable records and offer no alternative path forward.My *************** contribute to the services provided by Cusick HOA Management Company, which includes assisting residents with the ARC review process. I have attempted to resolve this issue directly with the company but have not received satisfactory assistance.

    Unfortunately we cannot provide a resolution for something that you did not keep records on  and that your previous management company did not provide to us. 

    The solution would be to submit a new request so that the board is able to review and approve again since you have no records, and niether do we. I find it so unfortunate that you would report my company to the BBB for an issue that we have literally no control over.

    On October 25, 2023, Cusick Property Management sent misinformation to homeowners of The Crossings Community Association regarding our upcoming annual meeting. Cusick stated there are 2 board seats for a 2-year term open and 1 seat with a 1-year term. I sent an inquiry to *********************** asking for clarification on the open seats attaching a letter with valid evidence from legal counsel supporting the fact that there are 3 expired board seats open, each with a 2-year term. ***** response completely evaded my question. This bespeaks that Cusick, like our prior association management company, is aiding and abetting our community board in conducting yet another rigged and noncompliant election. As of today November 13th, **** still has not provided an answer to my inquiry. In addition, Cusick sent an email reopening the nomination window that closed on November 8th. While the email is under the signatory of The *** board it was sent by Cusick evidencing their complicitness in this attempt to steer an *** election. In the real world when a filing date for an election has been closed it remains closed with the possibility of write ins or nominations from the floor. The fact that Cusick sits by quietly without answering homeowner questions knowing that the board is not following their governing documents stains Cusicks hands with the mud of election rigging. It makes them an association management company that cannot be trusted. I want my questions answered.

    The information that we received from the previous management company indicated that two seats were up for 2 years and 1 seat for one year. After further investigation we found that there were indeed 3 spots open for reelection for 2-year terms, annual notice went out in the mail once we figured out the correct open spots for their community. Their annual meeting was conducted on 11/27 where elections took place.....

    Cusick has proven that its business practices follow predatory association strategies. Based on my observations, Cusick operates from knowledge and influence gained through employees with criminally intertwined pasts. Therefore, I reject Cusicks response. I believe that Cusick personnel was in the midst of carrying out a divisive plan to steer The Crossings election, thus not responding to the BBB complaint until after the election. An honest answer at the onset would have ruined their plan.   I emailed Cusick on 10/25/2023. I was never afforded a personal response from Cusick.  I was treated as if my concern as a stakeholder of the association did not matter. As a stakeholder in the association, how can I trust Cusick with more consequential and weighted issues if I cannot get a response to a simple question without outside intervention.  It is clear that Cusick is a company that will do whatever it takes to keep a contract, regardless of whether it violates the law or homeowner rights. We should have seen that writing on the wall when we learned that Cusick VP *************************** plead guilty to felony mortgage fraud (prior to being hired by Cusick) that resulted in an order for restitution of approximately $836,875 and again when Cusick had an employee (with prior embezzlement convictions yet hired by Cusick) stealing money from its coffers. Neither of these criminal entanglements were disclosed by Cusick when **************************;responded to my request for proposal. Anyone considering Cusick as its service provider, be aware ***CRIMINAL MINDSETS ARE AT WORK!*** This is not the representation you should want to manage your most valuable asset. A criminal mind says, Operate in the gray. A prudent mind says, Be responsive, maintain integrity and follow the law.' When a predatory association management links up with dishonest board members to manipulate outcomes it can and will run an HOA into a financial hole. ***Cusick Community Management is not to be trusted.***

    Cusick, has unprofessional staff ...who think they can lie ,Harras homeowners without being held responsible.1- I have rental property at community run by Cusick ...bylaw require submission of the lease at time of a new lease and uptake Cusick if lease continues beyond 1 years on a month-to-month basis if there is a clause like that in the leas.2-Rules and regulations has been followed by me lease was submitted to Cusick (PROBABLY TWICE).. and Cusick acknowledged receipt .3- Employee for Cusick *********************. she believes she has ultimate authority to terrorize homeowners ...called me for a hearing for not complying with bylaws. Despite the fact Cusick send me e mail proving that I complied.4- Another great example of Cusick employees lies and terrorizing homeowners ... is the fact i do send my payment every month for *************** Evey month for around 20 years on auto bill pay .... Cusick took over the community about a year ago, payment was sent as usual. 5- Due to the change Cusick was supposed to have a system in place to recover payments from old management company. yet Cusick failed to do so ****- Cusick employee ****** after I spoke with about the payment ...said, show me proof of payment and i will out a hold on it with no penalties till payment is located which I did 7-Payment for that particular month eventually was returned to me and I submitted again to Cusick. to find that ****** did not honor his word and applied late fees on my account. 8- Contacted ****** who in a sarcastic tone said yea I stopped late fees but system but it on again ...I told him you said something and did opposite plus you run the system. but no answer from him just the run around 9-I would like to mention here that Cusick employee ******************* realized I have submitted the lease more than once and I have proof, so she changed the subject of the hearing from non-Comply with Bylaws to a hearing for a late fee?!!! showing without a Dout her malicious intention to harass me.

    Unfortunately, we as the management company representing his ***** of ********* have simply done our jobs here. There was a mistake, if you want to call it that, where he sent ** a copy of  his lease, but it wouldnt open.  We figured it out and it was corrected, and we apologized. The rest of his issues are unfortunately out of our control.  **************** chose not to update his dues payments like the rest of his neighbors did and we waived what late fees were within our ability to waive as per the *****s instructions. We relayed his request to waive more late fees to his board and they declined, citing personal responsibility to do what the other almost 320 residents did to update their payments.

    **************** requested a hearing with the board and they agreed, so his previous hearing for the lease (which was no longer needed) was changed to a hearing to discuss his late fees again, at his request. We apologized for the one mistake we made and have made every effort within our ability/authority to help this HO and ***** his requests.

    Unless Cusick can explain why Cusick would advise the Board to pay the $27,877.36 to the ****************** in 2022 when that relationship was to be dissolved on 10-31-2021, according to the documents filed with the Register of Deeds book ***** page *******. Cusick's fiduciary obligation and duty is to the *********************** Homeowners Association.Cusick has been placed on notice of the issue; resulting in an opportunity for Cusick to review the matter raised regarding the ****************** dues and the dissolution of that partnership. Cusick's response below is acknowledgement of the issue raised regarding the ******************, failing to respond to the issue raised would be in breach of Cusick's fiduciary obligation to the *********************** ************************ Once again, Cusick should in good faith review this matter again.
