When applying for a loan in my name last month, I got denied. When I was provided a copy of my credit report, I saw things on there that were inaccurate. Inquiries and addresses that are not mine were on my report as well as accounts that I never opened. I have contacted these creditors to make them aware of the breach. Now, they are requesting that I fill out a full Packet to show cause in order for them to cease reporting to my credit due to this possible identity theft. Dear *** or Madam:I am a victim of identity theft. I recently learned that my personal information was used to open an account at your company. I did not open or authorize this account, and I therefore request that it be closed immediately. I also request that PLAZA SERVICES absolve me of all charges on the account, and that you take all appropriate steps to remove information about this account from my credit files.I have sent several written request for this account to be properly verified. ACCOUNT NUMBER: *********** FOR THE AMOUNT OF $8176.33 The Notice also specifies your responsibilities when you receive notice from a ***, under section 605B of the Fair Credit Reporting Act, that information you provided to the *** may be the result of identity theft. Those responsibilities include ceasing to provide the inaccurate information to any ***s and ensuring that you do not attempt to sell or transfer the fraudulent debts to another party for collection.Please investigate this matter, close the account and absolve me of all charges, take the steps required under the Fair Credit Reporting Act, and send me a letter explaining your findings and actions.Business response

I'm disputing under FDCPA did not receive notice of debt with documentation contents , tracking number of delivery confirmation of Notice of Debt Form B-1. I am now requesting for verification, and validation of delivery of those notices with tracking numbers, or certified return receipt. Also confirmation that collection was reviewed by attorney; and copy of authenticated Forward Flow Agreement. Copy of signed contract with wet signature signed by me that authorizes Plaza Services to distribute my private personal information. Confirmation that Plaza Services owns the alleged debt. Plaza Services is willfully violating Section 809 of my FDCPA CONSUMER RIGHTS, with reasonable understanding that they are reporting and furnishing inaccurate, incomplete, inconsistent, unverifiable, unvalidated information, data, to my consumer, credit, database, and repository files without following proper procedures. Plaza Services states om their website that accounts that are paid in full or settled are to be deleted/removed from any tradeline reporting on TransUnion, Equifax, and/ Experian.Business response

Dear Plaza Services,I am writing to dispute the alleged debt currently being pursued by your organization, which was purportedly acquired from Plaza Services. It has come to my attention that this debt is subject to the arbitration agreement outlined in the *** Communication agreement, to which I am a party.I am aware that initiating arbitration involves significant costs, and given that your organization likely acquired this debt for pennies on the dollar, I am offering you an opportunity to settle this matter amicably before pursuing legal action. I propose a settlement amount of $6,000, which accounts for the mental distress, anxiety, emotional distress, and financial hardship that this situation has caused me.Furthermore, as part of the settlement agreement, I insist on the following:Payment of $6,000 as compensation for the aforementioned distress and hardship.Removal of any reporting of this debt from all credit reporting agencies.This settlement offer is contingent upon your prompt response and compliance within [reasonable timeframe, e.g., 30 days] from the date of this notice.In accordance with 15 USC 1692c(c), I demand that you cease and desist from all illegal activities and mediums of communication regarding this debt, including any communication on a consumer report, except for your response via mail with a settlement check or a letter notifying me of the deletion of the account from my consumer report.Should you choose not to accept this settlement, I want to make it clear that I am fully prepared to initiate arbitration proceedings.
