Refund and Exchange Policy

1. Right to Cancel (3-Day Rescission – Florida Law) In accordance with Florida law, certain home improvement contracts may include a 3-day right of cancellation (“cooling-off period”). The Client may cancel this Agreement within three (3) business days from the date of signing. Cancellation must be submitted in writing (email, mail, or hand-delivered). Cancellation is effective upon delivery or postmark date. ?? Florida law requires this right in qualifying contracts and mandates written notice to cancel. 2. Refunds Within the 3-Day Period If the Client cancels within the legal 3-day rescission period: 100% of all payments will be refunded, EXCEPT for: Materials already purchased Work already performed Permit or administrative costs incurred Refunds will be issued within 10–30 business days after cancellation. 3. Deposits & Scheduling Protection (AFTER 3 DAYS) After the 3-day cancellation period: Deposits become NON-REFUNDABLE Deposits are used to: Reserve scheduling Cover administrative costs Secure labor and materials This is critical because Florida law allows enforcement of contract terms after rescission expires. 4. Cancellation After Work Has Started If the Client cancels after work has begun: Client agrees to pay for: All labor completed All materials purchased (including custom-tinted paint) Any scheduled labor costs or lost production time No refunds will be issued beyond the unused portion of the contract balance. 5. Contractor Non-Performance (Florida Protection Clause) If Refresh Painting LLC: Fails to begin work without justification, OR Fails to perform within a reasonable timeframe, The Client may issue a written demand. If unresolved within 30 days, Client may request a refund of unearned funds. ?? Florida Statute §489.126 supports refund obligations when work is not performed after payment. 6. Material Orders & Custom Products All custom materials (paint colors, specialty coatings, cabinets, etc.) are NON-REFUNDABLE Once materials are ordered or tinted, they cannot be returned or refunded 7. Chargebacks & Payment Disputes Any unauthorized chargeback will be treated as a breach of contract Refresh Painting LLC reserves the right to: File a mechanics lien Pursue collections and legal action Recover legal fees and damages 8. Weather, HOA, and Delays Delays caused by: Weather HOA approvals Material shortages Client scheduling changes DO NOT qualify for refunds 9. Refund Processing Timeline Approved refunds processed within 10–30 business days Refunds issued via original payment method or company check 10. Agreement to Policy By signing the contract, the Client acknowledges: Understanding of Florida cancellation laws Agreement to this refund policy Waiver of refund rights outside stated condition
