    We entered into a 3-year contract on the basis of a product that does not offer the functionality on which we were sold, and has multiple breakdowns and errors, now requiring a weekly meeting with the company to discuss fixes and track their resolution. The contract includes a termination clause for cause if solutions on not provided within 30 days (section 4.4 of MSLA: REMOVED). There have been at least two occasions of software failures that have prevented business, including a patient portal error lasting six weeks and delaying our office's ability to open and conduct business, and a communications module that is still not operational (despite four months of live software) and is the only way to remain HIPAA compliant in our electronic communication with patients. Their software is also not integrated and requires multiple work arounds to make each piece functional and work together. This includes the ability to create schedule templates that function with the patient self scheduling (self-scheduling is a module we were upsold on); we are currently using a workaround template. We have been told this is how this program is designed and we can only request the improvement for a later iteration, which would take years. Our company is new and small and does not have the resources to allocate to pointing out the ever-evolving software errors, requesting fixes, and following up each week to make sure these are resolved and the software is again operational. The sales person who sold our office the software has since left and relayed the company is likely to drag on any requests to terminate the contract (we have been refused twice), and instead only offer a buyout of the contract (they have quoted us the entirety of the contract over three years, ~$30k). The software is so clearly not meant for a practice like ours, and they should honor the termination clause for cause.

    This business has failed to notify the customer of renewal of services and charged for services without services of any kind being rendered. Additionally, not only have threats of legal action been made by this company to their customers, this has happened numerous times. I suspect this company is engaging in predatory business practices and high-pressure tactics to force their customers to make decisions that would not be in their own best interest. I am seeking to make this information known so that prospective customers understand the potential risk of doing business with this company.

    Nextech operates a website, REMOVED, through which health care practices allow patients to access their records. The issue with the website is there is no way to contact customer support for issues, or request deletion of your account, which I suspect is a HIPPA violation, given patients have no control of their data on this site. I would like someone to reach out to me and help delete my data, while also adding a contact customer support function so people do not have to raise concerns like this - we should have more control over our PHI.
