This account is listed as a charge-off which is a certificate of indebtedness. I am sure (ABLTY RECVRY) has filed a 1099c. Income cant be reported on a consumer report. My privacy was violated as per the Privacy Act 1974. This account needs to be removed from my consumer report. Privacy Act of 1974 (5 US Code 552a) Any and all consent to Equifax, Experian, and Transunion whether it be verbal, non-verbal, written, implied, or otherwise is revoked. 15 USC 6802 (b)(c) states that A financial institution may not disclose nonpublic personal information to a non-affiliated third party unless the consumer is given an explanation of how the consumer can exercise that non-disclosure option. You never informed me of my right to exercise non-disclosure option. Not only that 15 USC 1681C (a)(5) states Except as authorized under subsection (b), no consumer reporting agency may make any consumer report containing any of the following items of information any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. ABILITY RECOVERY SERVICES LLC (ARS) opened on ABILITY RECOVERY SERVICES LLC (ARS) opened on February 2024 account number D727****** continues to try to extort monies from me when no monies are due. They're attempting to collect on an alleged debt. I HAVE NO KNOWLEDGE of the account or any purchases on the account. I have reported this to the appropriate authorities, & the **** as fraudulent and Identity Theft. I have never done business with them and not sure how they even got my personal information. I contacted *********************************, CEO, by way of Affidavit sent Certified Mail Return Receipt Requested with an Affidavit of Mailing. They've obtained my information by way of Identity Theft, O.C.G.A 16-9-121. Punishing me for non-repayment of an alleged debt by extortionate means by furnishing nonpublic information to third parties without my consent is a violation of 18 U.S. Code 894 and 20yrs in prison. I've requested verification of the debt in the manner of an Affidavit, whereby one has first hand knowledge of the alleged transactions, and swears to the truth under penalty of perjury that I indeed owe them money. They've failed to rebut the Affidavit point for point. No such documentation exists from ARS. I hired *******************************,Witness, Notary **************** of the State of Georgia, who is not in receipt of any Sworn nor Commercial Affidavit that would substantiate any of their claims. In accordance with law, ONLY sworn affidavits, oaths, and depositions qualify as a verification of the lawful existence of a debt. For their convenience, an Affidavit has been included so that *********************************, CEO, can accept full liability & bind the company and sign and return said Affidavit to the Notary Public mentioned herein to demonstrate an act of good faith. Ability Recovery Services, LLC (ARS) has received and reviewed the above identified complaint. Three medical accounts were placed for collection on June 5, 2024. Only the account subject to this complaint is on the consumer's credit report. A Regulation F letter dated June 7, 2024 was mailed to consumer providing all information needed to identify the medical debt and to provide the consumer her rights under federal collection laws.
The consumer subsequently, upon the account at issue appearing on her credit report, filed a complaint with the BBB to state that the account was not owed to ARS. ARS immediately updated the bureau reporting the account as disputed by the consumer and consumer was provided with additional information.
ARS is a third party collection agency that is under contract with the Current creditor to provide collection services for medical accounts placed with us. This means that *** has the right to attempt collection of the debt directly with consumer. Further, as additional protection for each consumer with a medical debt placed with us, *** signs a ******************* Agreement with the Current creditor wherein *** agrees to comply with all privacy rights to the consumer under HIPAA.
Again, the action requested by consumer was to correct credit report. *** did properly update the account as disputed and provided back up for the medical debt. Additionally, this response explains why *** has a right to collect the debt at issue. Any payment made by the consumer will be processed by *** and forwarded to the current creditor to either pay in full the debt or reduce the balance, if full payment is not made.
ARS invites the consumer to call us directly to discuss options that the current creditor has provided to us in terms of settlement of the debt as an effective way to have the account removed from the consumer's credit report.

They have been dishonest.I have not been notified of anything from this company.
This is on my credit report twice. Under 2 different creditors. One with original date of the charge and original creditor named. See their attachment showing the same information as already reported on credit report.

This is a medical bill from 2019 that does not belong to me. And has hurt my credit score because their actions.

Upon checking my credit report I see I have an open balance of $985 with this company opened April 06 2024. It does not show what type of account this is regarding this "collection attempt". I have not received any type of communications via my email or phone number regarding any finance owed, what is this balance supposed to be for? Failure to properly notify of me of this alleged debt, they violated the Fair Debt Collection Practices Act(FDCPA) ******* Notice for validation of debts. Part two of my response to why I'm rejecting their response :
Ability Recovery System have yet to address my debt validation letter that i sent more than a month ago to them, and they also haven't address my response to the fact they sent the collection letter to the address *************************************** in which I have no relation to nor any of my family, as we moved out of there in 2016. My current address for the past 8 years is *********************************************************************** as shown in my attached bank statement. Them furnishing my credit, without any proper notice violate the Fair Debt Collection Practices Act(FDCPA) ******* Notice for validation of debts and is considered fraud under both Federal and State Laws. I'll not hesitate to take legal action againts them if they fail to remove this collection from the three major credit bureaus Experian, Equifax, and Transunion, and give me a proper notice with my signature agreeing to pay the alleged debt of the creditor.
