I took out the merchant advance in September of 2023 in December I was in a terrible accident and suffered a stroke. I was in the hospital for months, and then discharged to a rehab facility for 13 weeks. Unable to care for myself still. I havent been able to work and when threatened with the lien I explained this to a manager they offered me a settlement of 3500 on an 1800 dollar loan. I requested a copy of my contract and still havent received it because I know in the contract it states that if Im no longer receiving revenue they cant collect. Im on government assistance and SNAP due to debilitating disability and they froze my cashapp account. I also am looking for people who have filed a class action lawsuit. This company should be banned from doing business. Last time I checked I owe almost 6k on an 1800 dollar advance.Business Response

I took the loan out and a month after that I was in a accident and now permanently blind and had to close my business down. I showed them in the merchant cash advance paperwork. I signed that it said that if I had a slowing of work or lack of funds coming in then I couldn't be held responsible for it but now they are putting liens on accounts and even took money out of a account that was closed down making me pay for it when I told them the account was closed for fraud. They could have worked with me seeing that I have no income coming in right instead of going straight for a lien. Poor business and disrespectful customer service.Business Response

Ms. ******** please note that the Payment Rights Purchase and Sale Agreement you signed on 01/07/2025 clearly states the different legal recourses that Fundo LLC as Buyer has in the event of default, including filing a lien against your assets according to the Uniform Commercial Code, and that in no section it contains any provision that you would not be held responsible for repayment in the event of "slowing of work or lack of funds" - actually, the No Liability clause included determines the opposite (see Section 1.4 of the Terms and Conditions, Page 3). You could have requested a reconciliation, but never did, according to our records, and all payments simply defaulted both from the original account and the account you asked us to debit from when you claimed the original one was closed due to fraud. After the accident one of our representatives asked for the required proof, this was required on 03/19 and you only submitted until yesterday, 05/07, a screenshot which does not indicate a permanent blindness diagnosis. At present, you still remain in posession of funds, no payment from the original schedule has ever been successful from any of the accounts you willingly provided to be debited from, and have not been willing to work with us in settling your account - last contact on 04/03 you said you would get your lawyer involved and report fraud. Submitting a BBB complaint on the same day you provided the proof of medical condition we required two months ago will not help your case, however, the evidence you sent is already with the reprresentative in charge of your file, wo will be in touch soon with any possible payment alternatives. Ms. ******** the proof we asked for was for the medical condition you initially alleged you had and wanted to use as a reason to not fulfil the contractual obligation you took under your business. The payment we ended up taking was ****enforced as explained in our response and as part of the original contractual provisions you agreed upon when you signed the agreement. Sadly, from the original agreed amounts we have only been able to recoup so far $86.66 after five months. We have tried, on multiple occasions, to work out something with you, and we are still willing to offer you settlement options that may be conducive to a lien release as the representative in charge of your file communicated earlier today. I took and I had caretakers come into town to take care of me because I'd had open heart surgery. I was not working.And then I went back to work part-time, but I was very short of money, and behind are my bills. One of my caretakers applied through a loan for fundo.Fundo gave a loan with an outrageous.And in ********** illegal loan percents. I called several weeks after this loan to make a payoff, but the loan payoff was almost triple of what the person had agreed tomorrow and had deposited into my son's account. ********************** had their attorneys file paperwork in the state of *******, which is 100% illegal. Because I am a washington based business. Then they filed a lien on my place of work without a court order. Which again is against washington law. My work has a local office in *******. But they are based out of **************Meanwhile, my business location is based out of **********. Solely, in fact, I have never stepped foot in *******. I have attorneys in ******* and ********** now, and as of today, the union is involved. And we're getting the attorney general involved. Don't use this company. I took out 1300 to which they already took 200 off the top as a service fee so I got 1100. They proceeded to take out $154 for 9 weeks. So I well paid over what I took out when I would call to get pay off it was always more then the last time and they are incredible hard to get ahold of let alone rude and will not work with you. When I tried to make arrangememts to settle the amount was out of this world. They wanted $2700. Now they are saying i owe $5900 and have filed a *** filing on my accounts let alone always having a different amount. I have the string of emails always conflicting the amounts and not willing to work with me on realistic options let alone not being able to talk to anyone to get realistic information. I have my attorney drawing up a counter sue for emotional and financial stress and will be also contacting legislation and the white house on this. Ms. ****** on 12/09/2024 you took a Merchant Cash Advance (MCA) from us, for which an amount of $1,100 was deposited to the business bank account you indicated. The agreement you signed (attached to this response) clearly indicates: the Future Receipts Sold and Processing Fees (page 1) and a breakdown of applicable fees in case of default (page 9), both of which were digitally signed by you on 12/09 in acknowledgement (please note that this e-signature contract meets requirements for a binding agreement). Several of our representatives have been in contact with you, and the one who is currently handling your account provided today a full account statement and indicated the steps to follow in order to bring back your account to a good standing (you made a $156.66 payment today, only your 8th successful payment, and first remittance since January). I am rejecting this response because:They repeatedly changed the amounts of payoff when I would call to a higher amount when they said you could pay it off early. First time is was $1100, Second time it was $1300 and this was after I had paid over $600 of the $1100 I was advanced. I have now paid $939.96 of the $1100 I got from them and they tell me I owe $5200. Each pay off was more then the last after payments had already been made on account. When trying to work out a settlement it was unrealistic amounts with unrealistic payment dates. They even so much as sent me an email with someone else's name for a *******, weekly payment amount of $164 when mine was $156.66 a week and total payoff of $5000.00 when mine at the time they said was $3700. When I responded to that email they said the information in the email to ******* was indeed my amounts just the wrong name. See attached. This doesn't even match up with anything that I agree upon in initial agreement nor was it my amounts. In that email addressed to said *******, They even gave him a break down of options. This kind of email was never given to me for options. They are inconsistent and unorganized unless it comes to adding on fees to get them more money and control your account. They gave several different amounts several times. I have all the email documentation and have recorded calls that I gave to my attorney. When a payment arrangement was set up they still filed a *** filing charging me $250 for filing when my state charges $35 to file and a $1500 default fee. They do not allow online login access to login into your account to watch paydown or make payments. Everything is done over the phone or email in which is very spotty with communication and different people every time who do not know what they are doing. This is so they can hijack your account and not let you know what they are charging. Even the breakdown they sent me makes no sense. They have access to my accounts however can not provide me online access to mine???? that's fishy! Any financial institution or lender these days has that availability.. (see email attach to their response to this)My attorney will be in contact with them next week and I will be charging them my own made up fee for no online access as well as filing all everything I can file to make sure they can not do this to anyone else. They bully people to the point of near death with emotional and financial stress making it so there is not way out while continuously adding fees....as you can see from the numerous complaints its the same story over and over again. If they are a legit firm doing legit things they should be offering online access to your account with them so you can view as you go along not just add fees and do whatever they want with discrepancies and inconsistencies.

We contest the rejection of our previous response as it is valid and applicable to Ms. ******* defaulted account. The complainant is now alleging not having access to an online portal (which is on our roadmap to be deployed soon to all of our customers) or her own subjective perceptions as an excuse to not fulfill her acquired financial obligation. Again, any information regarding the advance can be requested at any moment during business hours from one of our customer service agents during our businesses hours either via chat, email, or call, or by replying to the agent already assigned to the account, as it has always been the case. We don't consider that threatening with legal action on BBB will help the debtor's case or make the lawfully acquired obligation upon the agreed terms and conditions go away, and we see no merit in entertaining further correspondence. I took out a loan in August 2024 for $1100. I received $875 it came with a processing fee of $200, other fees not listed of $100 and a wire fee of $25. With interest and fees my repayment amount is $2640. I ended up defaulting on the loan after paying a total of $548 towards the loan. They placed a *** lien against my personal and business accounts. I am currently trying to repay the loan. They are now telling me I owe $4242. There were 3 offers given to me. 1 payment equally $2969.40 and the loan would be repaid or a down payment of $1018.08 and the balance broken down into weekly payments of $158.38 with a balance of $2375.52. 3rd option pay full $4242.00. I am rejecting this response because: the income you had verified for reconciliation was not from a business but you counted it as income. But you took out 2 payments and left me with two ***** fees from my bank for overdraft. I have just acquired a new job and as a VIP with your company , your interest should be illegal I also was not advised there was 100 fee just for the loan so instead of 700 I got 600. And then have to pay 500 dollars on interest ... Weekly payments of ********* crazy. I almost lost my place to live. Have some sympathy for your customers who have lost everything. I will continue ******* with you guys because I pay my bills. But please be reasonable. After I get my first check under my belt in a few weeks I can do 50 a week. If I get anything back from my taxes this year I'll probably try and pay it off.

I took out a cash advance from fundo as they claim on Feb 5 however that's in question because they have changed dates. Anyways it was for $1400 after fees $1175. Weekly payments $159. I already paid for the past 5 weeks $795. I called today March 18, 25 to pay it off they told me it is $1395 which makes zero sense how is my pay off balance the exact amount of the cash advance? If I already paid $795. I am only going to pay $1100 that's it. I ask for the ceo email he was rude and said no. I ask to speak with their legal department the same guy who said he is the supervisor answered and said he represents the legal team too that is complete BS. I ended up taking a loan (a sale of future receivables disguised as a loan) from Fundo when my business was struggling. At the time I had some family emergencies that prevented me from paying on-time. *********** files a lien against the business after 1 month of non payment. They gave me no time to reconcile and would not accept my offers to set up a payment plan. *********** after advancing only $2,000 ($1820 after their $180 transfer fee) demanded a total amount of $7,000 be paid back as they purchased $5,000 of future sales (I should have had a lawyer present and I did not). They disguised the loan as a sale so that they could charge excessive usury rates/returns on the loans. They can then file liens and get $7,000 for only $1820 paid out. *********** seized my payment processors causing my entire website to shut down even after I pleaded with them to take payments, described my situation etc. *********** was clearly never interested in getting a payment. I have a family of 5 and this company forced me to close my website which was my only source of income. Their *** angle makes it so that you cant do anything once they file the lien.Business Response

The business stated they never heard from me until a year later and that is not true. I have attached an email communication with the company stating my intent to pay in May of 2023 (after their misleading email about a potential lien that had already been filed). I was going through a family crisis, moving across the country due to an emergency with my mother as I stated to them repeatedly so I was not able to get in touch right away. This complaint is in regard to the action to freeze my accounts in august of 2024 after my communication and intent to pay. The company is demanding full payment. According to the payment schedule, They would not have had anywhere near full payment even if I was able to make every payment at that time. They have not been willing to take any payment that I could afford. All of their offers were way out of my reach as I told them repeatedly. My business website had to effectively close due to this companys predatory practices and lack of regard for my business and sole income. I am rejecting this response because:The speedy lien slapped on my business has made it virtually impossible to operate as promised in our contract. Fundo must release the hold on my payment processors so that we can re-open the business to make steady payments. The company purchased future sales. How can we operate without access to our funds? The only satisfactory response in this case would be a letter to release the holds on ****** and ******* and ****** so that business can resume as agreed.

Thank you for your message. Please note that the email address provided on this complaint does not match the information we have on file and appears to belong to another customer. Using the phone number, we were able to locate your account. Unfrotunately it does seem that as a result of the default on the account that took place in August of 2024 and the lack of communication and payments made since, the account is currently in collection.
