Bright Lending issued me a $700 loan with an APR of nearly 700%, which is illegal under the Illinois Predatory Loan Prevention Act that caps rates at 36%. Ive paid them $344.46 toward this void loan. That payment should never have been required in the first place. They are not licensed to lend in ******** and are attempting to sidestep the law by claiming tribal jurisdiction. State law is clear: this kind of lending is unenforceable and void. Bright Lending is ignoring that and trying to collect the remaining principal anyway, acting like waiving interest is a favor.Their conduct is deceptive, abusive, and violates both state and federal protections. Theyve refused to refund what I paid and continue to frame this debt as legitimate. Im demanding a full refund of $344.46 and a written statement confirming the loan is void, closed, and uncollectible. This complaint is also filed with the ************************* and ****. Further delay or gaslighting will only escalate the matter.Business Response

Dear Better Business Bureau:
Bright Lending is in receipt of the above-referenced complaint filed with the BBB. We take all comments, good or bad, very seriously. The following is our response to the items noted.
First, we would like to take this opportunity to provide you with some background information on our company, its business practices, and our actions in response to our customer. ********************** is committed to complying with the principles of federal consumer protection laws and regulations, as well as the laws of the ******************* Indian Community. Bright Lending discloses the total cost to a borrower if only the minimum payment schedule is followed, and we inform our customers that this is an expensive form of borrowing. The APR is disclosed on the Bright Lending website and is prominently displayed in loan documents that are reviewed and signed by the customer.
Second, we respectfully note that Illinois law does not apply to Bright Lending. Bright Lending is a wholly owned and operated entity of the ************************************ (Tribe) on the ******************************* of ******** Bright Lending was established for the Tribes economic benefit and is organized and licensed under and operates pursuant to Tribal law. Both our website and our consumer loan agreement explicitly describe the sovereign status of Bright Lending and clearly require the application of Tribal law to any business dealings with Bright Lending.
**** Kelleys complaint is effectively asking Bright Lending to forgive a substantial portion of the principal balance of their loan. Bright Lending is simply looking to be made whole by recovering the exact amount of money loaned to the complainant, without any interest or fees. The complainant's position disregards the fundamental legal principle that loaned funds must be repaid, irrespective of subsequent disputes about interest or of the borrowers personal views concerning enforceability.
We certainly understand that everyone faces financial difficulties from time-to-time, but the loan agreement signed by **** ****** is legally binding. I am writing to formally express my concerns regarding the deceptive lending practices I have experienced with Bright lending . While I acknowledge my responsibility to repay debts, I expect the terms to be fair, legal, and transparent. Unfortunately, that has not been the case with this loan(s).While I was made aware of the high interest rate, I was never informed that nearly all interest would be front-loadedresulting in monthly payments where up to 95% is applied to interest rather than principal. For example, my most recent payment of $604.58 contributed only a few dollars to the actual balance which in a short amount of time has increased exponentially. This structure was not clearly disclosed during the loan process.Despite having made consistent effortsincluding taking out additional loansI noticed that the loan balance remained much higher and virtually unchanged. After paying over $1872.57 on $2,200 received, I still owe an insane amount. This is not only financially crippling, but unethical.Upon further research, I also discovered that it is illegal to issue such loans to residents of ********, and that class action lawsuits are currently pending against similar practices. I have contacted the customer service team, but no viable solutions have been offered.I am currently facing multiple personal hardships, including uncontrolled diabetes, ongoing cancer treatment, and the aftermath of recent home flooding. These circumstances make it increasingly difficult to manage this unjust debtespecially considering that Bright lending has already received all principal borrowed except ****** which I have no qualms to pay as it is legitimately owed. I am a 67-year-old senior affected by excessive loan interest, which has harmed my financial stability. Predatory lending leaves many seniors unable to afford basic needs. In ********, the Predatory Loan Prevention Act (PLPA) exists to protect against such practices.Business Response

I took out a loan with bright lending in the amount of $1000 on 5/15/2025 due to hard times. I have made 6 payments of $137.81 totaling in $826.86. I went to check how much I had left because I knew I was getting close to the $1000. They are saying I will be paying back $5922.09. That interest rate seems insanely high and majorly predatory. I fully intend to pay back what I borrowed but I cant afford thousands of dollars in interest like that in hard times. Especially when it was not made clear that the interest was going to be that high and is not easily stated.Business Response

After discussing with the **** CPBC, Attorney General, and several Lawyer groups I was informed that the 700% interest rate on the loan I have just taken out with Bright Lending was a predatory loan that took advantage of my financial situation and rely on tribal laws where they live to make this possible while my New Jersey state would never allow such rates.I have been in a very difficult situation and did not realize just how bad of interest rate I signed up for. I attached the loan document showing that I will roughly pay $5,800 for $1,000 of principle if I were to take this loan to completion with the 700 percent rate. I attached a screenshot showing that somehow my first payment made to this company was less than $2 of principle and more than $265 of interest! That is a loan shark or possibly worse type behavior. I am now trapped in this loan and need to get out of this immediately I wont be able to keep this payment schedule up it will cripple me financially even more than I currently ********* group that reached out to me informed me I should work with them and should not be reaching out to this company looking for their assistance but Im trying here anyways. 700% interest is. Beyond predatory and I also attached a screenshot showing that if you cant make this companys biweekly payment within 5 days after it is due they add 10 percent and 30$ on top which makes this even worse.I just want my account closed as paid in full with them now and never do business with them again. There is already a pending payment on my end of $271 that is more than 1/4 of the principle. If I can just get this loan closed and this company can deem my account paid in full and close business with me or I will have to take legal action and steps through my attorney general as prescribed.Business Response

*Note: Bright Lending ("Bright") updated their website overnight for my loan with completely different information than what was posted yesterday, June 2, 2025, the day I disputed this debt and revoked ACH, Debit Withdrawals and Remote Checks.* I took out an $1,150 loan on 03/05/24 (No. **********) that was later converted to a new loan in the amount of $1,000 on 09/30/24 (No. **********) after I fell into financial hardship and was forced to enter into a new loan by Bright in order to remain in "good standing". No additional funds were provided to me under Loan No. **********, simply a reduction in the overall outstanding loan amount. To-date, I have paid over $1,932.04 to Bright which is approx. 43% over-and-above the original loan amount. I revoked ACH payment authorization on April 28, 2025, yet Bright continued to debit my checking account $113.02 on 04/30/25, 05/15/25 and 06/01/25. I stopped payment on the 06/01/25 payment and advised Bright via e-mail & formal letter on 06/02/25 that they have continued to take funds from me without permission and authorization. I further advised them that they are not licensed to do business in the State of CA and are charging me a ********% APR and ********% Finance Charge on this loan which is far beyond California's state cap for loans under $2,500 which is set between 12% and 30%. I requested that the account be closed and marked Paid in Full, however Bright responded to me via e-mail on 06/03/25 advising that they are a tribal lending and therefore exempt from State Laws. Bright Lending is a predatory and unethical lender who has forced me into loan flipping - both of which are illegal. I intend to file additional complaints with the **** and CAAG if Bright fails to close this account and cease further collection actions. I have paid above and beyond the original loan amount in good faith and they are trying to take advantage of me. I will not lose my home over these deceptive and usurious business practices.Business Response

Complaint: 23414684I am vehemently rejecting this response. Bright Lending's three (3) points of response to this Complaint are laughable. In their first paragraph, they indicate that they are committed to complying with the principles of federal consumer protection laws and regulations and in their second paragraph they claim that my assertion regarding usurious and predatory business practices are "unfounded", yet they were sued by the Minnesota ************************* back in October 2023 for conducting predatory lending and collection illegal interest. See attachments.
In the third paragraph of their response, they assert I have only made a partial repayment towards the total outstanding loan balance. To-date I have paid over $1,932.04 on a $1,150.00 loan. As stated in my complaint, this is 43% over and above the original loan amount.
Bright Lending hides behind federal regulations and consumer protection laws in states they have not been sued in. I plan to ensure the ****************************************** is made aware of their actions and my complaint.
I do not accept Bright Lending's response to this complaint and I will not engage with them outside of this portal. The loan has been paid in full. I sent a letter to them via E-mail and Certified Mail/Return Receipt Requested on June 2, 2025 (copy also attached) which was returned to me as "Return to Sender/Insufficient Address/Unable to Forward/Return to Sender" by the **** even though the letter was mailed to the address with the BBB, their address on all correspondence and stated on their web portal.
Bright Lending needs to cease and desist their predatory lending practices. I have fulfilled my obligation to them. I again request that my account be marked Paid in Full and closed. No further funds are due and no further funds may be taken from my accounts. All Collection efforts should cease.
Sincerely,
***** ******Initial Complaint
