I was misled to purchase from a listing in poshmark.com (poshmark username @huescobarh) just to realize the item was a counterfeit and it might be the result of illegal activities. (Order #******cdb289d20e0644f791). I asked poshmark for a refund and a full investigation of this seller ******************* (poshmark username @**********). I have reported the account and no action has been taken.According to 18 U.S. Code 501, counterfeit stamps commercialization is considered an illegal activity. Both the seller and the third party (in this case Poshmark) are directly liable under US law. I respectfully request both immediate termination of this activity and refund to me and all other customers that have bought from this seller.See the evidence for comparison of valid **** stamps. I am by law abided not to return the item but to report this activity and give the item as evidence to a **** postmaster. Therefore I will not be returning the item as asked by poshmark.Business Response

I am rejecting this response because the business did contact me and closed the case after a tedious back and forth for a refund only after they insisted I returned the purchase (which is illegal to mail being counterfeit stamps). Nonetheless I requested the profile with alleged illegal activity (@**********)to be closed permanently and to follow up on this and similar activity on their website. They didn't, They said they blocked the user but the profile is still up with many followers and what is worse, there is no record of previous activity to alert other buyers (previous and future) about this illegal activity(nonetheless I screenshotted many of the "reviews" as evidence of what happened - attached). I have contacted the ********************** and they will also investigate. This is a shame. Their website should follow up and start a criminal investigation of this person. They also should refund every person who fell for this scam.

I am rejecting this response because: Poshmark Moderation Team might have addressed the situation but did not resolve it. As you can see in the evidence, the account is STILL active as recently as Oct. 17. In fact there is a review of yet another user that fell for the scam on Oct. 18. The account needs to be closed permanently and the user investigated with all the information Poshmark has from them. All the buyers need to be refunded and money recovered. Once again, this is the result of ILLEGAL activity (per 18 U.S. Code 502). The US ************************* and its ****************************** have been alerted and have begun an investigation against the user AND ********************** LLC. If you have fallen victim of counterfeit stamp scams call them at ************.

I am rejecting this response because:immediate action on a case opened directly with the business over 10 business days ago does NOT mean immediate. Besides, even if the changes and outcomes are not visible to the user, the petition and request to closed the account and make it inaccesible to other costumers as well as allowing users to keep interacting with this account does not mean sufficient action. No refunds or communication to other customers took place. This case is far to be closed. Close and make the account inaccesible and I will considered the case closed.

Hello, I sold a very good condition authentic Chanel medium double flap bag to a buyer: @tamarov on Poshmark on 9/16/22. The images and description of the bag on my listing were exactly the condition the bag was shipped out to Poshmarks headquarters for authentication. Any and all imperfections were listed and photographed in a very detailed manner. The bag was shipped on 9/16 and was received by Poshmarks authentication team on 9/18/22 tracking: **********************. The authentication took until 9/23/22, was authenticated and shipped to the buyer on 9/26/22, and the buyer received the package on 9/28/22. The buyer reached out to me stating there was light surface scratches on the leather that were not there in my photos (or when I shipped the item). I informed her that I did not inflict this damage and she opened a case because she wanted Poshmarks to pay for the damage, because they caused it during authentication. She included very vague photos of her proof and Poshmark has had this case in review for 5 days. I was supposed to have my earnings ($2480.00) released within 3 days (10/1/22), as this issue was not my fault. I have reached out to Poshmark Support twice, and through the conversation in the case, but they will not respond. I believe this buyer (who also sells Chanel bags in much worse condition than the bag I sold her, at a much higher price) is attempting to scam Poshmark into giving her her money back, and potentially returning to me a bag that she or Poshmark knowingly damaged. I have included all correspondence between myself and the buyer, as well as Poshmark. I need Poshmark to release my earnings, as I provided excellent customer service, as well as a well documented, authentic Chanel bag, for a fraction of the going cost. This case is between Poshmark and the buyer, not me, as the bag was authenticated and verified by Poshmark prior to them shipping it to the buyer. Poshmark headquarters received the item/bracelet on or about 9-17-22. After Poshmark headquarters authenticated the item/bracelet it was mailed to the buyer. On 9-26-22 there was an attempted delivery to the buyer by the **** with no response from the buyer. The buyer received notice that the item/package was available for pick-up. I have reached out to the buyer several times and she has stopped responding (I have a log of our messages before and she was very responsive up until the bracelet was delivered). I have reached out to Poshmark with no response. I have done my part to sell and ship the bracelet as promised.
