    Arizona Attorney General's Office v. Kingsley Management Corporation

    On April 29, 2021, the Civil Rights Division of the Arizona Attorney General's Office (CRD) has filed an Arizona Fair Housing Act lawsuit against Brentwood Southern, LLC, d/b/a Brentwood Southern Mobile Home Community, and Kingsley Management Corporation. Under the Arizona Fair Housing Act, it is unlawful for a person or entity to discriminate against individuals with disabilities in the terms and conditions of their housing. It also is illegal to refuse to provide a reasonable accommodation to a person with a disability if that accommodation is necessary to provide the person with an equal opportunity to enjoy the dwelling of their choice. 

    On April 29, 2019, an Arizona resident with a disability who uses an emotional support animal to mitigate the symptoms of her disability attempted to purchase a mobile home and lease land at Brentwood Southern Mobile Home Community in Mesa, AZ. The resident's offer to purchase the home was accepted, but the business refused to consider the application to lease the underlying land because the resident had an emotional support animal and the home was located in the "no pet zone" of the community. 

    The CRD's lawsuit also alleges that the business refused to provide a reasonable accommodation allowing the resident to lease the land where the mobile home was located. The lawsuit further alleges that the business violated the Arizona Fair Housing Act by refusing to accept the application and refusing to provide a reasonable accommodation because of the disability.

      In November of 2023, I submitted an application to Pecan Lake Mobile Home Community in Wilmer, TX. The manager of this property (Jessica Z*****) treated me with more utter disrespect than I think I have ever experienced. I went from excitement & elation at qualifying to purchase my first home, to horror and disgust at her total lack of concern, communication, and professionalism. Jessica completely ruined my trust in this property as well as my desire to enter into a mortgage for a modular home located there. A representative of KMC (Bateman) reached out to hear more about my experience, offer an apology, and assure me a refund on my deposit. I received an email in January that the deposit would be mailed to the address of the home I was NO LONGER MOVING INTO! I responded by email & proceeded to call the property on January 31, February 14, March 1, & again today. I have yet to receive a call back from KMC acknowledging their failure to apply professionalism, human decency and common sense when issuing my refund. This entire experience has been horrifying. If there is a fine in existence, for attempting to defraud future or non-residents of deposit money by first demanding money orders then treating them so badly they'd never move in in a million years, this business deserves to be hit with it.       Mi madre es una persona mayor ************* que ha sido acosada por Kingsley Management y ********************** en *******, **********. Su salud se ha vuelto tan grave por haber sido acosada y amenazada con el desalojo que ahora se encuentra en estado crtico. Kingsley insiste en acelerar el desalojo y solo pinta su descripcin inexacta de por qu un inquilino es desalojado solo para obligar al inquilino a una venta corta o abandonar su casa pagada. Invert y cuid de la casa de mi madre y obedec las reglas del parque excesivamente abusivas solo para que se aprovecharan de ***** El administrador del parque ha hecho esto a otros y hay varias demandas colectivas. Kingsley est practicando maliciosamente y ver justicia para mi amada madre.My mother is a disabled senior citizen who has been harassed by Kingsley Management and ********************** in ******* **********. Her health has gotten so severe from being harassed and threatened with eviction that she is now in critical condition. Kingsley insists on expediting the eviction and only paints their inaccurate portrayal of why a tenant is evicted only to force the tenant into a short sale or abandon their paid off home. I invested and took care of my mothers home and obeyed ****** abusive park rules only for her to be taken advantage of. The park manager has done this to others and there are several class action lawsuits. Kingsley is practicing maliciously and will see justice for one day.
