The company refuses ro respond to any of my emails of texts with an answer my question on how much is the lowest payment arrangement I can make. This is the 1st debt collector that has been unable to provide the information to me it's like they don't want their money back they just want to cause unnecessary problems. I'm asking them for the next steps and for them to provide a payment arrangement and they refuse to answer so I've come to submit the complaint.Business Response

Thank you for your message. First and foremost please note that we are not a debt settlement agency nor a debt collector. You entered into an agreement to sell your future receivables for an advance and funds and defaulted on that agreement, and has since been in communication to resolve the balance on the account. In reviewing your account i see that you have been in communication with our collections department and that an option of settlement offers was most recently provided on February 12th. To date, you remain in possession of the funds provided to you in good faith and deposited into your account on October 29th without a single remittance made to date. Please review the correspondence sent to you by the collections team following several months of contact attempts with no response from you.
We stand by to address your questions in hopes of an amicable resolution on this account.

Overcharged me for cash advance loan, interest rate is so high; this should be illegal. Account was sent to collections because I wasnt able to pay back loan, now they are threatening to garnish and place lien on my bank accounts . Ive setup a payment plan and I missed a payment now the balance is going from $4000 to $7000 ! I only borrowed $1200 from them.Business Response

Thank you for message. First please note that we are not a loan provider and do not issue loans of any kind. The agreement you entered for was for the sale of your future receipts. At the time of funding, the full amout of your payback is advised before funds are disbursed, no fees are added to this amount barring fees for missed payments should any occur on the account, and there is no interest added after funding. Unfortunately, because the account that was provided to us for repayment was closed after 2 remittances, the account did go into default. Upon review of your account, however, it does appear that a settlement reduced offer has been recently provided to you should payments remain in good standing moving forward.Initial Complaint

On November 2, 2024, this company was charging me 600 percent interest demanding repayment of $5000 for a $650 loan and they were notified by phone and by email that I demanded their access to my bank account by debit, ACH and any other method was officially revoked and they were in compliance. Recently, on 1/7/25 and 1/24/25 they drafted two FAKE checks for $115 each and processed them through my bank, creating a financial turmoil. These "checks" have no signatures and inaccurate addresses listed.Business Response

The total payment amount due at the time of signing was indicated on the agreement that was signed and executed prior to the deposit of funds into your account. I signed a contract with Fundo for a $900 loan. I made weekly payments to Fundo until the payments were satisfied. AFTER the loan was satisfied, Fundo began to say that my account was delinquent and began to charge fees/fines not proportionate to the original loan. Fundo took advantage of my lack of awareness on how many payments I had made and began to continue charging my card for a year. Fundo continues to demand more money for this loan, even after I have already paid almost $4,658 for this loan.Business Response

I have recently received a cash advance from fundo on August ******* in the amount of $1,300. The cash advance was originally for $1,500 which they claim ($200.00) was for process fees. That was not mentioned until cash advance was accepted. I have been making all payments on time until up to two weeks due to No incoming INCOME. I have payed this account on time and have already payed the cash advance off plus some. They have received over $2,800 dolllars plus from me. I spoke with an agent on January 10th and informed them that I currently dont have any income coming in anymore. I ask if I could just settle the account and she informed me yes for only 700 dollar off. Which is $2,069. I informed her I dont have that type of money. She then offer to lower my weekly payments and she was going to email it to me in 2-3 mins which I did not receive. Due to no incoming income Im requesting for this account to be settle due to payments to the cash advance has already been paid plus extra thousands of dollars more has been paid to fundo.Business Response

June 2024, I took what I believed to be a cash advance with Fundo. My payments were supposed to be ach withdrawn beginning June 17, 2024 and every Monday following. Fundo breached the contract and withdrew funds June 15, June 22, and June 29 without my permission. When I realized they were withdrawing the payments early I called and asked for verification of payment due dates and a copy of my contract on July 2, 2024. It was confirmed that all payments were to be withdrawn June 17, 2024 and every Monday. I was also supposed to receive a copy of the contract and never received it. I believe August 2024 I stopped allowing ach withdrawals from the account because I had not received a copy of the contract. September, they threatened me with a ******** filed against me and I disputed it requesting for the address to mail in payments and also spoke with a representative requesting for a copy of the agreed contract. I never received a copy of the contract. December 2024 I received an email stating that a ******** was filed against me and I had 10 business days to reply come up with a settlement of the alleged $2800. I received $600 from Fundo, LLC and they withdrew $890.00 from my account and refuse to provide me with a copy of the agreement nor acknowledged that they were withdrawing payments before the contracted date. I called and spoke ***** in the ****************** who offered a $2200 settlement which I declined in the demand letter because they breached the contract and refuse to send the requested information. I sent a demand letter to provide a copy of the agreement, terminate the ******** filing, and to amicably settle the account because they violated the agreement by taking unauthorized payments before the contracted date. This company has so many complaints filed against them for the same reasons, not providing a copy of the contract, making it seem like a merchant account when it's a cash advance, illegally filing ********* on accounts and more.Business Response

Thank you for your message. We too have noticed that some banks have begun processing Monday ACH payments faster than usual, however a review of your account and indicate that these payments were scheduled for processing on the dates you indicated, as you were set for Monday payments. A copy of your agreement has been sent to you at the time of funding on Jun 05 4:44 pm in an email with the subject " Welcome to Fundo! Important information regarding your account" as well we as on December 19th in addition to a statement in response to your request. From the time of your funding until payments were stopped in August, we received only one communication from you regarding the early processing, and your payments were at that time moved to Tuesdays to eliminate any possibility of early weekend processing. From August through december we attempted to discuss the account with you but were unable to connect, as such UCC rights were enforced, at which point we were able to speak with you and provided you with the proposed settlement.
We are happy to discuss other settlement options for resolution and welcome you to reach out to our team from Monday through Friday from 9am to 5pm EST.

Their response is unacceptable. I notified the company in July 2024 about the due date. If I had a copy of the contract I wouldnt have requested multiple times for the contract. They never sent an invoice indicating that your total balance due until December 2024 when they added their fees. They were aware of the payments being withdrawn early and never notified the customers or did anything to prevent it. I spoke with Fundo in July, August, and September. September is when I replied to their email about the *** lien being filed. Where is the level of integrity? When are they going to take ownership of their breach. The bank wouldnt have sent payment without their request. It was not my responsibility to contact them about their breach. Even after being advised of the breach theyre still showing inaccurate payment history dates. How is it ok to put a lien on someone accounts receivable and expect t payment when you caused the breach. As a consumer I have the right to dispute and request a copy of a contract, payment history, and etc. At this point my hands are forced to proceed legally because Im not working to have my earnings illegally sent to Fundo! They are illegally attempting to collect a debt without a court order. The Secretary of State says that filing is for informational purposes and they have to a court order to collect.

***** ****** was very rude and disrespectful, did not listen to anything I had say, told me hire an attorney and have your attorney to reach out to our attorney.That was an absurd offer. I requested a copy of agreement in July 2024 didnt receive it until December 2024 after the accumulation of these astronomical fees. When they breached contract on the 1st draft and didnt do anything to prevent it. They stated they were aware of the early withdrawals and didnt contact their customers that was affected by these withdrawals. The bank is only sending out the payments at your request.
They keep saying merchant account, Im not a merchant, Instacart is the merchant. Im contracted via these app companies that have the merchant accounts. So what you provided was a loan.

I took out of merchant cash advance from them summer of 2023 after paying back the principal I explained to them that I was having some financial troubles and I couldn't make the payments. They were very rude and told me that I had to make the payments or I was going to get in trouble. I showed them in the merchant cash advance paperwork. I signed that it said that if I had a slowing of work or lack of funds coming in then I couldn't be held responsible for it and they tried calling me a couple more times asking me and I told him I didn't have the money for them still and then I stopped hearing from them. Now all the sudden my bank account has been frozen with a ucc lien against it and I still can't get a hold of themBusiness Response

I had previously accepted the prior cash advances from this company under the impression that I would be eligible for advances that considered of higher value as told by an employee of Fundo. I going that actually to be contrary to my experience to where my cash advances became smaller still with very high interest rates which were practically double the amount that was advanced to me. It was explained to me that the reason for this was that they project the availability of funds is judged by the previous 90 days transaction history of my used accounts. Being that the weekly payments that were made to Fundo from my account were included in the history, I find it to be conflict of interests that even the payments made to Fundo negatively affected my ability to be presented a higher cash advance amount even after an excellent payment history with this company. More so what is more unethical is that they don't report to any of the three major bureaus. I find it to be a bad practice that you can gain no merit with this business by making on time payments but contrarily be somewhat disadvantaged.Business Response

This includes considering any payments you are currently making to us as we do not want to overextend our customers and therefor have to consider all financial obligations when determining affordability.
