      I canceled my gap contract and the dealer is now closed for business. i noticed the amount of the refund credited to my loan. I feel like i have been and am being ripped off by this company since there is nobody that will talk to me about why the refund was put towards my loan and not sent to me. I have been paying this loan since 2019 at an unbelievable interest rate. There is no way to refinance with them and there is no way to pay off the loan without it going to interest. This company is ripping people off and nothing can be done. I want this to be investigated to find out why they are still in business! i have tried to call, message and even live chat and nobody will help me.

Exeter has thoroughly investigated the complaint and made the following determination.

      On October 14, 2019, ***** signed a Retail Installment Sale Contract Simple Finance Charge (Contract)for the purchase of a vehicle with *********** ****************, which assigned the Contract to Exeter. The APR charged does not exceed the rate allowed by the ************** in which the Contract was executed. All required information regarding the terms of the Contract, including the APR were disclosed on the Contract as required by law; the signed Contract shows that ***** agreed with the terms and conditions.
      Regarding ****** Guaranteed Asset Protection (GAP) refund. ****** GAP contract states they will refund all charges to the Lienholder listed.
      Exeters records were reviewed, including phone calls, and we are unable to substantiate ****** claims regarding the level of service received. We are also unable to substantiate the claim presented in this complaint of any violations by Exeter.
      Exeter does not offer refinancing, but ***** may contact a lender of their choice to explore options to refinance.
      Under separate cover, ***** will receive a copy of their executed Contract, GAP Contract and a Statement of Account, showing all account activity through March 19, 2024. Please be advised that the Statement of Account is available to ***** at any time by logging into MyAccount.ExeterFinance.com.

      Exeters records indicate that the Account was settled in full and closed on January 12, 2024.

      On February 1, 2024, Exeter mailed the Vehicles title to ******* at the mailing address on file. On February 22, 2024, Exeter received the title back as returned mail from the ************* **************.Subsequently, Exeter re-mailed the title to the mailing address on file, which had been previously confirmed by ******* as the correct address. On March 20, 2024,Exeter received the title back as returned mail from the ************* ************** a second time as undeliverable. On March 28, 2024, Exeter was able to make contact with *******, who provided an updated address to mail the title to.That same day Exeter overnighted the title via Fed-Ex to the new address provided. ******* was provided the Fed-Ex tracking number for their records.

      Regarding an insurance claim being filed by Exeter, upon confirmation that ******* redeemed the Vehicle from the auction on February 27, 2024, we closed the claim previously filed with ******* insurance provider. As of the date of this response, there are no active insurance claims.

      This is to confirm that a payoff was received on January 17, 2024, and applied to the account. Upon receipt of the payoff, it is Exeters process to send the title release documents to the primary borrowers address unless the payoff check is received with written instructions to send it elsewhere. ****** is listed as the co-borrower on the account and *********************** records indicates that no written instructions were provided with the payoff check.   

      On February 8, 2024, the title release documents were mailed to the primary borrowers address. Exeter sincerely apologizes for any inconvenience this may have caused and for any service you received that did not meet your expectations. On March 19, 2024, Exeter mailed a Lien Release to Drayers address on file. The Lien Release can be presented to the ********** of ***** Vehicles to obtain a lien free title.

      On 02/21/2024 Exeter attempted twice to obtain money from our bank account unsuccessfully. The next day they did it again with a lower amount, and this time unfortunately they were successful. I immediately went to my bank to report this activity as fraudulent. They bank concurred that no legimate company would use this tactic and that it was indeed a fraudulent attempt to obtain as much money from me as possible. Actions have been started by me and my financial institution to get this money back. Exeter already has many complaints I see for being a business with questionable ethics. This activity now seems to be nothing but illegal. Please make consumers aware of these actions by Exeter located in ******, *****. Furthermore, I have never done business or never would do business with this unethical company.

      An Exeter representative spoke with ****** on March 22, 2024, and was advised that ******* financial institution has already begun disputing the transaction. If ******* financial institution declines their request to dispute the transaction, ****** may submit a refund request for Exeter to begin an investigation. To initiate a refund request, we kindly request ****** provide the following documentation:
      An unaltered bank statement reflecting the transaction in question. The bank statement must contain all balance information. A bank statement with marked through or blotted out items is not acceptable. The statement must show a minimum 10-day history from the date the disputed transaction posted. The bank logo and/or name must display on the statement.

      Police report pertaining to the incident.

      I am writing to file a formal dispute regarding inaccurate credit reporting and a disputed charge-off by Exeter Finance. I have attempted to resolve these issues directly with the lender but to no avail. I am hopeful that your intervention can help rectify these matters.Inaccurate Credit Reporting Due to Name Change:It has come to my attention that Exeter Finance has inaccurately reported my credit history to the credit bureaus due to a name change. Despite providing documentation of my legal name change, the lender has failed to update my information accordingly, including accepting payments without applying for my loan. This oversight has negatively affected my credit report, affecting my financial standing.Disputed Charge-Off and Refusal to Provide Documentation:Furthermore, Exeter Finance has erroneously charged off an account without providing adequate documentation or justification for this action. Despite repeated requests for documentation supporting the charge-off, the lender has failed to comply with my inquiries, leaving me without proper clarification or resolution. Exeter Finance continues to run my credit without approval after a charge-off. I have made diligent efforts to address these issues directly with Exeter Finance. Still, their lack of responsiveness and refusal to cooperate have compelled me to seek assistance from the Better Business Bureau. Therefore, I kindly request that the BBB investigate this matter and facilitate a fair and accurate resolution. Specifically, I seek the following actions:Correction of my credit report to reflect my updated legal name.Removal of any inaccurately reported charge-offs.Provision of documentation supporting the disputed charge-off.Thank you for your attention to this matter.       On April 30, 2021, ****** signed a Retail *************************** Vehicle -Simple Interest Charge (With Arbitration) (Contract) for the purchase of a vehicle with ********** ************** I LLC (Dealer), which assigned the Contract to Exeter.

      This is to confirm that the Account was charged off on June 30, 2023, in accordance with Exeter policy and applicable law.  Due to the excessive delinquency, the Account was charged off. Exeter has an obligation to report its consumers account information in accordance with the guidelines stated in the Fair Credit Reporting Act. The information, including delinquent payments reported to ************************* (CRAs) is accurate.Any discrepancies between the information reported by Exeter and what is reflected on your credit file will need to be addressed by the CRAs directly,as each reporting agency is governed by their own guidelines and procedures.Exeter will not honor your request to remove the charge off from your credit file based on the claims presented in this complaint.

      Exeters records were reviewed, and ****** has not requested a name change on the Account.  In order to update the name on the Account for a legal name change, ****** must provide one of the following documents listed below:

      o Court order documenting the legal name change

      o Marriage certificate
      o Social Security card
      o State issued driver's license and/or ID

      So about 2 years ago I bought a truck from **** Redbarn. My work vehicle had blown its engine in ******. I was in a hurry for a work vehicle. My credit at the time wasnt great. Purchased a Dodge Ram 1500. During Covid Id missed some payments juggling house payments, other bills, and food. I took the whatever loan I could ? I just needed to work. Well not very long into the loan I was having engine issues. The seller didnt disclose the remanufactured engine in the vehicle. So I had to buy another engine. New engine $8,000.00 vs rebuilt, $5,000.00 vs used Low mileage $3,200.00.. was up a running left me strapped for floats (driving money), bills, commercial insurance, and other bills. I was juggling making partial payments and trying do what I could till I could catch up. We (me and my wife) still trying to get straight from covid . This might help explain. 2 months before Covid. My wifes contract was cut short. She was on unemployment during Covid. Well I had another engine issue. This model of truck could not maintain high enough oil levels while idling. This was an issue with a lot of ************************* 2016. I was already strapped borrowed the money bought a 2016 engine. Well eventually I could not juggle enough. Truck as repossessed. Well I raised the $3,300.00 to catch up. Payment and get my truck back to work. Well the online payment read my payment ($505.98) was not due to 2-26-24. Today being 2-23-24 I logged in. My payment read $1,600.00 payment is due 2-26-24. There is over $1,000.00 worth of fees for who knows what? How is in any way going to help this situation? Im trying to do the right thing. How is this fair? They also say I need to find another lender. Which is a little difficult but Im trying? That is double my payment in fees. Who is this right? I know my terms were not great but, this is horrible. Please can someone help me?************************* I just want to be able to fairly make a few Payments till I can find a new lender.?

      On October 27, 2020, ******* signed a Motor Vehicle Retail Installment Sales Contract Simple Interest Charge (Contract) for the purchase of a vehicle with ************************** (Dealer), which assigned the Contract to Exeter.

      Exeter acknowledges Parrishs efforts to keep their Account in good standing. Exeter empathizes with ******* and the personal difficulties that prevented them from making their payments on time.

      A review of the Account indicates that the Vehicle was recovered on January 16,2024, due to the Account being in default for nonpayment. Repossession fees are assessed to the Account upon redemption. 

      On January 17, 2024, ******* was advised during a phone call by a **************** Representative (***) that the Account was charged off as of December 31, 2023,and in order to redeem the Vehicle the full balance is due. The *** advised ******* of an alternative, to refinance the Vehicle with a different lender. Due to the charged off status of the Account, those were the two options available to redeem the Vehicle. Upon speaking to a manager, an exception was made for ******* to redeem the Vehicle. The Vehicle was redeemed on January 19, 2024. Refinancing the Vehicle is not a requirement of Exeter. ******* has the option to refinance the Vehicle with a different lender at any time during the life of the Account. 

      Exeter has determined that the Account balance is accurate. The balance includes the monthly payment due on March 26, 2024, late and repossession charges. The late and repossession charges can be paid over the life of the Account.

      Per the terms of the Contract, a late charge of five percent of the scheduled payment will be assessed   when the entire payment is not rendered to the Account within 15 days after the payment is due.

      I have retained new copies of my credit reports, and noticed that Exeter finance LLC did not furnish the credit bureaus with the required disclosure, within the period required by law. Exeter finance LLC are required by federal law to place a "notice of dispute" on my account within 30 days of my dispute, which was signed for on September 7, 2023 at 9:22 AM. I have retained a copy of the signature and date of receipt, as well as a time-stamped copy of my credit reports, showing that they have violated the Fair Credit Reporting Act, Section 623(a)(3) and/or the Fair Debt Collection Practices Act Section 807(8) by not placing the disclosure within the required 30-day period.

      On June 9, 2022, ******* signed a Retail Installment Sale Contract - Simple Finance Charge ("Contract") for the purchase of a vehicle with ***************** ******* ********** (Dealer), which was later assigned to Exeter.

      Exeters records were reviewed, and the information reported to the ************************* (CRAs), was confirmed to be accurate; therefore, no adjustments are necessary. We are unable to substantiate Redmonds claim of any violations by Exeter as stated in the complaint. Exeter will not honor their request to remove the valid tradeline from their credit file based on the claims presented in this complaint. We recommend ******* contact the CRAs directly regarding any discrepancies as each reporting agency is governed by their own guidelines and procedures.

      During our review of the Account, we identified that the mailing address we have on file for ******* is different from the address listed on this complaint. To ensure we have the most current contact information, if ******** address has changed, please have them to contact us via phone or mail and provide us with their new address.

      I financed a car in April 2023 and have been experiencing issues since June 2023, as, the car is not operable at this time, February 2024. I reached out to the financing company to ask if I could keep liability on the car although it is not operable. Not once was I asked to provide proof of this car not being operable but told in so many words, that, I must keep full coverage insurance on a car that is not operable. I filed a complaint with the ************************* against the dealership because unknowingly to me, the car had been in an accident. I was ******************************************************************************* check. I am trying to do things independently without my parent and I must admit, I made the worst mistake in this car, and now, I am having to deal with the consequences. I got in debt again because I needed a car for my two sons under 2 years old and me. So, I am paying for two cars (one through Exeter and one through Navy Federal). I have full coverage insurance on both cars although the car financed with Exeter is not operable. All I asked for is to keep liability until the car becomes operable again. I had to purchase Triple AAA and wait for the waiting period to have the car towed back to Christian ******** to inspect and diagnose the car to determine if it's repairable.

      Exeter is an indirect auto finance company that purchases contracts from dealerships into which customers enter to finance the purchase of vehicles. Exeter does not make warranties or representations concerning the fitness of vehicles.  Any concerns regarding the condition or any repairs required for the Vehicle, these should be addressed directly with the Dealer or a licensed mechanical shop of their preference.

      ******* is required to maintain insurance that includes comprehensive and collision coverage with a maximum deductible of $1,000 each.

      During Exeters review of the Account, ********************** identified that the mailing address we have for ******* on file is different from the address listed on this complaint.       I noticed I had late payments from Exeter Finance on my credit report. During these months I did not receive anything stating I was late. As you can see, majority of my payments have been on time so I am requesting the removal of these late payments from my account. I am trying to increase my score to purchase a home and would greatly appreciate if you guys can submit a request to the credit reporting agencies to remove the late payments.

      Exeter acknowledges your efforts to keep your account in good standing.

      Regarding the request for a goodwill amendment to ****** credit report, Exeter is bound by the Fair Credit Reporting Act which requires all accounts to be reported accurately and factually. While Exeter empathizes with ****** and the personal difficulties that prevented them from making their payments on time, Exeter cannot falsely report to the ************************* (CRAs) that they paid as agreed as a goodwill gesture.

      Exeter is not required to notify their customers each month the payments are past due. As a courtesy, Exeter will attempt to contact customers by phone who have agreed to receive outbound calls using an automated dialer, or prerecorded voice messages.       Exeters records were reviewed, and it has been confirmed that the information reported to the CRAs was accurate. As such,Exeter will not honor ****** request to remove the valid late payments from their credit file based on the claims presented in this complaint. Any discrepancies between the information reported by Exeter and what is reflected on their credit file will need to be addressed by the CRAs directly as each reporting agency is governed by their own guidelines.

      Under a separate cover, will be a copy of Thomasexecuted Contract and a Statement of Account showing all Account activity through March 19, 2024. Exeter considers these items to be a sufficient validation of the debt. No additional documents will be provided. Please be advised that the Statement of Account is available to ****** at any time by logging into MyAccount.ExeterFinance.com.

      During Exeters review of the Account, ********************** identified that the mailing address we have for ****** on file is different from the address listed on this complaint.       To Whom It May ****************** February 20, 2024, Exeter Finance LLC (Exeter) received notice regarding a complaint filed through the Better Business Bureau (BBB). Exeter would like to thank ********************* (*****) for the opportunity to address their concerns. Exeters success is based on customer satisfaction with our products and services, so the issues presented in this complaint are taken seriously and every effort is made to provide a prompt and equitable response. Exeter has thoroughly investigated the complaint and made the following determination.

      Regarding the payoff check, this is to confirm that Exeter received a check in the amount of $7,573.86 from **************** carrier that was applied to the account with an effective date of December 31, 2023. ***** also submitted multiple payments totaling $15,000.00.

      Due to an overpayment on the account, ********************** has issued the refund in the form of one or more checks that were mailed to Allens address on file on March 1, 2024,and March 11, 2024. 

      Per the previous phone interaction with *****, it was determined that one of the payments received required research. ***** was advised to contact ********* and request a trace on the money order in question. Additionally, ***** was advised of the steps to submit a payment dispute to Exeter once they received the results of the trace from MoneyGram.
