I contacted Guardian Litigation Group to help with consolidating my debt. They told me that they would negotiate with my creditors to settle my debts, and that I would pay them one monthly payment and they would distribute the funds to my creditors. I was quoted a payment amount. After one payment was made, they contacted me saying that they had settled one debt and that my payment would be going up by $200 a month over what I was quoted. The debt with that creditor was never paid. Fast forward 5 months and none of my other debts had been negotiated at all. When I told Guardian that I wanted to cancel, they told me I owed them $1800. They did not do what they said they would, so I told them I refused to pay. Then a couple of months go by and I decided to go ahead and pay them to get it off my credit, and now theyre telling me I owe them over $3200. I asked for them to provide a written statement as to how they arrived at that number and was told they could not do that. Im not blindly shelling out over $3k without knowing what its for. Bottom line is that they did not provide the service they were contracted for.

Thank you for the opportunity to reply to ****************.  She retained us to negotiate and settle certain unsecured debts.  Unfortunately, our firm had to disengage from the agreement after she stopped making deposits to her set aside savings account.  Even though **************** only made 1 successful deposit out of 5 attempted deposits, we still managed to negotiate a settlement on her largest single debt.  She contracted our firm to settle $18,765 in debt for her. Within the first month of the engagement, we entered a settlement on $12,010 of that debt.  **************** explicitly authorized the acceptance of that settlement via text message.  Her single cleared deposit was applied to that debt and our firm was paid $3.20.  She was provided a full accounting statement which reflects these amounts from the administrator of her set aside savings account, Forth Pay.  **************** program was progressing incredibly well, and we would be happy to welcome her back so we can finish the job we started.  We do not charge our clients a fee until we settle.  Regardless of what she chooses to do, we wish **************** the best in getting debt free.

    Customer Answer

    Date: 04/05/2024

I have formally asked for an itemized statement of how Guardian arrived at the $3245 they say I owe them (after I was first told $1600). They let my debts get behind over 4 months, effectively sending my credit score from 600 to 430. They have not complied with my request for a mailed statement. I also asked for them to send a letter to one main to let them know that I am no longer working with them. I was told it would take 2-3 business days. Two weeks have gone by and one main has still not received that letter.  Guardian is nothing but a scam.

    Business Response

    Date: 04/05/2024

    Dear ****************:

Please contact Forth Pay, the administrator of your set aside savings account, at ******************************************* via phone at ************ for the accounting statement you are looking for, as well as online access to that statement.  Forths statement (as well as your regular bank statement) will confirm that you made a single deposit to your set aside savings account, and that most of the deposit was applied to a settlement payment for your debt with One Main.  It appears that you are now contacting One Main directly to reap the benefits of the settlement that we negotiated on your behalf.

You verbally agreed to our contingency fee during your initial quality control call which took place on 9/8/23.  That fee is 27% of the balance of the debt being enrolled.  You also agreed to the fee in writing when you executed the agreement with our firm on 9/8/23.  The negative impact on credit was also explained, verbally and in writing, and you agreed to same.  We have already sent One Main a revocation of our power of attorney.  We wish you the best of luck in getting debt free.  Thank you,

    Guardian Litigation Group

    Customer Answer

No, I SENT ONE MAIN A REVOCATION OF YOUR POWER OF ATTORNEY! I asked for you to send it and was told that it would take 2-3 business days, and then 2 weeks later I had to send it to One Main MYSELF since you lazy humans couldnt be bothered to do it. I was told by One Main that there had been no negotiation, and that as soon as they received a revocation, I could begin to work with them on a settlement plan. The public needs to be informed that they can call their debtors themselves and do the same exact thing that you are SUPPOSED to do on our behalf, but that youre too lazy to do while letting our credit tank and calling us to coach us on basically ignoring their calls.

I signed a contract with Guardian Litigation in April of 2023. They agreed to settle all of my credit card debt for the sum of $40,000.00. I agreed to pay $836.11 per month for 4 years. So far I have paid them $10,032. They have settled two accounts and are paying one down. They have now asked me to pay an extra $500.00 to pay Discover card. I do not have any extra money and struggle to pay the monthly premium at the current rate. Guardian has not settled the Discover card account and now I am being sued by Discover who is threatening to garnish my wages. I am a retired person and have limited income. Guardian charges me $500.00 in monthly fees and states they do not have the funds to pay Discover card. This is a lose-lose for me because so long as they are charging me so much in fees they will not be able to settle the rest of my debt. This is not what I agreed to initially. The contract was I pay them $40,000.00 and they would resolve all my debt. I want a refund I do not trust this company and think they prey on the elderly. Please help me.

    Business Response

    Date: 03/27/2024

    Dear BBB:

Thank you for the opportunity to respond to ****************.  Our firm was hired to negotiate and settle approximately $50,000 of her unsecured debt over the course of an estimated program term of 48 months.  To date, we have placed approximately $26,000 of this debt under settlement for slightly less than half of what was owed.  Most of Ms. ******* deposits to her set aside savings account have been applied to these negotiated settlements. Although she is only 23% into her program term, our firm has already aggressively negotiated and settled 52% of her enrolled debts.   Our firm does not regularly charge her $500 in monthly fees.  Weve allowed for our contingency fees to be spread out over the term of her program.

We are confident that we will be able to negotiate a settlement on the account that **************** has been sued on.  She has already spoken to her attorney, who has appeared in the matter on her behalf, and negotiations with the creditors attorneys are underway.  Our firm has negotiated and settled thousands of similar cases and we ask that **************** remain patient and maintain communication with us while we perform the job she hired us to.  Our firm has a variety of strategies to glean additional time for her to build savings while we negotiate the lawsuit with opposing counsel.  Based on the information provided in her complaint, she is of the belief that she is paying our firm $40,000.  This is not accurate, and we will have our supervisory personnel reach out to **************** to clarify her concerns.  Should she have any other questions we ask that she reach out to our firm directly.  Thank you for your attention.

I pay $836.11 per month for 48 months equals $40,128.00 so I do not understand how Guardian can state that I will not pay the stated sum. This is not true, I will pay over $40,000.00. However that is what I agreed to and do not dispute this. What I am disputing is that Guardian is requesting an extra $500.00 to settle my Discover account. As I stated previously I do not have extra funds. I have recently been diagnosed with Breast Cancer and will be out of work for at least 3 months. Furthermore even that not withstanding I will not pay an extra sum when our agreement is that I would pay $40,000.00 and Guardian would settle all of my accounts. This was carefully explained to me when I initially signed the contract. Also Guardian does charge me $500.00 per month and I have an invoice from FORTH to substantiate this fact. I do not appreciate Guardian stating that what I have claimed is not true. Therefore I would like the BBB to confirm receipt of fax From The Breast ******************** and a statement from FORTH proving that I pay Guardian $500.00 per month. Please provide a fax number so that I may send these documents.

    Business Response

    Date: 04/02/2024

    Dear ****************:

Your previous message stated that so far you have deposited $10,032. We clarified in our response that you 1) have not yet paid the total estimated amount of $40,128 and 2) that you are not paying Guardian this amount.  Please remember that, as we explained when you retained us in our welcome calls, our quality control calls and, in our agreement, that this amount is an estimate based on our previous results for other clients.  It is not a guaranteed amount because individual results always vary.  With that being said, we are still making good progress and your results to date are relatively close to that original estimate.

The additional $500 that was requested from you was for payment of the lawsuit we are settling for you.  From what we see in our most recent notes, after our most recent call you were informed that our firm has further deferred its fee collection for you to help with settling this lawsuit.  The $456 fee that was charged to you in April and March is not the same every month. Our fee collection schedule fluctuates monthly based on each clients settlement payment schedule.  The reason for the fluctuation is to allow you sufficient time to pay the fees you owe to our firm. For example, although weve already settled $25,875 in debt for you, we have only been paid 55% of the fees we are owed for those settlements.  The remaining fee amount that you owe has been placed in deferment so we can help you attain additional settlements.  We trust this message answers your questions. Should you have any other questions, please call in and speak with the Team Lead that weve assigned to your file.

    Thank you,
    Guardian Litigation Group

They guys are predators. They residentially lie to you up front and make false claims like you will see your credit score start to organically increase within 3-6 months of being in the program completely false. They also dont allow you to speak with the attorney that is supposedly negotiating these debts for you. This is due to the fact that they arent actually doing anything but sitting around until your debts all start getting charged off and your credit report is screwed for the next 7 years. They also will engage in predatory finance practices. The Forth group that takes payments has double charged me at times, made blatant lies that the refund will process within 3 business days. However they dont actually ever refund your extra payment. Be very weary if this organization. Youre better off negotiating with your creditors directly as these guys lie about many things. Cant trust attorneys unfortunately.

    Dear BBB:

**************** hired our firm to negotiate and settle approximately $20,000 of his unsecured debt in June of 2023. Since then, he has made 4 successful deposits to his set aside savings account.  Despite missed deposits, our firm has still placed over 25% of his enrolled debt under settlement. Prior to being hired by ****************, we explained to him (verbally and in writing) that there would be a negative impact on his credit and that credit is not our focus.  Our goal in debt settlement is to get our clients out of debt in the quickest, most cost effective manner possible.  Our clients can speak with their attorney about their debt settlement representation at any time, subject to the attorneys schedule.  Based on our file notes, it appears that one of our supervisors spoke to **************** immediately after he filed his complaint with the BBB and addressed his concern. Should **************** have any other concerns, we would appreciate his calling us to address them.  Thank you,

Unfortunately they are lying about the deposits. They recently settle only 1 debt (after 5 months of doing nothing). I accepted the settlement. They collected around $1500 in fees and paid $225 for the settlement. My deposit payment to them is 325 each month. How $325x4=1300 and I was informed I still have a $50 balance in the account. So obviously they are lying and Ive made more than 4 deposits. That alone tells you everything you need to know. They also made a claim they had a chase settlement for me, but have sent me nothing. Probably because they wont do anything until they can drain your account to pay them fees. They arent interested in getting you out of debt, they only work when they can collect a bunch of fees from you.

We appreciate the opportunity to respond to **************** once more.  He has made 4 deposits which totaled up to $1629.50.  One of the 4 successful deposits was for an increased amount.  Eight (8) scheduled deposits were returned due to NSF.  The Chase settlement **************** mentioned was relayed to him and we are waiting on his approval to move forward with it.  Should **************** have any other concerns, we would ask that he contact us and ask to speak with a Team Lead.  Thank you,

My complaint is with the Guardian Litigation Group.-I signed a contract with them that they would be an in between and reduce my debt with American Express.-I have paid them on time for the last nine months -they have not settled any of my debts -and I have just received a summons collection action from ********************* -I was served in front of my children -I have been in constant contact with Guardian Litigation Group. They have assured me that they were coming to a resolution with ***************** which has now turned out to be false and fraudulent.-I would like to someone to help me out to understand who they are and what they are doing with my $11,000 of money that they have collected from me and have been doing nothing.

    Dear BBB:

We appreciate the opportunity to respond to ****************** complaint.  He hired our firm in April of 2023 to negotiate and settle approximately $60,000 in unsecured debt.  Unfortunately, during the months of April through December, ****************** did not maintain consistent communication with us. During the course of our contact with his creditors, we discovered that ****************** was making regular monthly payments on at least 1 of the 4 accounts he had hired us to settle.  Our program is designed for those who are unable to make payments to their creditors because they are in financial hardship and this creditor refused to discuss settlement.  Furthermore, he did not return the documentation we had requested to communicate with 2 of his creditors until December.  We have resent him the document we need for his 4th creditor.  In the meantime, please ask ****************** to contact us and send in all pages of the complaint he was served with ASAP so that his attorney can appear on his behalf.  We are already in communication with that creditors attorney.  Thank you,

I started this program in August of 2022 as a way to help me manage the stress of my debts. I am not proud of how much in debt I became, however, I was a single mom trying to take care of all the necessities my son and I needed to survive. I was aware there would be fees from the services Guardian provided. But unless you fully read all the pages of the contract thoroughly, they do not tell you when agreeing over the phone the fine print. 27% of the ORIGINAL debt for each account entered is what their fees are. Trying to terminate my contract with them has been nothing short of a nightmare. I requested to terminate my contract 2 days shy of a month today. My final payment for fees were taken out of my checking account today and they withdrew the amount I was paying monthly, which I did not authorize. I authorized a smaller payment to cover the fees I owed, less the balance of my escrow account. This payment was also the 2nd time I authorized the smaller amount to be taken. I first authorized the payment on December 1. But the payment was never taken. I called and asked why this was and they said they need to make additional changes to my account to withdraw the correct amount. I asked to make sure the $504.21 was not taken out of my account and it would only be the $390.97. I made sure to only have this amount in my checking account to cover the fee. However, they withdrew more than was authorized, which also resulted in my checking account to be negative. I have talked to countless account managers and I have to go over everything with them again and again and again. Ive been told they are only able to provide a paper check as a refund and I have to trust the check will come and it will be in good standing.

I had canceled out the program to pay off my creditors after paying off three of the four they promised to clear up. The three creditors were paid off in may of 2022, but they have continued to receive payments from my bank account. I have been working with this firm since January to settle my debts , so far its been an absolute nightmare. Been 11 months and they are not able to settle and now coming and asking me for more money. No concern for customer and they do not care . Its a lie that they say they will settle in 90 days . Its been 11 months and nothing . They took the money upfront and now coming back and saying I am short some money to settle . When I asked what happened to my $27K, got generic response that I have to call them , which is a big fat joke . When you call , you are transferred to 10people who have no idea whats happening and they rude . They say negotiators are working , really ????? For 11 months ? My health is affected now and I am stuck without settling .

As of the date of this writing, we are pleased to confirm that we have obtained agreeable settlements on all her debts.  She engaged our firm to negotiate and settle her debts over the course of a 48-month estimated program term and was approved for a debt settlement acceleration loan to speed up completion.  Today, we completed negotiations of the last 2 debts and are waiting for receipt of settlement letters to finalize the payments to the creditors. We do need to wait for those letters to arrive before we can make the settlement payments. This company has been an absolute nightmare to deal with. I have been trying to arrange for a withdrawal from my checking account into my account with ********************, so that they can make my next two payments to a creditor. I have been trying to do this for the past three weeks, with absolutely no success. On Oct 3, they sent me a form to fill out and send back, which I did. Still, the withdrawal did not occur. I called several times and keep having to re-explain the entire situation to the many different account representatives. Last Wednesday, October 18, a gentlemen recorded my agreement to remove the funds on Friday, Oct. 20, which still didn't occur. I called again and did ANOTHER recording and the money should have been taken out today but it hasn't. My payment to my creditor is due tomorrow and I have also sent several email explaining the urgent nature of this situation. Not making this payment will further damage my credit and may even be cause for the creditor to break the original agreement. This case needs intervention because I am very frustrated and worried. Thank you in advance for your time and consideration.

    Dear BBB:

Thank you for the opportunity to respond and clarify.  Unfortunately, ******************** set aside savings account administrator has had issues accessing her authorization recordings and allowing the draft to process in a timely manner.  This is not something that we can control.  However, we can confirm that this will have no impact on the existing settlement that she is concerned with and her requested deposit is already in a pending status.  Our supervisory personnel have already made attempts to reach ****************** and convey this to her.  We ask that ****************** take our call today so that we can explain this to her in more detail.  Thank you for your attention.
