I bought a car from ******************** on 27 November 2020 with financing through Exeter Finance. The interest rate for this purchase was at *****%. We have been paying faithfully for the past three years. In May of 2023, I attended a military finance class offered through the military that the Servicemember Civil Relief Act (SCRA) has certain benefits for active duty military personnel. Seeing that I'm currently Active Duty for over 25 years, she looked into if any of those apply to us. It turns out, my home of record ************* provides extra relief for debts incurred during your enlistment as well, to include adjusting your APR to no more than 6%. Once we found that out, we filed the necessary paperwork per the law to all of our companies that we have debt with. To date, we have received favorable responses from all of the companies except Exeter. They have stated that they have sent me correspondence through the mail (which I have never received) that requires me to submit my W2. This is not a requirement for the key provision of the *************. I have been active duty for 25 years and there are no Navy bases in **** so that would be virtually impossible. I am simply requesting that Exeter honor the law in accordance with the key provision of the *************. I'm trying to avoid getting a lawyer involved, but I am willing to, to ensure that this company honors the law by adjusting the interest rate to the required 6% and applying any overpayments/interest accrued back into the loan.Business Response

On July 28, 2023, ******* contacted Exeter to check the status of their SCRA Request. The **************** Representative advised *******, that SCRA benefits have been denied, until the **2 has been received to validate that Urmanic is an **** resident. As of September 6, 2023, Exeter has not received the **2 from Urmanic as requested.
Under separate cover, ******* will receive a copy of the executed Contract and a Statement of Account showing all account activity through September 5,2023.

I am rejecting this response because: First, I was never informed that was denied, I was informed that it was being upheld until Exeter received a W-2 from me. Second, per the Ohio State Guide for SCRA (attached), it does not require the servicemember to submit their W-2 or be a current resident, only that their residency at the time of active duty is from the *************. I have submitted my home of record of entry into military service from the key provision *************. This is a federal document and should suffice to establish my entry into service from ****. If no resolution is possible, then I will be forced to reach out to the military lawyers here in ************ for further action. I thank Exeter for their timely response and hope we can come to a solution before any legal action. Additionally, I provided my original letter and supporting documentation for reference. Additionally, my wife and I belong to an SCRA group on ********* and we were denied outright despite being from ****. I am the service member and the account is in my name. I have provided a screenshot from a conversation from a spouse not from a key provision state and she was approved. I feel this is discrimination at the very least. Vehicle was repossessed in June but I paid to get the vehicle back it has been over three months and I still cannot get the vehicle registered in my name because Exeter Finance please the vehicle in their name and refused to send me documentation to take to the *** so that I can get vehicle plates. Exeter has denied me their consumer reporting complaint, phone number and email address and every single time I call them I get a different response on whether or not I will be able to drive my vehicle. On March 24, 2021, ***** signed a Retail Installment Contract (Contract) for the purchase of a vehicle with CarMax, which assigned the Contract to Exeter. The vehicle was repossessed on May 10, 2023, due to non-payment.
On May 25, 2023, ***** paid the amount required to reinstate the account, and the vehicle was released to ***** thereafter. Prior to the reinstatement of the account, ****** name was removed from the title in preparation for the auction sale. On July 7, 2023, Exeter sent ***** a ***** of ******** (***) to complete and return along with a copy of their drivers license. ***** was advised that the original *** had to be signed to transfer the title back to their name. On July 21, 2023, the *** was resent to ****** address on file.
Exeter received the executed *** and copy of Ortizs drivers license on July 31, ******** title transfer back into Ortizs name was completed on August 18, 2023. We are unable to substantiate ****** claims of being provided different responses or unfair business practices as stated in this complaint. Exeter is committed to providing excellent customer service and apologizes if the services received did not meet Ortizs expectations.

I am rejecting this response because: This took an unreasonable amount of time. I had to pay extra money and utilize resources I do not have! I want reimbursements for all the car services I had to use during this time, the stress this company caused me and also all of my personal belongs were destroyed! Hello the date of the accident was July 6,2023 my vehicle was involved into a totally lost. Where all the air bags deployed. The other party was at fault and their insurance only covered 10k in damages. I informed my insurance company about the matter they was going to pick up the vehicle but the vehicle has been seized by Exeter finance. I have never missed a payment and my car status was current. Exeter repossessed my vehicle without my knowledge base on they stated it was an accumulating fees. So they repossessed my vehicle causing my credit score to drop dramatically over this situation that was totally not my fault. My score has drop over 100 points because of this repossession. I have been seriously injured and have to come back to this I have medical issues and this is making me sicker. I have been transparent with all the representatives and each one just lie to me just for me to continue making making and I have a repossession on my credit score. Hello I was involved in a life and death situation where my car was totaled loss and I was in critical condition the accident happened July 6 2023. I broken my shoulder rotator and my knee was dislocated I had to have surgery procedure. The other vehicle was involved and had insurance. This company Exter financed is robbing clients out of their money and falsely reporting negative results. My insurance company paid for this car to be paid and full they received all payments now I am just seeing there is a balance that is not my responsibility gap insurance paid the difference and they was supposed to backdate the accident from the crash date. On November 8, 2023, Exeter Finance LLC (Exeter) received notice that *********************** (*****) had additional concerns to bring to Exeters attention regarding the complaint filed through the Better Business Bureau on August 22, 2023.
As stated in Exeters response dated October 20, 2023, the vehicle was deemed a total loss as of July 6, 2023. On October 3, 2023, insurance proceeds and *** claim proceeds were applied to the Account. Upon receipt of the *** claim payment, the Account was closed and was reported to the credit reporting agencies as such.
Regarding Davids account balance, *********************** records indicated that ***** made a payment on August 4, 2023, and on October 18, 2023, the payment was returned unpaid by ****** financial institution, resulting in the payment being charged back to the account.
On November 16, 2023, as a courtesy, Exeter waived the remaining balance on the account.

Account number ******* I have my account on autopay. $603.91 is to be withdrawn every month. Exeter didnt withdraw for the month of June. Then July 1st they withdrew $601.91 as scheduled through autopay, they then applied that entire payment toward the interest and none toward the principal. They said it was some error in their bill pay system yet they refused to correct the issue and make the proper adjustments despite my willingness to authorize a payment. I had an issue prior to this complaint where they said I was up to date so autopay didnt withdraw, then they took that next payment and applied it all towards interest. Spoke to their president and was an assured it would be taken care of. **** Im in the same position, autopay skipped a payment because Im up to date. The nice young lady I spoke to to resolve this new issue then told me the reason they didnt take a payment for the first incident was because I didnt have the funds in my account, which is absurd. I have 3 pages on my statement of account, one whole page is of payments being applied and reversed then reapplied and reversed again. Its an absolute mess! What is going on up there?! My principal balance hasnt changed in 2 months but my payoff amount has risen several hundred dollars during these autopay errors.Business Response

In response to Garzas concerns, ***** had autopay setup on the account that drafted monthly. The account was paid a month in advance prior to Exeter undergoing a change in payment systems. Due to the limitations of the new payment system, the autopay will not draft until a monthly payment is due. Unfortunately, this prevented ****** payment from drafting on the date they were expecting.
On October 27, 2023, ***** spoke with a member of Exeters management and was advised the previous payment made had been reallocated to their satisfaction. The payment allocation has been completed and ***** has been advised the next payment will draft by autopay on November 1, 2023.

August 9th and 17th I contacted Exeter Finance to explain hardship situation and was told to sell blood for payment money....Second call was to Mgr who told me to go back to car lot for refinance to no avail.. On July 27 or 28 when I went to ******************** iN ***** I had just received 762 from SSI which I thought was a permanent deposit... I later found out it was a one time payment. This was suppose to be my car payment money...Since then I received 386 only. I have tried to reduce my payment for at least 6 months but Exeter finance told me all my lower payments would only pay late fees of 14 dollars a day... I was put in a hard situation no thanks to the car company and would like my car back before August 28th when a payment of ****** is due that I do not have.. My understanding was the car price of almost ***** was the total price...so I misplaced the paperwork until a couple days ago and saw that your finance company is charging me a ***** finance charge..Would you pay ***** for a 2019 used car.. My income was falsified by the car LOT and you went by what ever forged document you say you received if any... Falsifying documents is a crime as well as using them for your gain. I did not lie about my income the car LOT did... as I'm quite sure you know. Hopefully the criminal justice system will work this out...

Subsequently,on August 11, 2023, a payment in the amount of $243.35 was processed online under ********* MyAccount profile. That payment satisfied the July 20th due date. On August 15, 2023, a payment in the amount of $243.35 was processed online under ********* MyAccount profile. That payment satisfied the August 20th due date. Both payments were applied per the terms of the contract.
We are unable to substantiate the claims that transactions in question were unauthorized by Exeter. As a result, we are unable to process the requested refund.
Additionally,if the payments were initiated in error by ********, they have the option to dispute the charges directly with their financial institution.

Exeter would like to thank *********************** (*******) for the opportunity to address the concerns outlined in the complaint. Exeters success is based on customer satisfaction with our products and services, so the issues presented in this complaint are taken seriously and every effort is made to provide a prompt and equitable response.
Exeter responded to multiple complaints filed by ******* directly, the State Attorney General of ******** and the ************************************ (CFPB) regarding the same/similar issues presented in this complaint. On July 15, 2019, ******* signed a Motor Vehicle Retail Installment Sales Contract Simple Finance Charge (Contract)for the purchase of a vehicle with ************************ (Dealer) which assigned the Contract to Exeter.
******* cites statutes and regulations either wholly unrelated to Exeter Finance or otherwise inapplicable to the circumstances surrounding their account.
Unlike what some may have experienced with a mortgage refinance or home equity line of credit, the
Federal Truth-in-Lending Act (TILA) and its implementing regulations does not provide for a right to
rescission for indirect auto sales finance contracts, such as the Contract into which ******* entered. ******* will remain responsible for the contractual terms which they agreed, including making payments.
As a creditor, Exeter has an obligation to report its consumers account information in accordance with
the guidelines stated in the Fair Credit Reporting Act. The information, including the charge-off, reported
to credit reporting agencies (CRAs) is accurate, and as such, no adjustments are necessary.

I financed a car through Exeter finance. Just over $20,000. I am not exactly the smartest person and thought I was being taken care of. *** Im finding out that the interest rate that Im paying is illegal under usury law. *****% interest. I called and asked if I could lower it because it was technically an outrageous and illegal rate.Exeter flat out told me that they could charge up to 28% and that they didnt know anything about the legal limit of interest rates for car financing. I just want my interest rate down to the legal maximum at the very least. Realizing that they did this to me and gave me such a rate has brought a lot of depressive thoughts. How can this be allowed to happen? Just because I dont know everything under the sun? Please help me. Exeter would like to thank *********************** (*******) for the opportunity to address the concerns outlined in the complaint. On July 20, 2023, ******* signed a Retail Installment Sale Contract Simple Finance Charge (Contract) for the purchase of a vehicle with ********************* (Dealer),which assigned the Contract to Exeter. Exeter is an indirect auto finance company that purchases Contracts from dealerships. Exeter does not communicate with or negotiate Contract terms with borrowers prior to the consummation of the Contract between the borrower and the Dealer.
All required information regarding the terms and conditions of the Contract, including without limitation the APR, was disclosed on the Contract as required by law. The signed Contract shows that all parties agreed with those terms and conditions. The APR charged does not exceed the maximum rate allowed by the *********************** (i.e., where the Contract was negotiated and executed, and whose law applies as pursuant to the express provisions of the Contract). ******** claim that Exeter is charging an illegal APR is unsubstantiated.
Exeter does not offer refinancing; therefore, will not refinance or otherwise change the existing terms of the Contract. ******* may contact any lender of choice to discuss refinancing options.

I am rejecting this response because: I didnt see a 27% apr until I received my first bill. It IS an USUROUS APR. It is over the ************** legal limit and it is an EXORBITANT RATE OF INTEREST. Do see that. There is no sense in paying double for a car. The dealership themselves have already tried to ******* out of paying for the hail damage fix as well as 0 customer service to help. ********************** is the same, everyone on the phone is rude. You cant take advantage of someone that doesnt fully understand all of this due to mental issues.Business Response

While we regret that ******* is not satisfied with Exeters previous response, we believe that the concerns have been fully addressed. I cosigned for a car back in FEB 3rd of 2023. My friend has made the car payments through a 3rd party that they use, and this company has failed to report any of the car payments. Exeter keeps calling me, telling me the car is 59 days past due, when I know the payments have been made by the other party. The other party doesn't send them updates, causing my credit score to drop constantly with their double hits each month that they say the payment is "past due." We have a case open with them, and its been 2 month with 0 resolution on the supposed late payments. At one point when we called, they said WE had to tell the 3rd party to release the information to Exeter in order for them to see the payments. How is this our job as the buyer? They should already be getting this information to them by their 3rd party company.Business Response

Exeter accepts various forms of payment on accounts. The various methods can be accepted via mail, by phone, online,direct transfers, and other third-party services that electronically transfer funds on the customers behalf. Exeter will apply funds received on a customer's account as required by state law and if specified, per their contract. Any outstanding payments handled by a third-party agency would require direct inquiry and investigation with them.
Regarding Reeds credit reporting, as a creditor, Exeter is obligated to report its consumers account information in accordance with the guidelines stated in the Fair Credit Reporting Act, which requires all accounts to be reported accurately and factually to the ************************* (CRAs). Account information is furnished to the CRAs every month and will reflect the status of the account at the time of reporting.
Exeters records were reviewed, and it has been confirmed that the information reported to the CRAs was accurate. As such,Exeter will not honor ***** request to remove the valid late payments from her credit file based on the claims presented in this complaint.
Under a separate cover, **** will receive a copy of their Statement of Account showing all activity over the life of the account. If **** believes there are inaccuracies regarding the payments Exeter has received, they should provide the specific information they are disputing, along with unaltered bank statements reflecting transactions in question. This may be sent to **************************** for further research.
