    IN REGARDS TO ******************************, VADER MOUNTAIN SERVICING IS A PREDATORY LENDER WHOM I ENTERED INTO A LOAN AGREEMENT WITH ON 9/5/2024. UNFORTUNATELY DUE TO SOME UNFORESEEN FRAUD ISSUES ON THE ACCOUNT I HAD PAYMENTS DRAFTED FROM HAD TO BE CLOSED. AT LEAST 2 PAYMENTS WERE PROCESSED ON 9/5 AND 9/6/2024. VADER MOUNTAIN SERVICING CALLED AND EMAILED ME ALMOST DAILY FOR MONTHS WELL INTO NOVEMBER 2024. THEY CONTINUED TO ASK ME TO ENTER INTO AN AGREEMENT TO REPAY IN ORDER TO AVOID THE ***** OF A *** **** FILING. ON 12/10/2024 I WAS NOTIFIED OF A ******** FILED AGAINST MY BUSINESS BY VADER MOUNTAIN.     To clarify, your business received funding on September 5, 2024. As per the agreement, payments were scheduled to be made via ***. While we did receive one payment, you blocked further payments on September 6, 2024, preventing us from collecting the agreed-upon amounts. Despite multiple attempts to contact you via phone and email between September and November 2024 to arrange a resolution, we received no response. Due to the failure to resume payments or set up a new arrangement, a UCC lien was filed on September 10, 2024, in accordance with our contractual rights.

    Regarding your concerns about the UCC filing date, our records confirm that the lien was filed on September 10, 2024, following your unauthorized blockage of payments and non-compliance with the agreement. If you have any documentation suggesting otherwise, we encourage you to share it with our legal team for review.

    Additionally, any funds in your Stripe account that were impacted are a result of the legal processes associated with enforcing the lien. If you believe there are discrepancies regarding your account balance or payments applied, we are willing to review all relevant documentation and provide an updated breakdown.

    I am rejecting this response because: I have requested on multiple occasions review of my account balance. My balance should reflect $25,220.72 minus the payment of $1880.91 for a total of $23,339.81. The *** lien filed has inaccurate and false information filed on it as it pertains to my balance and needs to be terminated.

    On the payment statement on 9/4/2024 my balance owed showed as $22,800.
    On 9/5 a payment of $217.14 was drafted from my account and then another on 9/6 in the amount of $217.14 which would bring the balance to $22,365.72. There were 3 fees in the amount of $35 each assessed to my account. Please advise what payments these were for as 2 payments were successful which would not correspond to 3 NSF fees. With these fees factored in although I question the validity of all 3 of them the total balance would be $22,470.72+$2,500 default fee and +$250 UCC fee is a total of $25,220.72. You show a balance due of $25,437.86 Which is a difference of $217.14 and does not account for one of the payments made as shown in the attachment.

    On or around September 2024, I was funded for a second loan with Vader Mountain Capital - a few red flags stuck out to me including but not limited to them retaining my business banking details, repeated attempts to re-fund even though I had just initiated a loan. In November 2024, my business account was hacked and funds were stolen. I spoke with Vader as soon as it happened because a freeze was placed on my account so we could investigate. Despite this Vader continued to draw an ACH to date. Despite the increasing amounts of emails and phone calls - our bank has repeatedly informed me, we cannot settle and account with any pending transactions. So what ends up happening is the charge will be blocked but we are required to wait 24 hours. I have asked several times for Vader to pause this ACH attempt for 2-3 business days so we can settle the account and the continue to run it. Then I was told I am being assessed multiple fees and am being subjected to several aggressive ************** position has remained steadfast - I just need a 2-3 business day pause on the *** attempts so we can settle the existing account to move the funds to pay the loan.

    On 12/5/2024 my business was approved for revenue based financing from Vader Mountain Capital. We were connected through 1West Capital. The amount was $2600. Vader Mountain Capital sent over the contract and I signed on behalf of the business (*******************). We submitted bank statements and had to also log in to the business account . After signing the agreement ***** informed me that Vader Mountain Capital is now rejecting the offer due to gambling on our business account . We informed ********************** and 1West that those were unauthorized charges on our account and we also submitted a dispute claim in support of this. We also have already signed and sent the agreement back to Vader mountain capital which makes this a binding contract between us . We have not been sent the funds per the agreement that was signed , we have given over personal and business information with no compensation. This has lead us to believe this is a fraudulent transaction. This is also unfair and deceptive to have us sign a contract then reject the offer after the contract is signed . This can also constitute securities fraud which we do plan on taking legal action if this is not resolved as soon as possible .

    Regarding the issue of the charges identified as gambling transactions on your business account, we appreciate you informing us that these were unauthorized charges and submitting a dispute claim. While we acknowledge your explanation, please note that, as per our standard due diligence procedures, certain account activities flagged during the underwriting process may necessitate further review or result in the decision to decline funding. In such cases, we prioritize protecting all parties involved from potential risk.

    ***** ******* from the vanguard group *** lien Enforcement Unit representing vader ************. Also known as vader Mountain Capital has called twice today but won't leave a message on voice mail but I can here what sounds like a call center in the background. He called twice on 11/25/2024 2 minutes apart. I've had zero contact with this company until today. No emails. No phone calls. No letters. No nothing until 11/25/2024. He sent 2 emails to the old company email. On 11/25/2024. 2 minutes apart. This gentleman also sent 2 text messages to my personal phone on 11/25/2024. In these text messages he stated that he is actively opening a fraud investigation against me and is threatening to liquidate all my personal belongings and garnish my checking account. The text messages are completely different from the emails sent to me. As stated in the files I have attached below. I have filed a complaint with the *** also

I went back 4 years and there has been no communication with them period in those 4 years. So them stating they have tried contacting me is a all out lie.

    1. Background on the Account:
    Ms. ****** entered into a business agreement with our company and breached the agreement, leaving an outstanding balance of $10,665.84 (the last payment she made was on 1/14/2020). Despite multiple attempts to reach Ms. ****** to discuss an amicable resolution, the balance remains unpaid. As a result, the account has been assigned to ************** for resolution.

    2.Communication History:
    According to our records, ************** initiated contact with Ms. ******* as part of their routine collection efforts.
    We understand that Ms. ****** expressed concern about the nature and content of the communications. While it is standard practice to inform customers of potential legal remedies, we have confirmed that no action has been taken beyond initial outreach and hence, we have no reason to believe that any communication made was improper in any way.

    3. Addressing the Allegations:
    Our team has reviewed the claims made by Ms. ****** regarding alleged statements made by the representative at *************** including threats of fraud investigations and personal asset liquidation. As previously stated, while we have no reason to believe that any communication made was improper in any way, we take Ms. ******* allegations seriously and will be conducting a full internal review of the communications made by ************** to ensure compliance with our standards and with all applicable laws.
    Additionally, we will ensure that any further communication adheres to professional and ethical standards while continuing efforts to resolve the outstanding balance.

    ****** Steps:
    To facilitate a resolution without pursuing the matter through litigation (as is our right),we are willing to work with Ms. ****** to establish a payment arrangement that is manageable for her circumstances.     This company assessed a $2,500 fee to my account. On multiple occasions, there have been returned payments on my account. However, I have consistently maintained open communication with Vader Mountain Capital to address these matters promptly. Each time an issue arose, I made immediate arrangements to ensure that my account remained in good standing and avoided default status.Despite this history of compliance and communication, Vader Mountain Capital recently applied a $2,500 fee to my account without prior notice or explanation. This fee was only disclosed after I sought clarification over a 24-hour period. At the time, my outstanding balance was $1,099, making the imposition of this fee both arbitrary and unwarranted.According to the terms of our agreement, such a fee would only apply in the event of default. However, I have taken every necessary step to prevent a default, including fulfilling payment arrangements as agreed. The assessment of this fee is therefore improper and in direct violation of the agreements terms. Additionally, the lack of transparency in this process has caused significant stress and ************ date, I have paid a total of $4,077.74 toward the loan. The total loan payback amount is $5,800, leaving an accurate remaining balance of $1,099. I am seeking the BBBs assistance in resolving this issue by:Reversing the $2,500 fee that was improperly assessed.Updating my account records to reflect the correct outstanding balance of $1,099.I experienced unprofessional behavior from a representative named ******, who insulted me by stating, I dont know how you can afford an attorney but cant afford to pay back your loan.     Thank you for your response. However, I must respectfully address several inaccuracies and reiterate my concerns regarding the handling of my account and interactions with your team.
    1.Timeline of the $2,500 Fee
    Your claim that the $2,500 fee was assessed in accordance with the agreement is misleading. While such a fee may have been outlined as applicable in the event of default, my account did not default until November 21st. This was the first notification I ever received indicating default. Any assertion that my account was in default prior to this date is simply untrue. I urge you to review your records for confirmation.
    2.Default Status
    The account did not enter default status until after ****** failed to address my concerns rationally or professionally. Her refusal to engage constructively escalated the situation unnecessarily. The fee was only added well after this conflict arose, further underscoring the lack of transparency and fairness in how this matter has been handled.
    3.Communication and Conduct Issues
    Communication broke down only after ****** began harassing me. Her approach was neither collaborative nor professional but instead condescending and defensive, which made resolving the issue impossible. Despite raising concerns about her behavior early on, these concerns were not addressed or taken seriously.
    4.Unprofessional Conduct
    My primary grievance remains the lack of professionalism displayed by ****** and the failure of Vader Mountain Capital to appropriately manage the situation. Rather than focusing on resolution or clarity, her tone and behavior created hostility and eroded trust.


    To reiterate my earlier complaint, Vader Mountain Capital has failed to meet reasonable standards of professionalism and transparency. The sudden imposition of a $2,500 fee after the account entered default on November 21st, the dismissive handling of my concerns about Erickas behavior, and the failure to address my complaints seriously have all contributed to my dissatisfaction.


    I expect a more thorough review of this matter and a constructive response that acknowledges these issues and proposes a fair resolution.

    I am rejecting this response because:

    I am writing to address the outstanding balance and clarify my willingness to resolve this matter. I am prepared to pay the correct amount owed, which is $1,099.26.


    However, I request the following before proceeding:
    1.Documentation showing notification that my account had entered default status prior to November 13th.
    2.Evidence supporting the $2,500 default fee applied to my account.


    As noted, on November 13th, ****** informed me that the reason my balance remained $2,644.17 was due to the application of this $2,500 default fee. Prior to this date, no such fee had been applied or communicated to me. Erickas justification for this charge is inconsistent with the accounts history, as it had not entered default status before or at the time alleged.


    I have made efforts to resolve this matter amicably. Should you agree to remove the $2,500 fee, I am ready to settle the remaining balance of $1,099.26.


    Additionally, I must point out that I have grounds to press harder on instances of harassment by ******, if necessary. My preference is to resolve this matter cooperatively, but I will take further steps if required.

    I defaulted on a loan with vader back in January due to unforseen hardship my account was assinged to ********** and ******** for collection I went ahead and contacted them and we negotiated a deal to pay *** of $3999 since I had already paid about $2235 directly to vader.They accepted payments and issued UCC release, I have paid ********** law firm $3000 in $500 *************** balance is $999 and all of a sudden with no communication from neither Vader nor ********** and ******** am receiveing calls from another law firm claiming they were hired by ******* the parent company to collect about $5000 from me and they are threatening to file a UCC ******* asking vader to be fair *** accept my final payment of $999 to ********** **** we have a signed agrement with as a final resoultion to this debt.I would have paid total of $6234 for a principal loaned of $4152 which is the amount I received from vader.

    US Business Grants, a website pretending to act as an official government entity, contacted my business after an application was made. They said they would provide a $65,000 ***** to the business. They said they would provide the ****** after I completed a loan, or what they called, a "Revenue Based Financing Agreement" with Vader Mountain Capital. I was then contacted by Vader Mountain Capital, who set ridiculous terms. I was given $10,000 to then pay back $22,000 over 90 days. 2 Weeks before I was finished paying, they harassed me asking to renew the agreement with even more ridiculous terms. When I contacted US Business Grants, they said I would not receive the ***** until I continued with these new terms with Vader Mountain Capital. I cut off all communication with them and finished paying what I owed. I believe this company to be a front for US Business Grants and should be held liable for the damage they have done to people.

    Vader Mountain Capital is neglecting what my complaint is about. In my complaint I clearly state that I know I signed a Revenue-Based Financing agreement and am fully aware of the commitment I made when I did so. That is fine. I took a contract and I followed through. What my complaint is about and what you are clearly diverting from is the fact that you reached out to me through a third party which was committing fraud by impersonating a government entity. There is no way to reach out to US Business Grants because they are not real. Whether legal or not, your business dishonest and predatory.
