      my complaint is rust consulting, *** is ********* and refuse to pay me the settle amount from the class action ***** v. ****************, 17 Civ. **** (S.D.N.Y. Dec. 1, 2022) in the amount of ***** they claim they sent out two checks s***e sep, 12 2023 i have not received any checks in the mail after the first check was lost i spoke with call service to get one reissue and to see if the problem can be remedy. have the mail sent certified or some type of secure way of mail to which i offered to pay for the mail i was denied and told to wait 4-6 weeks the second check was supposed to arrive the day b4 thanksgiving nothing came i know because i called in which they told me to wait 4-6 weeks i check with the mailman and postmaster no mail was sent i call some more to get another check reissued it's now february i was looking forward to that money now i don't even know if i'm getting paid when i call the call center i get an attitude and when i call the main office i get referred back to the call center after today i have to put in a claim with smalls claims i need 24 hours to get a response

Rust is a neutral third-party administrator specializing in the administration of class action settlements and similar programs involving notification, contact centers,claims processing, and fund distribution. Under the supervision of our clients as well as the relevant courts, we have administered over ***** cases and distributed over $20 billion in settlement funds throughout our 45 years in the legal administration industry. **** was engaged to carry out certain administrative aspects of this settlement as established by the parties and to answer class members questions.

      Rust mailed the complainants original settlement check on September 22, 2023, to the address he indicated on his claim form. When he called to inform us that he did not receive the check, we voided it and mailed a reissue on November 15, 2023, to the same address, as the complainant had not provided any updates to his address on file.

      He called again to inform us that he did not receive the reissued check, and on that call, provided Rust with a new mailing address to use. The reissued check has been voided; it will be reissued again and mailed to his updated address with the next batch of check reissues, expected to mail in late February or early March.

      Rust issues payments in batches -- ranging from thousands to millions -- to facilitate efficiency. This necessitates delays which we understand class members may find unacceptable. However, we cannot individually handle or expedite mailings without delaying and risking errors to overall administration.

      Rust Consulting, *** sent me a settlement check for the ***** vs ******* Settlement, and I received the check after the check void date, because the check was sent to my old address. The statement included, advised me to reach out to the number ************ and when I reached out, I was advised that Rust Consulting ***. will not reissue the check because the funds were sent to ** ************** (A ************************ I am appalled that Rust Consulting *** .would give away funds that were owed to me, without even attempting to have the check delivered to the correct address.

      Rust is in receipt of complaint #********, which relates to the settlement of ***** v.Verizon, No. 18-cv-5270 (*****************.). Rust is a neutral third-party administrator specializing in the administration of class action settlements and similar programs involving notification, contact centers, claims processing, and fund distribution. Under the supervision of our clients as well as the relevant courts, we have administered over ***** cases and distributed over $20 billion in settlement funds throughout our 45 years in the legal administration industry. **** was engaged to carry out certain administrative aspects of this settlement as established by the parties and to answer class members questions.

      Rust made multiple attempts to have the complainants check delivered to the correct address. We mailed the initial check on February 13, 2023, to the address provided to us by defense counsel in this matter. The complainant called Rust on February 24 to provide an updated address, and requested on March 2 that her check be reissued to that address. The reissued check was mailed on March 15 to the updated address that the complainant provided; we have reviewed our call logs and confirmed that the check was correctly mailed to the address (on **********, in ******, *****) that was indicated on the call. The reissued check was not returned to Rust as undeliverable.

      We did not hear from the complainant again until January 3, ****, by which time uncashed settlement funds (per the terms of the settlement agreement) had been transferred to the court-approved cy presrecipient, the ************ **************** Rust is bound to adhere to the terms of the settlements we administer and the instructions that we receive from the parties in those settlements for distributing payments, including the disposition of uncashed settlement funds.

       I am rejecting this response because: I did not receive the check to my **** ******* address. The check arrived at ******************* in late 2023, regardless of when it was sent. I had numerous issues receiving mail from ** to ** and I advised them of that. Rust Consulting refused to reissue the check when I contacted them. Rust Consulting LLC unlawfully turned the funds over to a nonprofit organization ( ** **************** All unclaimed funds in ************ are to be sent to the ** ********** of ********* not an organization of their choice.

      **** is in receipt of the follow up to complaint #********.**** mailed the complainant's requested check reissue on March 15 to the address that she provided. She was told to allow 4-6 weeks for the reissue to arrive. We did not hear from her again within that time frame, nor was the reissued check returned to Rust as undeliverable. The void date for the reissued checks was May 14, and all uncashed funds were transferred to the cy pres recipient on June 16, as stipulated in the parties' settlement agreement and approved by the court (not as a matter of choice by ****). Rust has adhered to the terms of the settlement agreement in this matter, as we are bound to do.We are no longer in control of the settlement funds and are unable to reissue payments.

      Hello my name is ******************************* I am complaining about a check that I attempted to cash at US Bank for the ****** V OTO DEVOLPEMENT SETTLEMENT - CONTROL NUMBER ********** - CHECK DATED 10/05/2023 - CHECK # *****. The check is made payable to "*******************************" When I attempted to cash it at US BANK and also a CURRENCY EXCHANGE no specific reason was provided as to why it would not accept it. The amount of the check is $929.78. I was indeed apart of this settlement. I was hoping to having the check replaced **** or expressed delivered to me if possible.

      I received an email from the federal trade commission about the settlement in regards to federal trade commission vs ********************* in September 2023. Basically email stated I was receiving an update on settlement since I was sent a check. Says on website average check for $337, and individuals were sent two checks. And phone number to call. Called several times with long wait. Finally got through and was told to email them since both checks were sent to wrong address. Still havent heard anything back. Also when I asked customer service how much the check was for she said $90. And backtracked and said technically the same check was reissued to the same wrong address even though it was sent back. Seems like too many issues with this company

      Class members were paid proportionally based on what they paid the defendants; the $300 figure cited is an average, with some receiving more and others less. *** complainants initial check mailed in March of 2021 to the address Rust had on file. It was returned as undeliverable, but because **** was not able to obtain an updated address via trace (standard industry procedure in settlements like this), an attempt was made to remail the check to the same address in February of 2022. *** remailed check was never cashed and was not returned as undeliverable.

      *** complainant first contacted Rust about the payment in September of 2023. As directed by the parties, **** is currently in the process of a second distribution of the settlement funds to class members who cashed their initial checks. We confirm receipt of the complainants reissue request; we are in contact directly with her and will follow up with her regarding the possibility of issuing a payment based on the funds that remain (if any) after the second distribution is complete.

      This is the actual complaint some how there was a mistake and my complaint to BBB was submitted improperly.The RUST CONSULTING in relation to GREENSKY is at c/o Rust Consulting *** PO Box **** ********* ** 55021-9603 and this too could be a bogus address since this is a different address then what you have listed and I did not see any way to correct it.So on July 5th 2023 I received a letter from Rust Consulting *** stating they had determined I was eligible for redress and compensation based on their investigation in relation to GREENSKY/HUMAN TOUCH from 2017. However Rust Consulting must have forgot to make out a refund check that I am entitled to based on their own written words. I expect to be sent a refund for the total amount which is $13,000 based on the improper acts by HUMAN TOUCH and ********. I will recontact ************************************** of the principal investigators who contacted me when the investigation began 4 years ago if this does not get corrected as it should be. I expect Rust Consulting *** to honor their own letter and send out a the refund and not try to keep the funds that belong to me that were improperly paid to HUMAN TOUCH and GREENSKY.Thank you

      Rust Consulting is in receipt of complaint #******* regarding a settlement reached between the ************************************ and GreenSky LLC. Rust specializes in the administration of class action settlements and similar programs involving notification, contact centers,claims processing, and fund distribution. Rust is a neutral third-party administrator and was engaged to carry out certain administrative aspects of the settlement and to answer questions.

      Rust is one of two administrators engaged by the **** for this project. *************** was responsible for determining class memberseligibility for the different forms of relief available under the settlement. **** is responsible for providing class member support as well as mailing outreach and redress notification letters and checks to those determined to be eligible for payments.

      On March 31, 2023, we mailed the complainant a letter indicating that, based on review of the facts and circumstances, they were determined to be eligible for credit redress. This means that their GreenSky loan associated with the merchant, Human Touch, is being canceled and the relevant tradeline is being deleted from their consumer credit report. Contrary to the complaint, the letter did not say the claimant was due a check, and Rust did not forget to include a check.

      We have no information about the complainants eligibility or ineligibility for any other form of relief, but the administrator who made their determination can be contacted directly at **********************************************************.

      We would also clarify that Rust handles hundreds of projects simultaneously and we establish a different PO Box for each individual project to receive incoming mail for that project. We also maintain multiple physical office locations.

       I am rejecting this response because:

      They have no right to keep a valid chargeback I am owed based on the written acknowledgement

      that compensation is owed to me by the Greensky Administrator.. Rust Consulting ****

      has been subject to several consumer complaints, The company has been accused of poor communication, delayed payments, and
      unprofessional behavior and rude customer service. I consider the response here to my complaint extremely rude especially about

      the forgotten check to be sent as the Greensky Admin sight states that checks were mailed out March 31 2023 and Rusts response here says

      they sent out a "Notice on March 31 2023". Well I never got that because there is a new mailing address and this means that the check

      was returned and I know I have a payment due based on the contents on that letter. So this matter is now a taxable event for Rust Consulting

      and will be reported to the *** and the Federal Reserve.

Please note the correct spelling of the administrators email address: [email protected] is a typo in the email address that the complainant indicated was unsuccessful. We have sent multiple test emails to this address and confirmed receipt.

      We would emphasize that Rust is not keeping any money otherwise due to this complainant. The checks that the website refers to were mailed to class members who were eligible for that form of relief, and the complainant per the administrators determination is not one of them. No check in the complainants name was returned to Rust; no such check was issued in the first place. The notice they received explained the form of relief (credit redress) for which they are eligible. If the complainant wishes to contest this determination, they will need to contact the administrator at the email address provided above and provide a written explanation along with documentation to support their position.

      I submitted for claim payment on class action. **** was hired by Defendant/Plaintiff/Court to handle a portion of claim payments. They ha*e deliberately and intentionally mishandled the claim and demand more paperwork when they ha*e all the paperwork they need to payout. **** slow walks and it takes 6 months for a response by them each time. Rust specializes in the administration of class action settlements and similar programs involving notification, contact centers,claims processing, and fund distribution. Rust is a neutral third-party administrator and was engaged to carry out certain administrative aspects of the settlement as established by the parties and to answer questions.

      There are multiple issues with this claim. 1) The dates on the documentation suggest that the repair was not completed by the effective date of June 30, 2021, as required. 2) The settlement only provides reimbursement for an engine that failed due to a failure of the timing chain or oil pump drive chain modules. There is no cause for engine failure indicated in the complainants documentation.

      The initial claim was adjudicated as deficient and Rust gave the complainant two opportunities to provide additional information. The additional documents still did not provide enough information to process the claim. **** mailed the complainant a denial letter on 05/10/2023 which explains her right to file an appeal to have her claim reviewed again by Counsel for both plaintiff and defense. If they disagree, a special master may make a final determination.

      The settlement requires that Rust review claims and then send them to *** for a final review. In a complex case like this with a large class and review required by multiple parties, it can take some time before we are able to respond to claimants. The processing times described in the complaint are standard for this type of settlement. We have not received any email correspondence from the complainant.

      The complainant should follow the court-approved appeal process described in her denial letter if she believes her claim has been denied in error or if she has additional information to provide.

      The complainants request to reissue the check from a Qualified to a Non-Qualified account required additional review by the Tax Administrator for the settlement in order to properly report the reissued payment to the **** which extended the time required to fulfill the request.Her payment is currently scheduled to mail by the end of this month.       I am waiting to receive a check for a settlement with ***** Fargo from Rust. I have been waiting since December 2022, I keep getting told they have mailed the check to the wrong address, or it must have been lost in the mail. Each time I am being asked to wait 6 to 8 weeks for a reissue and they refuse to send it Trackable mail. All I am looking for is my check to be sent to me so I can forget I ever knew the name of this consulting company.

      For efficiency, checks are reissued in batches, in this case approximately every 4-6 weeks. The complainants requested check will be included in the next batch of reissues, which we expect to mail on March 23.
