In June 2025, I signed financing paperwork with Foundation Finance Company LLC for a $15,711 bathroom remodel. After signing, I discovered that the total repayment amount would be nearly $38,000 due to an annual interest rate of *****%. This interest rate was never clearly explained to me at signing, and I was not shown a complete breakdown of the total cost of the loan.I believe this constitutes predatory lending, as I was not fully informed about the excessive interest or total repayment obligation. The loan nearly triples the cost of the remodel, which I would not have agreed to had I known the full financial impact. I feel the terms were deceptive and unfair.I am requesting an investigation into the financing practices of Foundation Finance Company LLC and that they reduce the interest or offer a fair settlement based on the original amount financed. I have also sent a formal dispute letter to the company requesting resolution.Business Response

Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed
To Whom It May Concern,
Thank you for your response regarding Complaint #********.
While I acknowledge that I signed financing paperwork with Foundation Finance, I respectfully disagree with your claim that the terms particularly the true cost of financing were clearly disclosed or understood prior to signing.
At no point in my conversations with your representatives including during the June 26, 2025 recorded call was I told that I would ultimately be paying nearly $38,000 on a $15,711 loan. I was never provided with or clearly walked through a full disclosure of total interest charges in dollars, nor a payment schedule reflecting that full amount. Simply stating a *****% APR is not meaningful or fully understandable to many consumers unless it is paired with real-world totals.
Instead, I was told only about the monthly payments, not the extreme interest and long-term cost. This is not a sufficient disclosure under the spirit of consumer protection laws, especially given how steep the finance charges are.
I still believe this constitutes unfair or predatory lending, as I would never have agreed to pay over $23,000 in intereston a $15,711 loan had this been made clear to me. I am again requesting a resolution, including:
A reduction in the interest rate to a reasonable level;
A principal-only payoff;
Or cancellation of the financing.
I also reiterate that I am prepared to escalate this through further consumer complaints and legal review if necessary.
Respectfully,

I am filing a complaint against Foundation Finance Company for ongoing inaccurate, misleading, and possibly fraudulent credit reporting regarding an account that was charged off in 2020 but continues to be updated monthly through 2025 with a balance that has ballooned far beyond the original high balance.The account in question:Was last paid in August 2019 Was charged off in early 2020 Was closed in September 2023 Is still showing balance updates as of April 2025 Now reports a balance of $31,292, despite a historical high balance of $18,700 These updates are being reported to the major credit bureaus (********** confirmed), despite the account being inactive, closed, and long past default. This appears to be a form of re-aging, in direct violation of the Fair Credit Reporting Act (FCRA).---Violations Identified:1. Inflated and Unverifiable Balance Foundation Finance is reporting a post-charge-off balance increase of more than $12,000 with no documentation, agreement, or legal basis provided.2. Improper Re-aging Monthly updates after charge-off and closure are misleading and appear to extend the time negative data remains on my report.3. Failure to Provide Validation I have never received an original signed agreement, itemized ledger, or accounting of the fees and interest claimed. This violates FCRA 609(a)(1).4. Harm to Consumer This inaccurate reporting has materially affected my credit score, financial reputation, and ability to obtain fair credit.Business Response

I got behind on the Foundation Finance, (**), loan payment, (pmt.) in May 22 , 2025 due to an electric bill that was over $500 for one month of service. I had surgery on **** 5, 2025 & was recuperating. I am also disabled . During this time ** did reach out and I did speak to a ** ***resentative, ****** prior to **** 21, 2025. I told the *** I would make a pmt. on **** 21. On **** 21, 2025, I made a pmt in the amount of $425.00. My regular pmt amount is $317.00 before late pmt of $40 which is $357.00 for the month of May. The remaining $93 went towards the **** pmt. About 2 days after making the **** 16th pmt I spoke to another ** *** & this *** asked me when I'd be able to pay the remaining balance for the **** pmt. At this time I told the *** I would pay **** pmt by the end of ****. I asked if I could change my pmt due date, as I don't get a check until the 3rd week of the month & was told I had to be current in order to change the pmt due date. On Saturday, **** 28th I received a letter from ** informing me that a *** fixture filing on the collateral, my home, had been filed. On **** 30th I spoke to a ** ***, ****. I asked her if that *** fixture filing would be lifted when I paid the outstanding amount of $224.65. She advised the *** fixture filing would remain. I asked the ** ***, ****, why this *** fixture filing had happened ***** she said ** could do this because it was in the contract & could file anytime during the loan contract. I asked her what I had to do to remove this fixture filing. The *** said I had to file a subordination filing or pay off the entire loan of over $20,000. After speaking to this *** I paid the remaining **** balance of $224.65. I have never had any liens on my property. I am sickened to discover this *** fixture filing will be on my credit ***ort & will inhibit future lending, including lending to pay off this ** loan. ** did not send me any notices/warnings that were certified or certified mail w/ return receipt. Foundation finance is not applying our total payment to our account. It is not reflected in the balance or the interest payments. This company seems to be a big con. You can't find any info, like your interest rate or a breakdown of your account online or on your statement. Some months the interest is $8, then others it's $27?! Only about half of our payments seems to be going to the balance and interest. Where is our money going?Business Response

In April 2024, I contracted with a roofing company to replace my roof, install reflective material and blown in insulation. The work was complete in May 2024, the price, $46,254.25. I have been paying $1,000.00 per month for the past 10 months, higher than the required amount. These payments are not correctly shown in reduced costs. I continue to receive a message on my bill stating 'You must pay off the promotional balance in full to avoid charges". I do not know what promotional program I am paying or the additional charges. Statements don't make any sense, the balance is different every month, In March the statement showed my balance at $41,735.92. I can't find how they are coming up with these numbers. I am writing to formally lodge a complaint against Foundation Finance Company, LLC, located at **************************************. This company has engaged in deceptive and unlawful business practices, particularly concerning its handling of consumer debts discharged through ************* December 2017, I was solicited by a company offering a water filtration system and was subsequently referred to Foundation Finance Company, LLC for financing. However, due to financial hardship, I filed for federal bankruptcy protection in December 2019 (Case No. 2:19-bk-19430 RK). The debt owed to Foundation Finance Company, LLC was properly listed in my bankruptcy petition and was fully discharged under federal law.Despite the legal discharge of this debt, I recently discovered that Foundation Finance Company, LLC has placed a lien on my property without notice or justification. This action is not only wrongful but also a clear violation of federal bankruptcy laws, as well as an abuse of consumer rights. My research has revealed that I am not alonemany other consumers have reported similar predatory conduct by this company, suggesting a pattern of deceit and unfair business practices.Violations of Federal and State LawsBusiness Response

I had solar panels installed by ************************* Contract signed May 2017. The system was finally installed Dec 2017/Jan 2018. I had nothing but problems after that. According to the contract I did not get the full equipment. The system did not get turned on right away. Took over a year for them to figure out it did not get turned on. I did not get reimbursed from anyone. I asked the electric company about what my panels are saving me per month. They could not help me. I tried reaching out to the Company I signed the contract with. They went out of business 2 years later. The manufacture filed for bankruptcy. I called the finance company asking for help. They said there is no one within 200 miles who can service my panels. I asked them if they can waive the rest of my loan off since everyone is in breech of my contract which was supposed to have a 25 year warranty of service to my panels. I dont even know if they are working. They said they can only waive $1000 out of the $6,842.20 that I owe them. Please help!Business Response

My Grandfather was forced into a contract with the company he inquired about the loan and when he was diagnosed the cancer he changed his mind and was told he couldn't back out of the contract was was threatened with being sued. He passed April 30th 2024 and although the company was notified of his death they continue to report late payments on his credit. The property was transferred to me prior to his passing additional the work was not completed as this loan was to replace all the windows in the property. I sent over a death certificate to the company as i did with all his debtors, there was no one else listed on the loan as an additional borrower or cosigner but i assumed the debt, when i notified the company that the property was for sale they threatened to place a lean on the property which could have delayed the sale, i was told by my attorney i would have to pay the debt once the house was sold. Is that debt Transferrable to me? i have since made the payment to the company but they are still reporting late payments on my grandfathers credit.Business Response

We used FF for window replacement, I faithfully doubled up on monthly payments for almost 2 years. One window continually fogs up. Budget Windows has replaced twice now. I don't think its fair that I get charged interest on a job that hasn't been 100% completed to satisfaction. I have called dispute resolution at Foundation Finance with no results. I need the interest accrued date adjusted to when the windows were installed 100% correctly which was last week 11/08/2024Business Response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. Pursuant to the finance contract to be valid the warranty that comes with the windows is enforceable. Due to windows continually fogging up, which is under warranty the finance contract is null and void until the date when windows are installed per warranty with Budget Windows. Foundation Finance needs to redo finance contract from date of properly installed windows. Last month

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appearthe windows were never installed to satisfactory condition. At the time of installation the weather was warm it wasnt until winter weather we discovered faults in the manufacture of the windows Budget Windows acknowledged this and replaced twice so far they are good as to the second replacement about a month ago. We did sign for a complete job not knowing at the time the windows were faulty. A fair compromise is what we are seeking. Doing nothing about it is unfair and unacceptable.
