    My name is ********************************, age 71 years old. I reside at ***** ********* ***** in Fort Washington, Maryland *****.  On April 28, 2022, I signed a contract with Malloy Property Solution located at *** ******** ***** **** in the National Harbor, Maryland 20745 and M.H.I.C. Licensed ******. Their telephone contact number is ###-###-####, ###-###-####, and ###-###-####.

    The contract was signed on April 28, 2022 which I thought meant they would be doing the work soon.   My insurance company ******** Insurance gave me a check for six thousand and one hundred and twenty eight dollars and sixty six cents ($6,128.66) on May 26, 2022,   I endorsed the insurance check to Malloy Property Solution, and the deductible of one thousand dollars ($1,000.00) went through DaMika M***** ***** bank account.  

    I was excited thinking my new roof would be on soon after I picked out the shingles and company received the money  I wondered what could be a hold up from April 28, 2022 until June 1, 2022 and sill no roof.  

    I forgot about them until June 1, 2022, my neighbor called to ask what was taking so long with the roof.  I text both the owner David M*****, and his sister DaMika M***** that I would like a refund and didn’t feel comfortable with the company.  Ms. M***** text that that her brother would call me. He never emailed or texted or called. It went simply ignored.

    I received messages from Ms. M***** something to do with the insurance which, I didn’t understand. Finally on the 9th of July 2022, two wet spots appeared on my ceiling in the master bedroom. I had it with the company I felt used and taken advantage of as senior citizen and single woman. I text the Malloy’s and the ********* Insurance Adjuster I wanted my money so I could go with another company.  David M***** immediately text back stating he was an adjuster and I was entitled to two thousand odd dollars and Monday July 11, 2022 a certified check would be in mailbox due to me breaking the contract. I called Mr. M***** and he refused to answer.
    I didn’t know what to do after that text. I felt robbed by this company and the insurance company told me I never should have released any money to them without the work being completed.  Also, the insurance company asked if they had done any work on the roof. I immediately said no and the response was something just doesn’t sound right. 

    I talked to the ********* Insurance supervisor who told me immediately file a complaint with the DLLR against the company after I told her David M***** was supposed to be a contractor. But, he said adjuster something I was never told. Also, the contract didn’t say if April 28, 2022 was a start date or if it could just drag on forever.

    After ********* Insurance contacted David M***** I received a message he could push my roof up to get it done and if I didn’t want the insurance to pay for it I could pay.

    Malloy Property Solution sign was placed on my property without authorization and no work was ever started on my roof. That’s a prime example how I feel taken advantage or is it a demonstration of power over or scare tactic.  I’ve asked three times for all funds be returned so I can pay a contractor to do my roof. Since July 9, 2022, I now have three spots in my ceiling which will cost me additional funds.  I am living on a fixed income and barely getting by. David M***** is strewed, and a very harsh young man who took advantage of my lack of knowledge, age, and the situation to benefit himself.  He created a very stressful situations and hardship because I had to loan to replace the funds I paid him for roof work he never did.  

    David M***** is a licensed contractor/salesperson and licensed adjuster in the State of Maryland.
    By law, in reading his contract isn’t binding since the rescission clause is incorrect. The contract states I only have 3 days to cancel or rescind the contract, but legally I have 5 days to cancel and up to 7 days if one is over the age of 75. Due to this incorrect information on their contract, the contract is void and not lawful, and I should be under no penalty for cancellation, also, there is no start or end on his contract.

    I am asking you to hold him accountable for threatening me with breaking a contractor, refusing to return my money, misleading and taking advantage of a senior citizen and female and return all monies to ****** ** ******** in cashier check. Also, hold him responsible to pay out of pocket if wood replacement is needed and painting cost of my master bedroom.

    On April 28, 2022, I signed a contract with Malloy Property Solutions to install a new roof. My mistake is trusting the work would be done in a timely fashion so I paid $7,128.77 up front. On July 1st, I requested my money. Again, on July 11th, I requested my money after two wet spot appeared on master bedroom ceiling. D**** Malloy emailed me stating I broke contract and would receive $2,000.00 on the 11th of July. Malloy told me he was my adjuster. The DLLR Commissioner informed me he received his adjusters license in June 2022. The contract was signed April 28, 2022. Please don't sign anything on a cell. Make sure there is start and end date on contract. Check to see if he has your age on contract to make sure you can cancel legally. Have DLLR review his contract or an attorney. Do not trust him. I welcome his comments.
