I filed for bankruptcy, I submitted documentation to both ****** and TrueAccord however TrueAccord is still harrassing me constantly stating I have debt in collections with them through ****** even after I provided my bankruptcy case number, and court letter.Business Response

On December 18, 2024, subsequent to sending the email above, TrueAccord received notice that the consumer filed bankruptcy in August of 2024. According to court records the bankruptcy was closed in November of 2024.

True Accord is attempting to collect $456.15 but this is a fraud. I never signed up for A* * * *****s, nor did I receive any subscription. I will not pay for something I never authorized or used. A* * * *****se is a triple-play service that included internet, phone and television services which I have never received any of this from AT & T and now True Accord is attempting to collect in which is a fraud. On November 30, 2024, TrueAccord sent the consumer an initial email detailing the creditor, an itemization of the amount due, how the debt could be disputed, and the option to unsubscribe. It also included a link to the CFPB website (htt*******************collection) for the consumer to learn more information about their federal rights.
On December 17, 2024, TrueAccord received the consumer’s email disputing this debt. We processed this dispute and paused collection activity. In addition, we processed a cease and desist on the account, therefore TrueAccord will no longer contact the consumer regarding this account.
As a result of the cease and desist, the current creditor removed the consumer’s account from our system on December 26, 2024, therefore TrueAccord is no longer collecting on it. The last communication sent to the consumer by TrueAccord on this account was on December 18, 2024, which confirmed receipt of the dispute, as well as informed them that TrueAccord was no longer collecting on the account. Since the account is no longer with TrueAccord, we have forwarded this complaint to the current creditor.
Lastly, TrueAccord has not reported this account to any of the credit bureaus. If the consumer has questions regarding credit reporting, we suggest they reach out directly to the current creditor or the credit reporting agencies.

On 12/6, I received an email from TrueAccord stating I owe a $223. 12 debt to **** ******* *** for an account ending in **** that went into default on Oct 17, 2017 and was charged off on Feb 14, 2018. On 12/10, I received another email stating I owe a debt of $223.12 to a "webbank" with an account ending in ****.
I have NEVER had an account with **** ******* *** or any of it subsidiaries. This alleged "debt" is not and never was on my credit report, this debt is not mine and the address they listed for me is NOT and has NEVER been my address. TrueAccord is scamming people during the holidays, attempting to cash in on whatever vulnerable person falls into their trap, how shameful. I will not contact this company because they are trying to scam me which is why im reaching out to you. They are trying to get my personal information and I will not provide it to them. I have no debts. This "collection" is not and was never on my credit report. I never lived in NH, as their documentation states. I am aware of this tradeline unlawfully reporting on my consumer report. And would like to conduct a further investigation. Please submit all documents that you have submitted to consumer reporting agencies. That you used to create this tradeline on my credit report. I have reason to believe that you unlawfully obtained my personal identification information. Without my prior consent; which, you have used to create this tradeline on my credit report. let me explain, if you have used my Name and any other personal identifiable information such as: a social security card, driver license, or my address. Without a signed agreement between me and your agency. That expresses mutual assent from both parties. Then you are facing some serious penalties under the UNITED STATES CODE. Pursuant 18 USC 1028A Aggravated identity theft. (See United States v. Kuc, 737 F.3d 129, 134) "Pursuant to 18 U.S.C. § 1028A(a)(1), a person is guilty of aggravated identity theft if, in relation to any crime listed in § 1028A(c), he "knowingly . . . uses, without lawful authority, a means of identification of another person." The statute defines the term "means of identification". To mean "any name or number that may is used alone, or in conjunction with any other information. To identify a specific individual, including any name, social security number, [or] date of birth." Meaning if you used 2 separate forms of identification without my consent. In the process of investigating this complaint, we reached out to ******. ****** provided the following information:
******’s records indicate that the loan in question is *********. Loan ********* was processed for $745.19 on July 21, 2023, for a purchase with ******. The repayment terms were 18 installments of $51.73 at an Annual Percentage Rate (APR) of 29.49% with payment due on the 21st of each month. Between the dates of August 21, 2023, and February 21, 2024, ****** received a total of 7 payments of $51.73. No further payments were received and the loan was charged off on July 20, 2024, after having an overdue balance for 120 days.
As stated in ******'s Terms of Service, Section 2, Servicing & Collection, which *** ***** agreed to upon account creation and every time he applied for a loan: "You agree to allow ****** to send you payment reminders from time-to-time. Notwithstanding whether you have consented or withdrawn your consent to the ****** E-Sign Consent, you agree that payment reminders may take the form of any available communication, subject to applicable law. You also agree that if you fail to pay an amount owed to ****** pursuant to this Agreement or any other agreement you have with us or any Bank Partner, ****** may engage in collection efforts to recover such amounts from you. These collection efforts may involve contacting you directly, submitting your information to a collections agency, or taking legal action. FAILURE TO PAY MAY AFFECT YOUR CREDIT SCORE."
Upon charge-off, ****** placed the loan with one of ******'s third-party collection partners,TrueAccord, for continued management. At this time, *** ***** will need to contact TrueAccord at ************** to settle this debt. Once the balance is paid in full, the loan will reflect as paid. However the history of charged off status will remain.
****** has no record of receiving contact from *** ***** to report that the loan was obtained without authorization. Upon receipt of this complaint a case has been forwarded to ******’s Account Safety Team for investigation. *** ***** can expect to receive their follow up via email within 30 days. In the interim, if *** ***** believes that this loan was obtained without his authorization, he is encouraged to complete ******'s webform which serves as an affidavit within ******'s Help Center and provide any supplemental documents to support the claim of the unauthorized activity. Upon origination of the loan, *** ***** electronically accepted/signed a Truth in Lending Agreement. To access his loan agreements online, visit ********************************** and access your ****** account. Once logged in, navigate to the “Pay” tab and select the desired loan. In the “Loan Timeline” section, select “Loan Terms.” This will open the Truth in Lending Disclosure for that particular loan. As stated in ******'s Terms of Service which *** ***** agreed to upon account creation and every time he applied for a loan, specifically Section 1: Electronic Disclosures: "Your electronic signature on agreements and documents has the same effect as if you signed them in ink." Together, these documents provide the debt verification that he seeks.
Please note, ****** has a regulatory obligation to furnish accurate loan and repayment information (positive or negative) to the credit bureau and can only update reporting if an inaccuracy is identified. Furthermore, this was disclosed on ******’s Terms of Use and Privacy Policy as well as your Loan Agreement which you consented to and approved when you obtained ******’s loan. On December first at 7:34pm I received an email stating I owed a debt a capital one account that was due April 30th 2014. I am not sure how they got my name or email address, but the home address they have on file is incorrect, and I was not living in the State of Indiana in 2014. TrueAccord is a third party debt collection company established to reimagine the debt collection experience for consumers. Founded in 2013, TrueAccord communicates primarily via email and offers an inbound customer service center in the event a consumer prefers to call in and speak with a live agent. One of our guiding principles is treating our consumer-customers with dignity and respect. We are a licensed and bonded agency and registered with the CFPB. We maintain a full-time internal compliance department that established our policies and procedures to meet the requirements of the state, federal and local laws and regulations governing collections. Our in-house training program instructs our agents on these policies, including annual refresher courses.
TrueAccord does not own the account in question. The current creditor placed the account, including the consumer’s contact information, with us and we loaded it into our system on November 22, 2024.
On December 1, 2024, TrueAccord sent the consumer an initial email detailing the creditor, an itemization of the amount due, how the debt could be disputed, and the option to unsubscribe. It also included a link to the CFPB website *********************************) for the consumer to learn more information about their federal rights.
On December 2, 2024 TrueAccord received the consumer’s email disputing this debt and requesting that TrueAccord cease & desist communication with them. TrueAccord has processed the dispute and cease and desist request. TrueAccord will no longer contact the consumer regarding this account.
Please note that in the regular course of business, the current creditor removed the consumer’s account from our system on December 4, 2024, therefore TrueAccord is no longer collecting on it. Since the account is no longer with TrueAccord, we have forwarded this complaint to the current creditor.Business Response

I stated receiving text messages about a debt owed. It has an amount of 324.00 a link to click on to get more information. I didn't recognize the account. So, I emailed the company only to get sent back an email from Ningdeih That due to the nature of our accounts, we are unable to speak with anyone other than the account holder. I asked to file a dispute because I don't recognize this account, amount or company. They refused to give me information.
