    I initially took out a short-term loan with Bright Lending in June 2023. I have taken out a total of four loans with this company. I've paid off the previous three and they have made it impossible to get out of this cycle. In total, I have received $2,200 across four loans. I have already paid OVER $5,000 to this company and they are still saying that I owe over $1,100. There is no way to escape this, which is just what companies like this want. The APR is well above the maximum allowed in the state of ******** and they are not a licensed lender. I have paid MORE THAN DOUBLE of my original loan amounts and I cannot continue paying this ridiculous rate. That is more than enough and I request that this be settled immediately. Please beware of this predatory lender!!!

    First, we respectfully note that Colorado law does not apply to Bright Lending.  Bright Lending is a wholly owned and operated entity of the ******************* **************** (Tribe) on the ******************************* of *******. Bright Lending was established for the Tribes economic benefit and is organized and licensed under and operates pursuant to Tribal law.  Both our website and our consumer loan agreement explicitly describe the sovereign status of Bright Lending and clearly require the application of Tribal law to any business dealings with Bright Lending.

    Second, we would like to take this opportunity to provide you with some background information on our company, its business practices, and our actions in response to our customer.  ********************** is committed to complying with the principles of federal consumer protection laws and regulations, as well as the laws of the Fort ******* ****************.  The APR is disclosed on the Bright Lending website and is prominently displayed in loan documents that are reviewed and signed by the customer.

    Third, we would also like to address the complainants assertion that Bright Lending is predatory, which is unfounded.  Bright Lending informs our customers that this is an expensive form of borrowing, and we even encourage our customers to prepay (with no penalty) to reduce the overall cost of borrowing.  We go further and inform our customers that our product is not meant as a long-term financial solution.  We also allow our customers to cancel their payment obligations under their Loan Agreement (at no cost), no later than 3:00 p.m. Mountain time of the next business day immediately following the Disbursement Date.

    We certainly understand that everyone faces financial difficulties from time-to-time, but the loan agreement signed by ******* **** is legally binding. Thus, we have every right to expect payment as scheduled in the agreement.  To date, ******* **** has only made a partial repayment towards the total outstanding loan balance. 

    We will communicate with ******* **** directly in an effort to resolve their concerns.  Correspondingly, ******* ****, at their convenience,may call our customer service line, and they will be directed to a representative who can assist them with any additional questions.

    I am rejecting this response because: As stated in my original complaint, I have received a total of $2,200 across four loans from Bright Lending and have already paid back exactly $5,030.58 to date. I've paid these loans plus exactly $2,830.58 in interest! If I were to make another payment of $623.12 as requested, I would have paid $3,453.70 in interest alone. I have already paid all of these loans back in full TWICE plus another $400+ on top of that. I am requesting that my account be considered paid and closed.

    I have used this company a few times in the past and comes to find out after speaking with my uncle who is Lawyer that works for a nationwide firm. He told me that it is illegal for tribal loans to offer there service in **. I needed to buy my mother's medication and this company preys on the vulnerable. My uncles firm is in the process of filling a class action lawsuit against tribal loan companies that prey on clients in states where tribal high interest loans are illegal. Blue mountain loans is not listed in the suit yet unless I want to sue and to be a part of it, I'd rather just get the high immoral interest I paid back to me. I need the money back for my mother's medication. I hope we can come to a compromise.

    I have tried contacting them with no answer i left a message on September 19th and haven't heard back. and I have literally used multiple tribal loans this past year and after talking to a family member recently that is a lawyer, he explained to me that these tribal loans are illegal in ************* and his law firm is getting a class action lawsuit against a couple of them that  gave out illegal high interest loans in states where there is a usury cap. . He explained that these high interest rates are against the law in multiple states. These tribal loans or should I say rent a tribe loans(most are rent a tribe where

    I received a loan for $1,000 on 3/6/24 and have been making monthly payments of $383.49. I have paid $1,917.45 and still have a balance of $1,449.88 as of today, with additional interest accruing daily. The principal is not going anywhere and I cant continue in this cycle! Its ridiculous that borrowing $1,000 is going to cost me a total of $3,835.83 total to payoff! This is highway robbery at best and CANT BE LEGAL!!! A perfect example of shady practices of predatory lending!!!

    I received an email that I had applied for a loan. I did NOT apply for a loan and within 3 hours of receiving this email I contacted the company to let them know that my identity was stolen. They refused to stop funding the loan of $950.00 to *********************, N.A. to account ending in 0924. I explained to them that this was NOT my bank and I DID NOT authorize this loan. They did not care and told me that I would need to fax a *** report in order for them to take any action on funding the loan. I asked them what happens if the hacker quickly removed the funds and they told me that they would send my account to their collections department.

    We would also like to address the concerns expressed by the complainant related to the funding of their loan.  Bright Lending received a loan application in ******* Bierworths name and subsequently completed underwriting.  A fully signed loan agreement in the amount of $950.00 purportedly executed by ******* *********, including ACH authorization, was received on September 18, 2024.  On September 19, 2024, the complainant contacted Bright Lending and claimed identify theft.  Upon receipt of documentation to support the claim, Bright Lending rescinded the loan.

    I got a loan from bright lending for the amount of $450.00 on 12/18/2023. It's is biweekly payment of $114 for the loan due to the insane apr the amount I owed them back was ********. As of 8/9/2024 the website states I still owe $374. This amount has not changed in the past 4 months. The loan I took was originally for a emergency expense due to a car accident. Had I known the businesses background I wouldn't have taken the loan.

    I received a loan for $1250.00 on 4/29 and have been making bi-weekly payments of $253.41. I have paid over $1267 and now have a balance of $1276.74. I understand the high interest rate - but $0 is going to principal amount and there is no option to pay ahead reduce interest amount. This is a complete violation of credit rights. Since the payments are bi-weekly, it only gives you a few days to pay the full amount before the balance increases again. They are taking advantage of people in desperate times. I just want to pay off the loan and not lose my home.

    Bright Lending is in receipt of the above-referenced complaint filed with the BBB.  We take all comments, good or bad, very seriously.  The following is our response to the items noted.  

    First, we would like to take this opportunity to provide you with some background information on our company, its business practices, and our actions in response to our customer.  ********************** is committed to complying with the principles of federal consumer protection laws and regulations, as well as the laws of the ******************* Indian Community.  Bright Lending discloses the total cost to a borrower if only the minimum payment schedule is followed, and we inform our customers that this is an expensive form of borrowing.  The APR is disclosed on the Bright Lending website and is prominently displayed in loan documents that are reviewed and signed by the customer.

    Second, we would also like to address the complainants assertion that there is no option to prepay.  Bright Lending encourages our customers to prepay (with no penalty) to reduce the overall cost of borrowing.  We go further and inform our customers that our product is not meant as a long-term financial solution.  We also allow our customers to cancel their payment obligations under their Loan Agreement (at no cost), no later than 3:00 p.m. Mountain time of the next business day immediately following the Disbursement Date.

    We certainly understand that everyone faces financial difficulties from time-to-time, but the loan agreement signed by ************************* is legally binding.  Thus, we have every right to expect payment as scheduled in the agreement.  To date, ************************* has only made a partial repayment towards the total outstanding loan balance.  

    We will communicate with ************************* directly in an effort to resolve their concerns.  Correspondingly, *************************, at their convenience, may call our customer service line, and they will be directed to a representative who can assist them with any additional questions.

    As noted above, Bright Lending is subject to robust consumer protection requirements.  We want to treat our customers well and ensure that they are pleased with our product.  Thank you for the opportunity to respond.
