              I bought a vehicle through ***** Autopark ******* (**) on 1/8/24. ********** offered me financing through Exeter Finance Corp. I bought the car with the help of this financing option, taking out a $6000.75 loan from Exeter Finance Corp. The following day (1/9/24) I contacted my bank (USAA) in order to re-finance this loan with a lower interest rate. My bank offered me an option with a lower interest rate and then purchased the loan from Exeter, by sending them a check for $6100 in the mail. According to the ***** records, **************** at Exeter Finance Corp received this check on 1/12/24. The check was then cashed. Although Exeter cashed the check, the new balance was never reflected in my account. I continue to get notices saying that I have a balance due. I have spoken with Exeter customer service on the phone 4 times, with the most recent call being today, 2/19/24 at about 6:30PM EST. Every time I speak to a customer service representative, they say there is no record of my paying off the loan. I have spoken with my bank who has confirmed that Exeter cashed the check over a month ago. I need Exeter to acknowledge that my debt to them has been paid and to close my account with them. I hope you can assist me in rectifying this situation, thank you.

              On February 20, 2024, Exeter Finance LLC (Exeter) received notice regarding a complaint filed through the Better Business Bureau (BBB).               On January 8, 2024, ******* signed a Retail Installment Sale Contract Simple Finance Charge (Contract) for the purchase of a vehicle with ***********************, ***** which assigned the Contract to Exeter.

              On January 31, 2024, ******* notified Exeter that they were refinancing the account and that a payoff check had been sent in by USAA via ***** and signed for by an Exeter representative on January 12, 2024. ******* was advised that there was no record of the payoff check being received on the account. ******* provided the amount of the payoff check and tracking information but did not have the check number at the time.

              On February 5, 2024, ******* provided Exeter with the check number and after further review, the payoff check was located and applied to Shannons account on February 22, 2024. The account was closed as paid in full as of that date. The payoff check did not include Shannons name, account number, or any other information for ********************** to identify the account to apply the payment to.

              They constantly charge me unknown fees that they refuse to list, change how much I owe daily, and the amount that I pay doesn't even reflect the monthly amount! A few days ago, it said that my February payment was $84. I checked again two days ago and it said $800 with unknown fees added and a late fee. I check again today at it now says $470! WHAT ARE YALL DOING WITH MY MONEY. Last year I dealt with an issue where they expected me to pay 1k for fees that the system randomly added that I should even pay. I had to speak to multiple people before they halfway figured out the issue. At this point, I'm just going to go back to Navy ******************** because at least with them, I know that I'm not getting scammed. I've had my car for almost two years and spent somewhere close to 5k already with my payoff amount not even moving!

              ***** has a Simple Interest Contract, which means interest accrues daily. Exeter applies all payments received as follows:first to earned and unpaid interest, second to principal, and third to other amounts owed under the Contract (e.g., late fees). Late payments, partial payments, and extensions will impact the amount of interest accruing on the outstanding principal balance. Exeters records were reviewed, and it was determined that all fees charged to the account were assessed correctly and in accordance with the contract terms, of which, a portion of the fees remain unpaid.Additionally, all payments received have been allocated properly to the account. 
              Regarding ***** claim that Exeter overcharged in fees, our records were reviewed, and we are unable to substantiate such claims.
              Under separate cover, ***** will receive a copy of their executed Contract and a Statement of Account, showing all account activity through February 20, 2024. Also included, will be a Simple Interest Tool that *** help ***** better understand how interest is calculated and how late payments and partial payments affect the amount of interest paid over the life of the Account. Please be advised that the Statement of Account is available to ***** at any time by logging into MyAccount.ExeterFinance.com.
              During our review of the Account, we identified that the mailing address we have on file for ***** is different from the address listed on this complaint. The monthly payment was ****** APR 28% I made 18 payments until not because of hardship. I contact Exeter Financial to inform them I no longer can afford to make the payment. I ask them for a voluntary surrender to come pick up the car. They said I need to fill out a form which I agree to do and I have not received form. I have call and email Exeter Financial to pick up the car. The insurance company has informed Exeter Financial that the insurance is no longer on the vehicle. Exeter Finance was inform the car location to be pick up. The car is in great condition its running and drives. I can no longer afford the notes.. I have call Exeter Finance everyday they to be put on hold with 3 or 4 people they said it would be 3 more months until pick up. Exeter Finance are trying to build up late fees and interest. I acknowledge I obtain this loan even when I didn't understand 28 % interest is very high. I still with like for them to pick up the vehicle as soon as possible. I did try and sell the car to Carmax but the car is only worth ****** with 75 ,000 miles on it . EXETER hasn't try to contact me anymore after I told them about the voluntary surrender of the car. Exeter has been attacking my credit score with contacting me with a pick up date. I Exeter can I take the car somewhere they told me no it would be label as abandonment .

              Regarding ******* request for a voluntary surrender, Exeters records were reviewed,including phone calls, and it was determined that during these phone calls the line was abruptly disconnected before Exeter could complete the voluntary surrender process with ******.

              On February 14, 2024, and February 15, 2024, a member of Exeters management attempted to reach ****** by phone, yet these attempts were unsuccessful. Additionally,Exeter has attempted to reach ****** via email and by using an automatic dialer. Several voicemails were left requesting ****** to return the call.Exeter is unable to substantiate the claims presented in this complaint.

              As a creditor, Exeter has an obligation to report its consumers account information in accordance with the guidelines stated in the Fair Credit Reporting Act. The information, including delinquent payments reported to ************************* (CRAs) is accurate. Any discrepancies between the information reported by Exeter and what is reflected on Garners credit file will need to be addressed by the CRAs directly, as each reporting agency is governed by their own guidelines and procedures.

              To settle my car loan, I withdrew $7,000 from my retirement savings to ensure that I had the necessary funds readily available. With the intention of making a single lump sum payment, I proceeded to initiate the payment through your platform. Unfortunately, I encountered a problem that prevented Exeter Finance from accepting the full amount in one transaction. As a result, I was compelled to make the payment in three separate installments.While the first two installments went through without any issues, I have experienced significant problems with the third and final payment. My bank confirmed that there were no issues on my end, and I do not have any daily limit restrictions that would hinder such a transaction. Despite my best efforts to address this issue proactively, the payment has not gone through as expected, and it resulted in a negative credit reporting that WAS NOT MY FAULT.I implore you to take immediate action to protect my credit rating, given the circumstances beyond my control and the diligent manner in which I have conducted my financial responsibilities with your company over the years. It is in both our interests to resolve this issue without any adverse effects on my credit. I kindly request a swift and comprehensive response, outlining the steps Exeter Finance will take to rectify this matter and safeguard my credit.

              Exeters records were reviewed, and it was determined that all payments received were applied to the account accurately. ****** account matured on December 22, 2023. Once an account matures, regardless of payments received after maturity, the days of delinquency continue to accrue until the balance is paid in full. ***** should note that the payoff was originally attempted on January 20, 2024, and returned from their bank unpaid on January 29, 2024. ***** replaced this returned payment on January 31, 2024, which paid the account in full. *********************** records indicate that ****** account was 30 or more days past due when the final payoff was received.

              Regarding ****** credit reporting, Exeter is bound by the Fair Credit Reporting Act which requires all accounts to be reported accurately and factually to the ************************* (CRAs).Account information is furnished to the CRAs every month and will reflect the status of the account at the time of reporting. Exeters records were reviewed,and it has been confirmed that the information reported to the CRAs was accurate. As such, no adjustments are necessary.

              I cancelled my gap insurance because I no longer have the car they financed. The gap company gave me all the information about date, amounts, check numbers and references numbers, that they payed to them. The car was payed off and I do not owe any money but they keep claiming they did not receive the check. That money is owed to me and the gap company payed them the money owed to me over a month and a half ago.

              Account has been settled in full since 11/2023. I have had to make numerous calls regarding the Credit Reporting on the account. Agents were not helpful at all and kept giving me the run around. They stated in December and January that it would report accurately and it is still showing a balance of over $7000 dollars. Contacted Exeter again today and was told it would be another 30 days before I have an answer.

              On October 26, 2023, ******** agreed to a settlement for less than the full account balance. The settlement payment was completed that same day. Due to a processing error, the account was not closed until January 10, 2024, after ******** notified Exeter that the account was still reflecting as open with a balance on their credit file. As of January 31, 2024, Exeter has provided an update to the credit reporting agencies to show the account as closed and settled in full as of October 26, 2023. ******** should allow up to 30 days for the update to be reflected on their credit file. Exeter apologizes to ******** for the delay and any inconvenience this may have caused.

              I am rejecting this response because:   I believe the customer service representative's and managers need further training. The reason I state this is because Ive been asked for a call back number and have been disconnected on multiple times due to no fault of my own and never received a call back. I would have to call in again and wait on hold for 20 minutes or longer and be transferred to multiple departments to help with the issue regarding my credit reporting. There have been no notations on the account showing where I have called in multiple times; November, December, and January. Each time I spoke with a representative they would tell me it fell through the cracks and it just happens sometimes and it would accurately report at the end of each month, which it did not. I have worked in Finance/Credit Reporting for almost 6 years and I do not believe this is a fair response to my complaint. I told representatives multiple times I was in the process of purchasing a home and that the derogatory **** on mine and my co owners credit not reporting as settled was lacking our chances of acquiring a better interest rate. Before the reporting was accurate at the end of January, we applied and was approved for a mortgage. Our credit scores since then increased by 60+ points which took us to another tier with having better credit. If this was reported at the end of October as it should have been, I wouldnt have issued a complaint. I believe the issue should be resolved by reporting a paid in full comment to all credit bureaus instead of showing as settled due to the error on Exeters part. Please provide a response to this matter. Thank you.

              While we regret that ******** is not satisfied with Exeters initial response, we believe that the concerns were fully addressed. As previously stated, on October 26, 2023, ******** agreed to a settlement for less than the full account balance. The settlement payment was completed that same day. Due to a processing error, the account was not closed until January 10, 2024, after ******** notified Exeter that the account was still reflecting as open with a balance on their credit file. Exeter has provided an update to the credit reporting agencies to show the account as closed and settled in full as of October 26,2023.

              Exeters records were reviewed, including recorded phone calls. Exeter acknowledges that ******** made multiple calls to resolve this matter, however, we are unable to substantiate the claims that ******** was hung up on multiple times or was placed on hold for ******************************* this complaint. Again, Exeter apologizes to ******** for the delay and the overall handling of the settlement agreement. Regrettably, we are unable to fulfill ********* request for an equitable remedy.

              This section of the law (15 U.S.C. Section 1692f(1)) makes it illegal for debt collectors to tack on extra amounts that arent included in the agreement you entered into with a creditor. That being said, after insurance and gap paid the company for the car, there was $154.00 left on my account. I called to pay the remaining balance and they are trying to make me pay over $2500.00 claiming that the balance is because of interest owed from the previous balance before insurance and gap made a payment. Interest can only be charged on the principal amount on a loan account, but this company is trying to make me pay for interest they didn't get a chance to charge me and had the nerve to offer me a 60% discount of a fee I am not even supposed to pay at all.I have been at odds with this company over the last few weeks. The car was totaled over 2 months ago, it was covered by insurance and gap paid the rest. They constantly tried to get me to make payments on a car that I didn't have any more and they are reporting the full balance on my credit report as of 01/20/24 and the balance at that time was $6,000. This false reporting of this company had decreased my credit rating significantly over the last 2 months and has cost me a lot, hurting my approval rating among other things. At this point the company has not only broken the law as stated above, but they should be paying me restitution for what they've done to my credit rating as a result of false or inaccurate reporting.Their interest rate is already among the highest in the industry for the same credit rating, their customer service doesn't know anything other than how to ask you for money, and there's no way to talk to the credit or accounts receivable department. This company gave me the feeling of a loan shark shaking people down, adding crazy fees and high interest rates. This is absolutely insane and they should not be allowed to remain in business with the horrible results that they deliver to their customers.

              To Whom It May ****************** February 6, 2024, Exeter Finance LLC (Exeter) received notice regarding a complaint filed through the Better Business Bureau (BBB). Exeter would like to thank ************************* (*****) for the opportunity to address their concerns.Exeters success is based on customer satisfaction with our products and services, so the issues presented in this complaint are taken seriously and every effort is made to provide a prompt and equitable response. Exeter has thoroughly investigated the complaint and made the following determination.

              On September 7, 2023, ***** signed a Retail Installment Contract (Contract) for the purchase of a vehicle with CarMax ********************** (Dealer), which assigned the Contract to Exeter.


              Exeter confirmed that the vehicle was deemed a total loss by the insurance provider due to an incident that occurred on December 3, 2023. Exeter provided the insurance provider a 15-day payoff quote. On December 18, 2023, ***** was sent a Total Loss Notification letter, advising that during the total loss process, continued payments would be required according to the original terms of the Contract in order to prevent any negative impact to Joness credit.

              On January 24, 2024, a Notice of Deficiency Balance was mailed to the address on file, advising of the deficiency balance remaining after the insurance and/or GAP payment had been received on Joness account. Interest continues to accrue on the balance until the complete payoff is received.  

              Please note that this is a simple interest account, as set forth in the Contract,which means interest accrues daily and must be collected first out of each payment received. Exeter applies all payments received as follows: first to earned and unpaid interest, second to principal, and third to other amounts owed under the Contract (e.g., late fees). Late payments, partial payments, and extensions will impact the amount of interest accruing on the outstanding principal balance. Exeters records were reviewed, and it was determined that all payments received have been allocated properly to the Account.

              As a creditor, Exeter has an obligation to report its consumers account information in accordance with the guidelines stated in the Fair Credit Reporting Act. The information, including delinquent payments reported to ************************* (CRAs) is accurate. Any discrepancies between the information reported by Exeter and what is reflected on Joness credit file will need to be addressed by the CRAs directly, as each reporting agency is governed by their own guidelines and procedures. Exeter will not honor ****** request to remove the valid delinquencies from their credit file based on the claims presented in this complaint.

              Under a separate cover, a copy of the executed Contract, Statement of Account, and a tool, How Your Daily Simple Interest Contract Works, will be sent to ***** for review.
