      Dear Advanced Collection BU,

      I am rejecting this response.
      Thank you for your communication dated September 24th, 2024. However, I have yet to receive any documentation or proof validating the alleged debt, despite your statement.
      As per my rights under the Fair Debt Collection Practices Act (FDCPA), I once again formally request full validation of this debt.

      Specifically, I request:
      - A copy of the signed contract or agreement that you claim I have with The Fountains at *********
      - A full itemized breakdown of the debt, showing how the amount was calculated.
      - Proof that Advanced Collection BU is authorized to collect on this debt.

      Until proper validation is provided, I continue to dispute the debt in its entirety. Please send all correspondence and the requested documents to my address in writing.
      If you fail to provide adequate validation within a reasonable timeframe, I will consider this matter unresolved and potentially pursue further actions to ensure compliance with the FDCPA.

      *** ***** from Advanced Collections ************ is HARRASSING my daughter for a FRAUDULENT ATTEMPT TO COLLECT A DEBT THAT SHE DOES NOT OWE. According to the ******************************* said the company called NOVA PROPERTY MANAGEMENT and COFFEE CREEK APARTMENT homes are operating with a NON-***************** Licences and have a closed facility due to the death of the previous owner of the business thus by law cannot make demands in association to pre-existing closed Court Cases. COURT CASE was DISMISSED WITH PREJUDICE ON 7/3/23 WITH AGREEMENTS ON BOTH LIVE PARTIES WITH LEGAL REPRESENTATION. MEANING THE PLAINTIFF IS BARRED FROM FILING A LAWSUIT ON THE SAME ISSUE AT A LATER DATE. THE TEREMS OF AGREEMENT STATED THERE WAS A $0 BALANCE OWED AS OF 7/3/2023. The FRAUDULENT Debt collection attempt is for a dates in which we were not residing at the residance and inclusive of the time frame within the Legal Case which was dismissed. They have no Legal Justification to making any FRAUDULENT claims of Debts out of Retaliation. After the case was Dismissed with Prejudice I certified mailed them a DEMAND FOR DEPOSIT on 7/10/23 and in Retaliatiion they responded with a FABRICATED DEBT COLLECTION that VIOLATES THE COURT RULINGS.       Advanced Collections Bureau, ************** is NOT a valid business that has the authority to operate in the State of ********. Upon checking on 9/17/2024 with the Secretary of State of Oklahoma to verify if this company is Legitimate with an active license to operate, they have discovered in the filing history for Advanced Collections Bureau, ************** whose Trade Name is "*********************" has been INACTIVE since 1998. In accordance, with the Secretary of State of *************************** since the company Advanced Collections Bureau, ************** "********************" has an INACTIVE License registered with the State of Oklahoma they are NOT acknowledged a Legitimate Business until they file as such with proper Licensing information. Therefore, once again, I, ******* R. ********, DISPUTE this FRAUDULENT Supposed Claim of Debt as it DOES NOT BELONG TO ME AND IS FRUADULENT. According to THE FAIR **** COLLECTION PRACTICES ACT(FDCPA)(15 USC 1692 et seq.) this is a Federal Law protecting me from unfair, deceptive, and abusive debt collection practices. In addition to the aforementioned request, you will need to provide valid proof that you have the legal right to operate as an Legitimate Entity in the State of ******** and that you did not obtain my Identity though Fraudulent means.

      I am rejecting this response because I do not have a contract with ***** Motel Apartments, nor was I made aware of any debt owed to them until it appeared on my credit report in March 2024. I have not received any validation or supporting documentation from Advanced Collection. 

      Violation of the Fair Debt Collection Practices Act (FDCPA):
      By their own admission in the business response, the debt collector (Advanced Collection) did not provide any written documentation prior to my BBB complaint. It is not until I filed a complaint with the BBB they want to mail documentation and open a dispute. This failure to provide documentation is a violation of the Fair Debt Collection Practices Act (FDCPA). Specifically, under Section 809 (Validation of Debts) [15 U.S.C. 1692g], a debt collector is required to provide validation of a debt within five days of initial contact. This validation should include the amount of the debt, the name of the creditor, and proof that I owe the debt.

      Furthermore, I was not informed of this debt until it negatively impacted my credit report causing a 37-point drop in my credit score. This lack of prior notice and subsequent damage to my credit is deeply concerning.

      Given the failure to validate the debt as required by law, I am requesting the following actions:
      1. Immediate removal of this debt from my credit report.

      2. Termination of any further collection efforts by Advanced Collection or any other third-party agencies related to this matter.

      3. I request that Advanced Collection provide written confirmation in their response to my complaint on the BBB page, stating that this debt has been removed from my credit report and that no further action will be taken. 

      4. If Advanced Collection fails to remove this debt from my credit report(s) and cease further collection actions, I will be forced to hire legal representation to pursue a lawsuit for violations of the Fair Debt Collection Practices Act (FDCPA) and any damages that have resulted from their unlawful reporting and failure to provide required documentation.


      I am committed to resolving this issue fairly and respectfully. However, I believe that the continued reporting of this unvalidated debt is unjust and harmful. Especially, how this collection has negatively harmed my credit report since March 2024 and no documentation to date was provided from Advanced Collection. I kindly ask the BBB to assist in ensuring that my rights are upheld and that this matter is resolved promptly.

      Dear BBB Representative,

      I am once again rejecting this response and want to clarify that I never received the Validation Notice allegedly sent on 4/13/2022, nor any copies of the original signed agreement. As stated previously, the first time I became aware of this debt was when it appeared on my credit report, causing a 37-point drop.

      Still to date, I have not been provided with any verifiable documentation proving that this debt is mine. Under the Fair Debt Collection Practices Act (FDCPA), a debt collector is required to provide validation within five days of initial contact, which has not been done.

      I formally request proof that this "Validation Notice" was delivered to and received by me, such as a return receipt with date and my signature of acknowledgement. Until such proof is provided, I maintain that this debt is unvalidated and should be removed from my credit report.

      Furthermore, the suggestion that I file a police report for a potential fraud or identity theft. An investigation is inappropriate without first providing me with the necessary documentation to substantiate the claim that this debt is indeed mine.

      At this point, the back-and-forth responses are becoming more costly and time-consuming for all involved than the amount allegedly owed.

      Therefore, I humbly and respectfully request the Better Business Bureau representative intervene and ensure the following actions are taken by the business (Advanced Collections), based on the violations of the FDCPA.

      1. Immediate removal of this debt from my credit report.
      2. Termination of any further collection efforts.
      3. Written confirmation in the BBB response that this debt has been removed and that no further action will be taken.

      I am not liable for this debt with *************** I do not have a contract with the collection agency, Advanced Collection Bureau. They did not provide me with the original contract as I requested.

      This complaint is the first written communication we have received from you. We have now marked your account in dispute and have mailed you validation of what our client still states is an accurate and valid debt to the address we had on file for you, as you did not provide an address in your complaint.

      Creditors have the right in the normal course of business to employ a third party such as our company to attempt to collect their past due accounts. It is quite legitimate and appropriate for an account, including credit reporting, to be handled through our company as agent for the original creditor.
