I recently called JND Legal Administration to get updates on my Equifax data breach case, and the experience was absolutely infuriating. The secretary (******) spoke with was incredibly rude and disrespectful, flat-out denying me any updates on my case. When I asked to speak with a supervisor, she refused and then abruptly hung up on me. This kind of treatment seems typical for this terrible company, and its unacceptable.

      As a member of In re: Equifax ****************** Security ********************** Litigation Settlement Class, ******* Saucedos claims are subject to the U.S. District Courts Settlement Final Order and Judgment.  The Settlement Agreement, along with the Consent Orders Equifax reached with the **** CFPB, and State Attorneys General in 2019, govern the settlement payments. More information can be found at ****************************************************************************************;

As the Settlement Administrator appointed by the Court in this matter, JND Legal Administration may only pay claims that meet the requirements set forth in the relevant Settlement Agreements and Court Orders.  Unfortunately,Mr. Saucedos claim did not meet the requirements for payment.
****************** was sent an Incomplete Claim Notice in October of 2023 stating that according to Equifax's records, he was not a member of the Settlement Class and was not eligible for Settlement benefits.  The Settlement Agreement establishes that Claimants have 30 days to cure deficiencies, once notified of that deficiency. JND did not receive a response to the Notice by the deadline.

****************** has called in and received information regarding his claim on multiple occasions.  He was offered the opportunity to speak to a supervisor on those occasions.  However, he refused at those times.  It appeared from his BBB complaint, that ***************** was requesting a call back. Therefore, a supervisor called him back and spoke with him regarding his claim on July 8, 2024.

I am rejecting this response because:I am rejecting this response because: It has been almost a year and a half since I submitted my claim, and I am have spent considerable time away from my family and money pursuing this matter. All I have encountered are disrespectful representatives who dismiss my claims and hang up on me. One representative called but provided no answers; it was as if he was reading from a script. He claimed to have sent an email, but I have searched all my email accounts and have not received it.

The average American has about three to four email accounts. I simply asked for proof that the email was sent, (forward me the email)  but the representative repeatedly said, "There is no proof to send," which does not support his argument. When I pointed out the flaw in his logic, he became disrespectful, irritable, and angry, attempting to chance the narrative as if  i was personally attacking him and his company. Very unprofessional.  And then hung up on me just like the others. This behavior is extremely disdainful, especially when my concerns are being disregarded. I am still waiting for the alleged email they claim to have sent.

The fully completed claim, along with evidence that the representative lied about my failure to complete it, includes identity verification and a police report highlighting the incident. Additionally, a screenshot of the Equifax data breach website, where one can enter their last name and the last six digits of their Social Security number, serves as further solid proof of the legitimacy of my claim. This evidence is complemented by a signed receipt from the United ********************* upon delivery. Despite their claims that I did not fill out the necessary information, I have numerous documents to prove my costs and time. However, I am unable to upload all of these documents on this platform.

This firm has not returned my many calls or responded to my specific emailed questions and requests for weeks. This firm is responsible for helping the people harmed by Mercedes as they financially benefited from the settlement with Mercedes. I want them to answer my specific questions about Park Place Mercedes benz specifically whether they should be resopnsible for 50% of my car paint repairs since they turned me away during Period II instead of offering a goodwill repair due to extended warranty and whether or not I can take my car to a more affordable body shop.

JND may only pay claims that meet the requirements set forth in the relevant Settlement Agreements and Court orders.  **************** filed two Extended Claims Period claims which each included a claim for "Time Spent" and for "Money Spent".

The "Time Spent" portion of ******************** first Extended Claims Period claim was approved for the maximum 20 hours allowable under the Settlement.  The "Time Spent" portion of ******************** second Extended Claims Period claim was denied because **************** was already approved for the maximum 20 hours of "Time Spent" in connection with her first Extended Claims Period claim. Any eligible amounts (including her "Time Spent" portion which has already been approved) will be paid after appeal period.

I was a member of a class action lawsuit. This was administered by JND legal Administration. The case is noted below.************** Mercedes-Benz Canada, Inc.MB Canadian BlueTEC II Settlement www.BlueTECSettlement.ca Toll-free ************** AKC I sent in all the appropriate paperwork and also had the Mercedes Field measures installed our 2015 Mercedes Benz GLK250, at no cost. JND then indicated they hadnt received our paperwork. Our paperwork was submitted to them, and I feel that due to their clerical errors, they have either lost or misplaced this file.I have all the dated email correspondence, with this company and can provide additional information when requested.Their website is included above for reference to class action settlement offering.

I am rejecting this response because:

As per the various emails that have been sent, we have made this very clear that the appropriate documentation was mailed to this organization.

It is our belief that the company has lost or misplaced or mis filed our application as a member of this class action lawsuit.

We had the necessary field measures retrofitted to our vehicle and submitted the paperwork required to this company in order to be a part of this lawsuit against the manufacturer, that being Mercedes Benz.

This ongoing denial has been very frustrating and we are being viewed as this is our fault, which is a pathetic response to my ongoing concerns to resolve what should have been a straight forward process.

We simply ask for the compensation that is rightfully ours, as per the documentation set out within the class action lawsuit.

      Sincerely,

      ***********************

I am a victim of 2017 Equifax Data Breach. Filed the claim for credit monitoring service at Equifax Data Breach Settlement website. Contacted the settlement administrator and I was told that 2 emails were sent to me in 2022. However, I have never received these emails.Further more, the attached print out from Equifax Data Breach Settlement website shows that my claim is still "under review" as of 2024-05-06, which implies that the emails has not been sent out to me as of today.

      I am rejecting this response

Here are the reasons for my rejection:

      1. Emails Not Received: Contrary to your assertion, I have never received any emails from your business in 2022 regarding my claim. I have thoroughly checked my inbox and spam folders, but there is no record of such communication.

      2. Claim Status: As of May 6, 2024, my claim remains under review according to the status displayed on your website. It is perplexing that credit monitoring emails were allegedly sent out while my claim is still pending after two years.

I have attached a printout of the claim status for your reference. I kindly request a more thorough investigation into this matter and a reconsideration of your response.

      Sincerely,

      ***********************

I am rejecting this response because:

The business claimed that according to their records, the emails were allegedly sent in 2022. However, the business website showed that my claim was still marked as under review as of May 6, 2024. As I have never received these emails, I believe there may be an error in the business record.

If the business can demonstrate that I did indeed receive these emails, I will be more than willing to reconsider my position.

      Sincerely,
