Specifically, Blue Angels Hearing is advertising claims without providing any substantiation such as “If you’d hate to see your own mother get ripped off – like what happened to my mother – you’d understand why I created Blue Angels Hearing", "As a result, my company’s able to offer high-quality, physician-designed hearing aids to fit virtually any budget!", "Key to my new enterprise was assembling a team of amazing hearing-aid specialists here in Seattle who share my alarm at the critical need for affordable hearing aids. Besides providing truly effective hearing aids, our experts are here to give you immediate help, whether it’s for advice or troubleshooting any issues you may have".
According to the Code of Advertising, Advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request. List prices comparisons may mislead the consumer where they are not to a price at which substantial sales of the product have occurred. An advertiser can use a list-price non-deceptively where it does not claim a savings and includes certain disclosures. When advertising, for example, savings of "up to 40%," at least 10% of the items must be available at 40% off. Advertisers may want to include a disclosure of both the minimum and maximum savings available to provide more information to consumers. Advertisers should avoid making unqualified lowest prices claims. One appropriate qualification is to promise truthfully that the advertiser will meet or beat a lower price sold by others.
Despite written requests, as of February 1, 2022, Blue Angels Hearing has failed to substantiate or modify its advertisement.
