TimePayment is a predatory loan company that markets and sells "lease-to-own" equipment programs and financing. What we were sold is a lease-to-own program that has tax benefits for our business and at the end of the lease term, we would own our equipment outright. However, after signing the contract and not reading it closely enough, what they sold us was not true. As stated in their contract, "...at the end of the Base Term You have the following options: (a) You can promptly return the Equipment in good condition, except for ordinary wear and tear, to TPC or to the person and place TPC designates in writing, or (b) You can purchase the Equipment for the Fair Market Value as quoted by TPC at that time plus any applicable taxes..." We were made aware of TimePayment through Zen Pro Audio, but after being told they do not work with that company anymore, we financed our equipment through ******************* After setting up autopay with them, they have charged us an extra $864.59 that was unauthorized. There are no notices sent via email or mail as to when payments are made, when they will be made, or if the payments have changed for any reason. When I disputed the transactions with them, they claimed that there was late charges added on because our card was declined. The transactions made by TimePayment on our bank account were clearly not. They have also hacked into one of my other credit cards via Upgrade and are trying to make purchases on that also. I believe that all of their horrible predatory tactics to get more money are aided by their contract; "If the Total Monthly Payment is made under the 'auto debit' payment option, You understand that the amount debited from Your account *** also vary". Please do not get involved with QuickSpark or TimePayment and make sure to read their contracts very carefully before doing business with them - but it is best that you NEVER do business with them. They have all of the telltale signs of credit card scammers and frauds.

      Dear TimePayment Corp.,

Your letter hasn't explained anything except for repeating what I have already read in the lease agreement. Like I said before, I was sold this as a "lease-to-own" equipment leasing program. It is clearly not. Your salesperson was clearly relying on the fact that people don't usually read every single fine line of legal jargon written in agreements and terms. She sold it to be as something different and told me to sign, in hopes that I wouldn't read the agreement that carefully.

About the unauthorized payments, our card was not declined. I did provide a card that was set to auto-pay for our TimePayment account with a representative on the phone. They told me numerous times that this was settled and that card would be charged appropriately. However, when I saw the unauthorized payment that greatly exceeded my normal monthly payment (almost three times more than the base payment), as agreed to in the lease agreement, the representative told me two or three different stories as to why this happened. First, they said that my card was declined and the extra $700 or so dollars was a "late fee". This was false because as anyone knows, you can go to your bank account, view the transaction history, and see if payments went through or have been declined. The payment was not declined. I sent them photographic screenshot evidence of this in my actual business bank account to show them. After I told them this, they replied with another story. The second story was that they were charging for two months at a time, which also was false. Two months of payments in one would have been a little over $600. After I denied that this story could not be the case, they went back to their first story.

TimePayment said in their latest response that "TPC made multiple attempts to reach you to resolve this matter." I did receive one phone call which I returned. I called their business about 3 or 4 different times and talked to different representatives on the phone each time. I also had email threads going with various representatives of the company about this. Every time I called or got an email response, I received a different answer to my complaint, none of which were true or valid. They seem like they clearly have tactics of stonewalling, gaslighting, belligerence, and denial that make it an entirely frustrating experience to be in contact with them. After I have explained my situation in as many possible ways as I can so that they understand, they completely deny my story, even though I have evidence of everything I have explained and I have provided that to them in multiple ways: verbally, in writing, and in screenshots.

It seems like it is impossible to get in touch with higher management at the company and receive any response from them that actually resolves this issue. Even in the latest response made to the BBB, they didn't actually address any of the issues I stated other than copying and pasting the lease agreement and hoping that constitutes a response. They have not actually said why they have charged that high of late fees to a card transaction that was not declined, why their representatives all tell me different stories as to why that happened, what the standard late fee is and should be, what fees will be added to each monthly payment and how much that actually varies from month-to-month, or why they don't answer my emails in a timely manner, if at all. When I receive an actual response to these issues, I will list this complaint as resolved on Better Business Bureau. However, I need an actual response that clearly states their answers to my questions and sadly and frustratingly, I am doubtful that they will be willing to provide this kind of resolution.

Businesses and Customers should be civil, courteous and polite in their responses to complaints. It is important to remain professional and productive when participating in the BBB complaint process.

      Business Response

      Date: 02/20/2023

As stated in TimePayment's previous response, all fees are described in the Non-Cancelable Commercial Equipment Lease Agreement. TimePayment did not receive a "lease to own" lease agreement on this account, therefore it was not processed as such, and TimePayment specifically disclaims any verbal representations made by the broker or vendor in the lease agreement. If you believe there was a discrepancy, you should address this with your ******************** representative. Any further questions regarding payments should be discussed directly with our **************** Department.

Thank you again for not addressing any of the questions I had asked and specifically requested be addressed. That was sarcasm if you werent able to read my tone. I prefer to handle this on Better Business Bureau because the records are made public and there is a mediator present which will help keep your company accountable. I have already discussed this issue with multiple TimePayment representatives, as stated in my previous response, with no resolution or help. I am not going to waste anymore time trying to call TimePayment to talk with someone who is going to give me zero answers.

Please address the concerns I laid out very clearly in my previous response. Thank you!

I purchased a product that required me to get a lease due to it being over $10,000 in price. That was fine, I agreed to the terms first given to me by TimePayment. The terms were that I was to pay a bit over $3,000 down and $643 a month for 35 months. I received a call stating that my payment for $709 was past due, which was odd because all of the communication in the past was a smaller monthly amount. When asked why the monthly increased they said taxes and fees even though I was under the understanding that taxes and fees were paid up front with the down payment. On top of this, they gave me an additional notice 1 week before the payment was due that I needed insurance or else they would add an additional $130 a month to my payment. Again, something that was not communicated to me when I agreed to the lease. I find this absolutely unethical and would request to have this company looked into further, as it seems Im not the only one with this issue.

I purchased a MinuteMan towing equipment and they recommended I use TimePayment for financing. The total unit costed $15,000, I put a $6,000 down payment and financed $9,000 through timepayment. However they dont consider it financing its a lease in their eyes even though I own the equipment and the truck title, they say im leasing it? Sounds like theyre trying to avoid some legal aspect. Now the nitty gritty, Keep in mind I financed $9,000. My monthly payment was SUPPOSED to be $351/month for 45 months + tax and tax processing fee which is supposedly a *** of $3.00. Well so far ive made 12 payments to timepayment for $5,135. That means ive been paying an average of $427 per month. If you - the $3.00 processing fee that means $424.00 from $351. Im sorry, why am I being charged 24% for tax? There are some months I was charged even higher! January I was charged $468.00, please let me know how does sales tax vary each month? because it seems to me you guys are just pocketing money. I still owe $15,000 on the unit somehow after paying $5000 this year alone!!!! How does it go from $351/mo for 45 months to $427/mo average after your taxes, because sales tax in ************* is 6.5% and sales tax in my home ***************** is 6%. This is outright robbery and scamming at its finest. If the entire unit costed $15,000 and I put $6,000 and financed $9,000, with an average payment of $427 i Am paying time payment $19,215 by the end of my contract. + $6000 dp that means ive paid $25,000 for a $15,000 unit $10,000 I am paying them for interest and taxes when the ENTIRE AMOUNT I FINANCED WAS $9,000 My monthly payment should stay THE SAME!!!! NOT change every month as you guys please!! I dont even get sent any invoices to my email or home address, I try to log into the website and it just gives me a white screen.

In May of 2021 I signed for a loan for equipment. I have faithfully paid Timepayment and they have failed to report that I have paid them. I have proofs of payment and emails trying to reach out regarding my issue and I do not get any response from them. They have affected me financially in many way and do not want to send me the tax form I need to report all of the interest. They have failed to report over $15,000 in payment. In the statement I attached, you can see my balance with a -$8000 as if it is over paid but again not reporting to the state.

Time payment has been such an awful company. From telling me they didnt receive payments to taking my money without authorization. I would like to complain about them lying to customers who call their customer support. I called to make a payment and to take it off autopay so it wouldnt charge my card twice. I asked their employee if my account was on autopay and if it was I wanted it removed because I couldnt afford a payment 2 days later. He lied and told me my account wasnt on autopay so that means it was an unauthorized payment. All the calls are recorded so there is proof.

I came across this predatory lender in July. They put on a friendly face so that you will sign anything that they want. This company failed to disclose the fact that the contract that I was signing was locking me in without any way out. When I asked to cancel my order that was paid through Timepayment Corp they said that it wasnt possible. The contact was made before the 30 day **** and I was still told that I had to repay the money. I was also told that they would try to get the money back from ******************************** and if they couldnt then I would be responsible for the balance. The bikes original cost was $1508 if it isnt paid down in 12 months then the cost more than doubles. This has to stop. This so called finance company is predatory and needs dismantled.

I contacted the company to try and resolve this complaint just to be talked over, told that I am not able to get out of the situation, and felt really used. ******************************** will not give the money back to the finance company so that this is resolved. They quote me as stuck because I signed a contract that TimePayments resolving agent said he would cancel if American quality would just send the funds back. I dont know why this is so hard to do.

These "purchases" are connected to my husbands debit card. We live here in ** and are just personal trainers, this company is all the way in MA and looks like they lease and sell construction equipment... we have never authorized a purchase from them. * They have been taking anything from $139-$142 out of my account every month on the 12th or 13th since January of 2020. * They granted a temporary "refund" of these charges (totaling close to $3500) on Oct. 27 2022 and took it right back out last week * We have never signed a single thing authorizing this withdrawal

In April 2022 I purchased 2 sublimation machines, which were financed by TimePayment in ********** **. They have taken the liberty each and every time to tell me something different about the way they store customer credit cards. I have NEVER given TimePayment authorization to auto-deduct from my accounts nor will I. They store the information and take it upon themselves to charge when I've informed them I call in monthly with payment. Then they charged me NSF fees because the credit card was declined I only fund it when I am paying bills. I come to you for assistance in resolving this matter. Each month I call they tell me a credit will be issued but instead what they do is take my current payment and apply it to erroneous fees and report my account as not paying the agreed-upon amount. Making new fees roll over monthly. Reflecting as if I am short paying my obligations. I don't wish to be threatened with reporting negative information on my credit as I have paid this account accordingly and the fees are something they created for themselves and me as this is affecting me emotionally, and physically... I'm at my wit's end. They want to charge me to get a monthly statement and I believe they are charging me each time I call to make a payment. If a service is financed by law the vendor needs to mail a monthly statement and they are getting away with placing fees on my account because I am unaware of it until I pay the following month. This company is a scam as the equipment I purchased is only about 4k and they are charging me 5k worth of interest. This alone needs to be investigated as these companies are ripping folks off. I need assistance in solving this matter as I am getting nowhere with anyone I speak with.Do not charge me fees to take a credit card payment.Do not charge me for a monthly statement of $10 and refuse to provide me with one unless I pay.Clear all erroneous fees off the account. Update my credit files accordingly.
