Millennia tax service is a scam! Made a mistake on ERC tax payment and now I am left with a large tax bill. They said they were talking to IRS. That was a lie also! don't use them, if you do do not use the money for a year at least. They work in the grey areas and leave you to handle all the problems. Calen and ***** are liars at best.

            Millennia Tax Relief, LLC Response

            03/03/2024

We are a tax firm with substantial experience processing claims for ERTC. Please note that we were a well-established business before ERTC and will be a business after ERTC. We are not one of the hundreds of companies that popped up during ERTC to take advantage of the income opportunity and have now disappeared.ERTC has always been problematic. Since the program started it has been subject to multiple revisions and different presidential administrations, to the point where, at one time, the main *** *** web page started by saying "Please note that information on this page *** not be up to date". This is the guidance that tax professionals were given. In many areas, *** Guidelines were vague, and most *** agents were not clear on the rules. Every single one of them you talked to had a different "opinion" of what the rules were, what the processing timeline would be, and what was actually taking place on any given case. From the standpoint of a tax firm, nothing ERTC was standardized within the **** Even the *** Auditors, who should be the most educated, familiar, and clear on the program guidelines were left speechless many times when asked for specifics on different parts of the program. To this day *** auditors are still not up to date on all of the *** guidelines. *** is a government program, an *** program. If we as tax professionals cannot get exact rules and regulations from the creators of the program it is destined to have problems and require subsequent changes. On Sept 14, 2023, the *** initiated an ERTC moratorium, halting the processing of all new applications for the program. From first-hand experience, we can say that the moratorium not only stopped the processing of the new applications, it stopped the processing of all applications, and to this point, we have seen no indication that the processing of *** claims has resumed back to normal. Why did the *** initiate the moratorium?According to the ***, there were multiple reasons for the moratorium:1) They were overwhelmed with a backlog of approximately ******* filings that had not been processed yet,2) ************ a mandatory training program to educate *** Advisors,3) To Clarify the guidelines, and 4) To increase the quality of compliance reviews of filings submitted As of Sept 14th, the *** rolled out a completely revised *** FAQ section which clarified their position on many of the areas where confusion lay in the guidelines. You can view that section on the *** website: ********************************************************************************************** Note that most of it was revised as of Sept 14th. What is on this page does not constitute all of the changes and clarifications that were made. It is the tip of the iceberg of the totality of clarifications, but it does give you an indication of the number of clarifications made starting in Sept 2023, 3.5 years after the initiation of the program. We completely understand ************* is not happy with the situation, we aren't either. These changes and clarifications affect our clients, our reputation, and of course our revenue. While I understand that ************* is concerned about his specific case, this is not an isolated incident. this is something that affects every company industry-wide, not just Millennia Tax. While the specific clarification that affected ***************** claim only affected a small fraction of our clientele, We know of one company that received ***** similar letters. When we found out about the change, we notified all of our clients promptly while we investigated and discussed the issue with the **** After those discussions, we notified the affected clientele that it was our opinion that they should comply with the *** request for a refund of overpaid funds. We also informed them of other events that *** reverse the current understanding of the guidelines. There have been several lawsuits filed against the *** that address changes the *** has made to ERTC Guidelines that could reverse this issue. The suits allege that the *** improperly restricted the availability of *** payouts based on unlawfully enacted legislative rules in violation of the Administrative Procedures Act and that instead legislated improperly through guidance documents. Among those unlawful rules, are ***-published guidance documents that fundamentally narrowed the *** statutory scheme, thereby prohibiting otherwise eligible small businesses from recovering the *** payouts to which they are entitled. We communicated to all affected clients that we would, without exception, reimburse the percentage of our fees collected corresponding to the amount of the requested *** refund. This was made clear to *************, at which time he declined. What ************** wanted was what amounts to an unreasonable amount because "he spent the money". While we completely understand that no one wants to send funds back, we also understand that ************** received an additional $150,000 that he would never have received had it not been for our efforts to educate small business owners on the program.************* says he now needs to get a loan to repay the ***, etc. The *** has made it very simple for businesses to pay back the funds. They can go to the website listed on the letter he got and in 10 minutes start a payment plan for the repayment of the funds. Note that there is no credit check or credit reporting on an *** pay plan.Every other client that we have that was affected has been completely understanding of the situation, except for **************.Our offer to reimburse ************** for 100% of our fees collected corresponding to the amount of the ***-requested refund still stands. If he is accepting of the returned fees, we can send them via *** the same day he communicates his acceptance.
