July 27, 2024 Received letter in the mail urging me to call to confirm my "eligibility" for a service contract when my "factory warranty" expires on my car. The letter references the correct year, make and model of my car (which is a ***** The letterhead and letter itself is written in a way which strongly implies that it is from *** or, at the very least, a company affiliated with ***, even though it is not. It does not provide a return address, website or company name, other than stating in fine print a the bottom that "all service contracts are through Evercare Direct." It is obvious that the letter is written with three principal goals in mind: (1) convince the reader that it is from *** or a *** dealership, (2) create a sense of urgency, using words such as "TIME SENSITIVE," "YOU HAVE NOT CONTACTED," "still may have time left," "before it's too late," "this may be our only attempt to contact you," etc., even though there is no such urgency, and (3) create a sense of significant negative consequences if the reader does not take action, using words such as "neglect," "financially liable," and "protect your vehicle," which is only true in the sense that there is always a risk of needing vehicle repairs, but not true in the sense that the reader has "neglected" to do something that he or she should have done. This appears to be an actual business that sells vehicle repair warranties, but it is incredibly misleading and deceptive marketing, which may be in violation of the Texas DTPA and/or the *************** Code.Business Response

I have been receiving letters that look like they are from my car company. My car company name is in the top left corner of the mailing. This spot is historically reserved for a return address. This is misleading. Then the letter states that I dont have a vehicle service contract and will be responsible for paying repairs. However, I do have a vehicle service contract for the vehicle referenced in the letter, just not with this company. This letter makes it sound like there is a problem with my existing contract. In small print on the bottom right of the letter it identifies Evercare Direct as the company providing the contract. This company should not be allowed to tell me I will be responsible for my repairs because I have a contract with someone other than them. This is deceptive practice. I should not have to call their company to get them to stop sending these letters. I want nothing to do with this company. This company should stop using deception in their advertising. Thats what the letter is, its an advertisement scaring people. Stop sending these letters.Business Response

I agree that you should remove my name and contact info from your list. However, it is absolutely not true that I would be responsible for my car repairs if I did not accept your marketing offer. My current service contract with someone other than your company would cover my repairs. You should not be using scare tactics on peolpe who may think their current contract is in jeopardy. You should not be putting the recipients car company in the top left of the mailing, making it look like the mailing comes from their car company. Its shameful.Initial Complaint

I have received multiple letters in the mail from a company that claims to be ever care direct which is an auto warranty company that is sending out predatory letters. It urges me to contact them before August 1 2024 and says that I have not contacted them regarding my vehicle service contract. It shows my personal information about my car at the top of the letter and gives an 888 number at the bottom of the letter signed by ***********************. This morning starting at 8:25 a.m. Eastern Standard Time on 7/23/24 I called the company and told them to take me off their mailing list for false advertisement. I am not with their **************** nor have I ever been with their ****************. This letter and continued contact from this company is unwanted and unnecessary and is predatory and seeking to get funds by false statements. It should be reported to the *** which I will do today. The first gentleman hung up on me. The second time I called I got a quote unquote manager. He stated for me to not call their company again. This is after I asked for them to take me off their mailing list for false advertisement. He stated that none of their letters were false advertisement and that they would not speak to anyone who stated so and again warned me not to call the company again. Again brutal tactics from a false company attempting to collect fees from unwary buyers. Extremely predatory letter. This company needs to be shut down for false advertisement. I then called back a third time as the manager on the second call hung up on me as well. The third time I got someone who I warned them immediately you need to get a new job because I'm going to shut your company down. False advertisement is not acceptable nor is it wanted by myself or my address. I did not seek contact with this company in any way shape or form. And I'm going to report you to the *** and the BBB. I am so tired as an American citizen getting predatory letters such as these from quote unquote auto warranty *****Business Response

I have received a letter (solicitation) regarding the expiration of my warranty on my 2023 Chevrolet Camaro. This car has a factory good for 3 years or ****** miles. This car has ***** miles on the odometer. This is a scam; the letter has TIME SENSITIVE stamped across the top. This letter is misleading, this letter is fraudulent and Evercare Direct should not be allowed operate in this manner. There is a statement, "plenty for private use", $300, there should be plenty on Evercare Direct owed to me for their constant bombardment of solicitations via the United ************* Services. Additionally, the Federal should arrest and charge Evercare Direct with criminal activity for mis-using the ***************Business Response

Sending scam mail to me about a car that's not even in my name. If you have to use public records to find clients, you are clearly not a legitimate company. Telling me that I NEED to contact them immediately about my vehicle's service contract. Only says the company name in extremely tiny print at the bottom. If you are trying to hide your company name, there's another hint at not being a legitimate company. Stop scamming people by sending them these pieces of mail. It's unethical and scummy. This company needs looked into and shut down.Business Response

The only company name on the letter I received was your company. In very tiny print at the bottom of the letter. Nowhere does it have the name of any other company. You've said in responses to other comments on here that YOU have sent them the letters and that YOU receive your clients through locating public information. So don't try to lie. Pick one or the other, you can't have both.Business Response

I work for ****** North America HQ in ********, ** and am offered corporate leases. With each lease renewal I get, I receive some notification that my warranty may soon expire or has expired. These are brand new cars with 0 miles on them! I'm not sure how this company is notified of the registrations of the vehicles, but with each car I have taken delivery of (3 different cars, typically every 6 months) I get these ridiculous notices needing my response. Calling them to be removed from mailings does nothing, as they cannot answer as to how they get their registration info. There has to be a way to stop receiving these notices but I have not found a way of opting out of my information being sold to these companies.Business Response
